I bet if this accident was with innocent americans dead I am sure if the 2 pilotes of the legazy were brazilians and survived they would be locked up in prison for the rest of their lives.

Brazilian ATC cleared the Legacy at the "wrong flight level" for this flight. The Brazilian authorities have acknowledged this is true. As for the transponder being turned off is one thing, failing is another. Is it possible that a brand new plane might have had a faulty transponder installed? By the way as a pilot I've been ordered by ATC to fly at the "wrong flight level" before. I normally ask if that is correct but have been told yes every time. I've also had the transponder fail.
@zafirsaad Let's say they did want to "chill" in the back...what's the point of turning off the transponder??? It doesn't tell anyone they are not in the cockpit. If they were not in the cockpit, all the more reason they'd want it on. It's like saying they'd turn off the autopilot so they could be out of the cockpit. That's not nothing to do with anything. There is NO reason to intentionally turn it off. It had to be malfunctioning or off by accident.

They turned off their transponder because they wanted to chill in the back with the NY Times reporters.
Even tyhough their altitude was wrong, the ATC was trying to contact them minutes before the crash, they were not in their seats.
Just because they were assigned a wrong altitude, it doesn't mean that the accident couldn't have been stopped.
If Transponder were on with TCAS and they were sitting in the cockpit, they would have heard the warning.
