It depends on whether or not the game stores/fixes other variables (ie, whether or not the round has finished) than player life at the start of the timestop - it's also possible that the "get up" animation when downed has different properties to the normal one.
My guess is that he could cancel into it, but he probably wouldn't cause the instant-kill; that would depend on Dio's life at the end of the last round.
Well if Jotaro and Dio both perform their Toki-yo Tomare at the same time, neither of them would get stuck, but once it occurs the other characters is stuck and is open for a beating.
This is why Dio isn't in any more games. PS3 can't handle his power.
