Kidnapping requires you take them somewhere. If you point a gun and someone's head and tell them to stay there, it's not kidnapping. You have to change locations, take them against their will to another location. Not twenty feet away location but you know, at least across the street.
This is just unlawful arrest and possibly unlawful detainment.

Now if the guards pushed him and he keep on persisting with the camera it was up to the property owner to come out and claim that he was trespassing. Getting your rights violated happens with both parties. The editor had a right to ask questions and should know what her can and can't do. He pobably will not be charge for anything which is right. But he should have known better to keep his distance.In the guards eyes he is a nusance and pushed him and when he pushed back he became a threat.

Tony Hopfinger, editor of the online Alaska Dispatch, tells KTUU-TV that security pushed him as he tried to question Joe Miller on Sunday. He says he pushed back and that guards then detained him, accusing him of trespassing at the public event in Anchorage.... HIM PUSHING BACK IS WHAT GOT HIM INTO TROUBLE... If someone pushes me I would push back but don't go around saying that someone violated your rights when get physical.
