  • Hmmm...does she not understand why those words were put there in the first place? The Bill of Rights and Constitution were put in place to protect the people from sliding back into subjugation (slavery). Who the hell gives her the right to take that away? Does she have the authority of God and we just don't realize it? This is not a Rebup or Dem issue. This goes to the very core of our American Sovereignty. People like this are our number one enemy no matter if they are a D or an R!

  • Elena Kagan is facing the Castle Defense: When your life & limb is threatened, and you cannot retreat; this is the Castle Defense when you take a life, and States often only allow you in your own home (castle) for such a thing. In a higher legal standard, is there any right to defend yourself? As we see the Constitution give war powers, and the United States does face war; the question means self-preservation, and Elena Kagan cannot find any self-preservation duty for someone who holds law.

  • There are inalienable rights for ALL HUMAN BEINGS, intrinsic to them from the moment of their creation. And the actions of the governments of the world - at very least in living memory - shows that NO CAREER POLITICIAN believes that there are inalienable rights, here in America or elsewhere. Their power can ONLY increase by eroding the rights of the People, and ignoring the rule of law.

  • Not knowing anything about the two women behind Senator Coburn, I was looking at their faces. The mouth on the brunette slowly opening as nominee Kagan spoke. I hope that was duplicated throughout the room and with all who see this. Notice the glance by the blond. All this could be something not a part of her testimony but I think that it is a view into the people's minds concerning her answers and Our Constitution (Dec. of Inde. and Bill of Rights).

  • Wow....she gave a very good answer. Senators and congressmen love to speak in terms of "belief." Kagan has the clarity of mind to remind the senator here that her personal beliefs should have no bearing on how she judges law should she become a justice. Policy questions such as whether we have inalienable rights is best left to Congress, not the Supreme Court.

    Umm there is no question whether we have inalienable rights, it was already stated in the declaration of independence (and even if not any idiot can tell you for example that your right to live does not come from the government, it is inalienable), so the simple question was whether the Obama rubber stamp Kagan agrees with the declaration of independence... of course she would not, because like her master they HATE AMERICA and want to destroy it.

  • @alexckfang Wrong. Inalienable rights are the basis of all claims of government behavioral legitimacy. For example, if there was no inherent right to one's own property, then government would have absolutely no claim to punish a thief.

So when a criminal murders someone in the USA that means according to you that suddenly the right to life is null and void? Just because some 'war lord in Sierra Leone' kills someone does that suddenly mean the inalienable right to life doesn't exist? All it shows is why the US needed the constitution - TO PROTECT THOSE INALIENABLE RIGHTS FROM THE GOVERNMENT.

    According to justice Antonin Scalia from a case back in 2000:

    "The Declaration of Independence...is not a legal prescription conferring powers upon the courts; and the Constitution’s refusal to 'deny or disparage' other rights is far removed from affirming any one of them, and even farther removed from authorizing judges to identify what they might be, and to enforce the judges’ list against laws duly enacted by the people."
