If there are gun laws, they are not enforced until someone is shot or finds a stockpile of Kalashnikov in a crack house. Ive personally fired a few automatics that i know aren't legal.   • You're smuggling in a standard of warrant outside the executive's discretion. "As commander in chief", he could judge it necessary, and on the reasoning you've given me he has full right to do so. After all, it seems, that anything goes when you claim to be protecting America.

    If this is not so, tell me why not. Tell me what ground denies him that power. If you say that he cannot do so because it would be to violate the constitution then you must *also* say that Bush is limited as well.

  • well, if Obama had enough internal support to extend his term then I guess he could do it. Republicans of course would be up in arms about it. Bush had enough internal support for his preventitive measures, he asked if it was legal and the answer was yes. Democrats of course don't agree. you do realize that if this really was such a black and white area then Bush would have been impeached many many months ago. that didn't happen.

  • can he do it by law? probably not, it would have to be ruled upon by the federal court to determine if it is within his right. a federal court has already ruled that Bush's wiretapping did not violate the 4th ammendment due to his precautions taken and the nature of conducting those wiretaps.

You have argued to the affirmative in the past. You have now changed your claim. You now say that the actions of the NSA are constitutional because they meet certain legal standards as determined in a court ruling. This amounts to admitting that the president is accountable to the law. Of course, these memos applied to far more than the NSA

  • my original claim was that Bush broke no laws. the entry of Iraq was authorized by the Congress. the wiretaps were deemed not to have violated the 4th ammendment. what constitutes torture depends on who you talk to. a declaration of war does not mean a president can disregard the Constitution or the Bill of Rights and Bush didn't violate either document according to the rule of law.

    That is a different claim from the one you are making now, i.e. that the president has to follow the law and that Bush did follow the law.

  • yes, parts of the Constitution can be considered to be red tape as it was never nor could be designed to address this type of 21st century terrorist warfare. Bush needed immediate lattitude with the ammendments which would have been prohibitive to maintaining national security. he worked within the law to do this and the federal court agreed considering the circumstances.

    To change the topic, it's not clear to me how, with respect to the general rights outlined in the constitution, war has significantly changed. Things have larger effects and can be done quickly, but how does the bill of rights fail to accommodate for that change?

  • you're completely right, of course. the same people who would be most offended by the way this man used and abused the law to subvert both the constitution as well as our civil liberties are the people who would demand justice through due process and the rule of law, not by a lynching. that being said, i question the decision to put this man in the position of helping to shape the minds of future lawyers.
