If NBC didn't mean "born here" to the framers, why did they provide relief to that in the same sentence?

My whole point is that this would be a big nasty unclear court battle, and not a smoking gun. Nothing is simple, especially in law.

1) he must be born in the USA. Obama NEVER showed a LONG FORM birth certificate!

An NBC is a citizen by virtue of the position of citizenship being granted AT BIRTH in common law, and if EVER there were a challenge over someones status as an NBC guess who would take up the issue. Article III courts are the ONLY ones authorized to hear such a challenge, and they all operate under common law All blacks are citizens only by virtue of the 14th amendment. This is wholly superseded by the 14th amendment, and also completely discounts the citizenship of the mother. This is in contrast to Vattel's defining naturalization. You are either born a citizen or naturalized and Obama was born a citizen.

Obama the Constitutional scholar knows he's not qualified because he knows this:

Furthermore the quote you reference is before the writing of the declaration of independence(1776), let alone the constitution(1787 12 years later), which is hardly compelling.
Obama was born in Hawaii, and is a natural/native born citizen under current law.

The Naturalization act of 1790 shows the intent of the framers was never to limit NBCs to those born within the US border. The law had unabashed bias, and further limited citizenship to those who were a "free white person" and would be wholly unconstitutional anyways. Current citizenship law is only contained in the14th amendment and USC title 8 sec 1401 -1409. VATTEL IS NOT US LAW, it's Swiss philosophy.

Arnold Schwarzenegger is a US citizen but he cannot run for President because he does not meet the definition of natural born. Even if AS had been born in the USA, AS still would not meet the definition of a natural born citizen since his father was not a US citizen at the time of his birth.

The 14th deals with citizenship not "natural born" citizenship. "Natural born" citizenship is required to run for the presidency as stated in article 2 section of the the constitution.

Ben Franklin's letter shows Vattel's Law of Nations, where natural born is defined, was used as a reference to write the constitution. I've looked hard but found nothing that would negate the requirement that Obama's father would have had to have been a US citizen when Obama was born.
The issue has been confused but the confusion could be cleared up if people ever really got the chance to hear about it.

Basically even if Barrack Obama was born in Kenya, he is still a natural-born citizen qualifying for the president under article II section 1 of the US constitution, as defined by congress in the US code. Congress is given the authority to define citizenship in section 5 of the 14th amendment and in Art. I Sec. 8 clause 4 of the US constitution.
Obama's mother, Stanley Ann Dunham, was a US citizen who lived in the US for WAY MORE than 5 years before Obama's birth.

In fact said section goes out of its way to give exception to those to be considered at the time of adoption if they were born outside of the US. This isdue to the small number of candidates available if NBC were the only qualifier at the time. No you must be born here. Thats what natural born means. Thats why its an issue.

Considering FEW PEOPLE WERE BORN ON THE CONTINENT AT THE TIME this is understandable. US code Title 8 blah blah blah is not part of the constitution. I suggest you do some more research.

However the military context in a foreign land is something the constitutional framers didn't anticipate in regards to this and it seems appropriate to have this adjudicated. Some claim Obama was born in Hawaii, they have a COLB, a newspaper announcement, and local officials who have verified the long form BC(that's called supporting evidence). Others, claim he was foreign born, but they don't have a single shred of evidence. You can choose to have faith that he was foreign born and disregard the actual evidence, but that just makes you a credulous fool.

@mstraney a Connecticut SS # is a smoking gun. Refusal to release your BC is a smoking gun. Releasing a COLB with the term "African" on it, which was not used back then,which was made with photoshop is a smoking gun. Getting into harvard with bad grades is a smoking gun.
But again you have to have some interest. You do not. At the end of the day, he has hidden his BC for some reason.I can only imagine the outcry if GW had hidden his, and a new gov of Tx siad he was going to find and could not

@mstraney Yes I am aware of OR and am in general agreement. I do not put any weight in those who say Obama was born outside the country nor do I have any faith that he was born outside. But I vehemently disagree in a COLB having any meaning in this regard since the law allows a foreign born to have one saying they were HW born. Officials have ONLY stated that the LFBC exists - they have stated nothing regarding content. Respectfully, no one knows what the LFBC says.

So you are absolutely incorrect. John McCain is a NBC under USC title 8 section 1401(c), and some have argued that he qualifies under USC title 8 sec. 1403. However sec 1403(canal zone) is generally regarded as applying to those that 1401 does not, and furthermore does not mention citizenship at birth specifically.

@mstraney While I understand and appreciate your references, I must point out that these references didn't even exist until century(s) later. And the 14th amendment was introduced to give slaves the benefit of citizenship. The constitutional presidential requirement must be applied as it was intended thus the interpretational problem. If NBC didn't mean "born here" to the framers, why did they provide relief to that in the same sentence?

They didn't. They provided an exception for naturalized persons(i.e. citizens but not by virtue of birth by place or blood)

It is interesting to note the marked absence of "NBC" in the requirements for the legislature though. They thought it was important to single out the president as being an NBC. @Scott757200 I don't remember exactly what I wrote. I'm think it was about how the 14th amendment and current law have modified and expanded the understanding of which persons are citizens at birth. Also, I'm pretty sure that the Nat. Act of 1790 is the only extra-constitutional law to use the exact phrase NBC, so the framers intent must be determined from it.
My whole point is that this would be a big nasty unclear court battle, and not a smoking gun. Nothing is simple, especially in law.

@mstraney If that is the case why isn't the qualification regarding citizenship the same for congress? It appears to me that there is a purposeful difference between the 2 (3) offices the constitution addresses. I think it is reasonable that the framers intent is that the office of president be held to a higher standard. Thoughts?

@Scott757200 If a 40 year old British immigrant were to have come to the US in 1790(post ratification), they would have become a naturalized citizen under the 1790 nat act two years later in 1792, but they wouldn't become eligible to serve in the House of Reps until they were "seven Years a Citizen"(art1 sec2) in 1799. They wouldn't become eligible for the senate until they were"nine Years a Citizen"(art1 sec3) in 1801. They would NEVER be eligible for the presidency. It's all about Spider-man
