Iraq was unconstitutional because there was no declaration of war or no eminent threat. The Patriot Act allows the government to spy on dissenting citizens without probable cause or a warrant. The Patriot Act is hardly defunct, as you put it. There is nothing in the U.S. Constitution that gives you or any of us the right to vote. Our national vote is a privilege. The constitution only grants elected officcials the right to vote in a national election. Constitutionally, majority rule doesn't apply nationally.
