  • ... However, if the rider refuses to cooperate and ID then he can be arrested and his identity can be established at the police station. Sec 25 PACE says that if an offence is committed and 1 of the arrest conditions apply (IDCOPPLAN) then a subject can be arrested. The A and N of IDCOPPLAN is Address and Name, meaning if you can't establish these but they have committed an offence, they can be arrested. I would've nicked this guy a lot earlier in the conversation!

  • @bennygribbon The law does cater for cyclists, they are dealt with in the same way as drivers. If you committ an offence under the road traffic act that can be dealt with by way of a Fixed Penalty Notice then the rider must accept to enter the FPN scheme and provide ID, and admit he committed an offence. If he disputes it he can refuse the FPN, but with ID the officer should then report him for the offence in a process book and he will receive a court summons...

  • Someone perhaps has put this on previous comments, but this is for the benefit of other youtube users: Under the Road Traffic Act 1988, cyclists must obey all traffic signs and signals. A cyclist can be fined for failing to do so and that includes failing to stop at a red traffic signal. This is a summary offence and can be dealt with by ways of a fixed penalty notice. In order for an officer to issue that notice, he/she require the rider's name and address. Failing to provide these....

  • i'm a cyclist myself & running a red light is against the law regardless of whether you're a motorist or a cyclist & the officer was executing his duties correctly in INTENDING to issue a fine. However, if what the cyclist said is correct it seems the law system is at fault cos the cyclist wasnt OBLIGED to take the paperwork, & he wasnt OBLIGED to give his personal details, so how could the officer issue a fine? The law needs changing so cyclists MUST take the paperwork or give their details

  • I see the usual kind of simpletons I've come to expect from youtube are out in force. The rules that apply to drivers do not apply to cyclists, because driving a car is a far more potentially dangerous operation than cycling a bike. There's a reason that a 12 year old with a cycling proficiency can cycle on the road but to drive you need to be at least 17, passed both a theory and practical exam, be fully insured, etc etc.

  • Secondly it is not at all unreasonable to expect police officers to understand the laws under which they can and cannot arrest someone, and to recite them when necessary. Too many officers get away with bullying tactics and allowing the public to assume that a policeman knows the rules and laws better than them, which as we all know is not often the case.

  • By failing to obey a traffic signal, a red light, the camera man has committed an offence under Section 36 of the Road Traffic Act 1988 & The Traffic Signs Regulations and General Directions 2002. As an offence has been committed he is legally required to provide his name and address to the Officer. Police Officers are not lawyers and do no not need to recite the law upon request...

    5: The fact that there is no injured party is just a matter of good fortune. Road traffic law exists both to punish those who cause actual - very, very real - injury as a result of improper use of the roads and those who RISK causing injury as a result of improper use of the roads.

    6: Britain's roads are not common land, if you want to use them you must abide by the relevant laws.

    That's not the full story. Danny (cyclist) is requesting clarification of the law(s) being imposed upon him. This is a valid approach if you believe we're all equal under the eyes of the law, and that any form of authority must prove jurisdiction before being able to act upon you. Clarification is key when dealing with legal/lawful matters, but few of us seek it due to time, pressure & fear. Question everything.

  • Great video. I wish I had a head-cam, too. Got pulled up for doing right turn at a possibly red light in Lyon, France. Guy got my details but never gave me a ticket, never arrived in the mail, either... Of course, not knowing French it wasn't so easy to argue with him much. Not sure if there are any rules here about refusal to comply with a police request for identification. Probably - it's France. Would be fun to be able to ask if THEY knew the rule, though. Then I could look it up. Good job!
