i was shocked 13 x while in the shower because the rep turned mine down as he was interigating it and didn't turn it back up... so painful i to thought i was dieing and now i sometimes have anxiety attacks while im in the shower.
RE: SWAN- Bridget testified before Congress about medically documented 31 shocks in 13 minutes and the importance of the Medical Device Safety ACT for patient's safety. She cannot sue because the courts have preempted any lawsuits against the medical device industry. Preemption did not exist until recently, so you were able to sue b/c it was BEFORE preemption. I would suggest that you inform yourself on this issue since you have a defibrillator--and before making a comment like that.

I realize u cant sue medical practice. but my friend there was over 100"000 recalls and they were still using them after the fact... turtle ur killing me smalls, we filed a class action suit 6 years ago well before this hearing... screw these people.. if you had a defective dfeb from medtronic i encourage u to look into a lawyer.. there were so many people they had to split them in catagorys

This makes me really mad. The Medical Device Safety Act needs to be passed so this does not happen to anyone else. Doctors will be getting sued for the deceit of the medical device industry. How is this happening in America? Robert Weiner said that the medical device industry is not wrong b/c they did not disobey the FDA? Seriously Mr. Weiner? How about selling a defibrillator lead that you KNOW is bad and not recalling it until 3 years later? Isn't that wrong?
How sad. I can't believe that in this country a medical device company can sell something that they know is bad and not be held accountable. The FDA's job is approve a product they believe is safe. It is the manufacturer's responsibility to maintain the quality of it's products and pull them off of the market when they know they are bad. Without the ability to sue, there is no guarantee of safety for the patient. No ability to sue=no accountibility.
