  • I believe that refusal is harmful act. Incompatibility to be in harmony. I believe refusal might be considered as an act of war!

    What do you mean by being infringed or violated? How would a present(presentment, statement) be a trespass? I believe some person is willing to serve another and the another is bluntly refusing to accept the gift.

If your neighbor offers to build a buddhist temple in your front yard, a simple notice of refusal is the accepted and customary way of dealing with that. There is no war. There was an offer and a refusal. There is peace. The offer had no authority so refusal is honorable and rightful.

If "peace" can only be restored by capitulation, then tyranny may be performed by making simple courteous offers. You have no peace when you have slaughtering tyrants who make offers which empower themselves. Human dignity, rights and destiny must be defended, sometimes, to PREVENT a loss of "peace".

  • @RICHARDIVANdotCOM Our legal system and our culture do not see acceptance of gifts as obligatory. You may be referencing another national culture. In that mindset someone could offer you a "gift" of a bullet in the head and you would have no recourse to refuse. You would be required to stand still as the gun was fired.

  • @minivanjack well would you not agree that you have a moral obligation to the person to accept his service to you? He's offering you value, money, no?

    I believe the example of a bullet in the head is a bit extreme, but let's say that you would not disagree with him on that matter, but "conditional acceptance" you would present him consequences of his action = death by your friend.

    Would he chose to accept or would he rather offer a termination of the agreement? That's the question, isn't it?

    -Your assailant may accept your terms.

    -You have no right to enlist your friend for a violent and controversial act.

    -Your threat of violent consequences is no less "act of war" than refusal.

    -Your friend may refuse or fail.

    -You have lied by saying you are conditionally permissive of fatal violence against you.

    You may wish to re-evaluate your core theories.

  • @minivanjack This scenario is just stupid. Would I die? Fuck it, the other person would die also, if he choose to do it. But any way in a normal case:

    If somebody would threaten me with a gun I would have right to defend myself against him any way I please without being liable for my actions.

    In case of an offer, I believe there is no rational person which would offer me to give me a bullet, do you?

    What I was suggesting by saying that refusal is an offence was rather a "normal" transaction.

  • @RICHARDIVANdotCOM The example was extreme, but perfectly applicable to other circumstances. If I make an offer of seafood, and you are allergic to seafood, you may refuse in honor. In fact, you don't need an allergy, or any other excuse. You just need to respectfully state your position. That is honorable refusal. Never allow yourself to be trapped by a manipulative offer.

He says one thing, you think another, he asks you whether you get it and you say yes. But he never defined the words he used and he might have meant something else then you think the words mean.   • @RICHARDIVANdotCOM Your sentence structure is not clear. All the warrant does is give the enforcer some encouragement by, sometimes, a corrupt court, to use force on you. You are then under threat of force and you will be harmed if you do not submit to force. This is no longer an offer. It is a threat of assault by overwhelming force.

Those offers may, in honor, be refused. To accept a destructive offer is not to create "harmony", it is to harm yourself and empower another to harm you.

But to know which is best for a situation depends on the situation. The important thing, if you are being infringed or violated, is to make notice of refusal so that you have recourse. Failure of refusal is acceptance under the perverted Uniform Commercial Code.

  • That works for me. But judges are so corrupt they now throw tantrums and threaten "contempt" against anyone who challenges their corruption. I have recently witness absolutely blatant and shameless commission of judicial corruption and failure to enforce against bank fraud. It seems to be consistent throughout the justice system. There is no longer rule of law in our court system We will soon have to find a way to shut down the courts and come up with a better system to administer justice.

  • @minivanjack It's just sickening. Are you familiar with Larry Fine out of California? I think he was an ex judge or something like that and tried to expose the corruption. He gets locked up for a year, no charges for over a year, the judge lets him out right after/before??? he retires. Fraud and corruption=The new rule of law.

  • @F8LXEPSHN His name is Richard Fine, an attorney. He was improsoned for 18 months by Judge Yaffe (L.A. Superior Court) for "contempt of court" in retaliation for exposing judicial corruption. Judge Yaffe has retired and has not been prosecuted for ordering and maintaining Fine's imprisonment on fabricated cause. The failure of prosecution points to corruption on the part of the California Attorney General (spanning the terms of Jerry Brown and Kamala D. Harris). Jerry Brown is now Gov. of Calif.

  • @F8LXEPSHN Yes, the best Harris can do is sue people who are trying to HELP people in foreclosure. What about prosecuting the CEOs of the banks for illegally foreclosing and selling homes? When a bank commits fraud with robo-signers, lending fraud, securities fraud and illegal home foreclosures you would think a few of those CEOs would be in prison by now. How is it any different from what (convict) Charles Keating did in the 1980's? DOJ could have stopped this foreclosure crisis three years ago

  • @minivanjack It's just crazy. I filed a complaint with the Office of Thrift Supervision for Aurora Loan Services foreclosing on my house. I asked them if the prom note I signed is what funded the loan and paid for the house and that you didn't loan me anything. They sent me a copy of my note with 2 endorsements on it. SO I sent a copy of that back to themn and said, "See, here's the proof" that person that sent me that isn't working there anymore or they assigned my case to someone else.

The saddest part is the courts are corrupt and the DOJ is not protecting people's houses or prosecuting the bank CEOs for the fraud (robo-signers, forgeries, lending fraud, securities fraud etc. etc.) The judges are all vested in bank equities, and none of the seem to understand the term "conflict of interest".

Once you send them a notice to prove they loaned you money their pretense of integrity is over. You seem to be one of the few who know that banks don't loan money, you create the money when you sign the note. It's your money. They take it by fraud and trick you into paying it back. What is FINCES?

  • @minivanjack I meant Fincen. Fincen.gov I now have evidence to the fact that the note paid for the house cause they sent me a copy with 2 endorsements on the front. That right there is proof that they defrauded

    me by deception. Told me I was getting a loan when I wasn't. Game over. The only obstacle is the courts. Even Walker F Todd stated that it was an even exchange of energy in an affidavit and who would know better. The court wasn't having it.

  • @F8LXEPSHN By far, the corrupt courts are the problem. It's one thing to commit fraud. It's a REAL problem when they ENFORCE fraud. We have to get some judges into prison. If FINCEN was real at all they would have prosecuted 500 bank CEOs by now. There is no govt, no rule of law. It's just a matter of when everybody realizes it.

  • @minivanjack Unfortunately I don't see that happening in my lifetime. No one I know even wants to hear it and just buries their head in the sand or gets pissed and calls me crazy. Usually they get pissed. I've been into this stuff since junior high. I'm 46 now. It's a lonely life. I can't even get someone to look up the definition of a note. If you like to be ridiculed, tell someone there's no such thing as money. For sick amusement only. Waking people up IS NOT easy.

  • @minivanjack June 5, 1933 HJR 192 took away the gold and the people were stupid enough to give it to them. Technically and legally IMOwe should be able to create our own prom notes. See UCC1-304. Similar to A4V but better.Take it to a private banker.Credit is all there is and it's unlimited.Actually genius if it weren't for the fraud. I'm seriously contemplating doing this. The ultimate test. Deny my claim of right I call the secret service to compel or get locked up for utilizing the truth.

  • Why not just send affidavits to all the big corps. If they don't rebut in 30 days they agree to pay you $5000 a month for 99 years. When the fail to answer, send an invoice to risk management for payment. Should they refuse then you'll have to sue to get paid.

  • Keep in mind, your food was bought with paper, the value of which exists only by agreement. Somewhat similarly, our math system would not be where it is if we did not agree upon giving value to some arbitrary representation of, well, three items.

  • I am not sure if an affidavit has any force, as all it is, is simply paper, just something to memoralize an event. I actually have first-hand knowledge of creating my own affidavit, and having the so called government and courts ignoring the affidavit that I created, it had no effect at all to those that think they have authority or jurisdiction over, as I said it was simply ignored by those.

  • @LetFreeman That is indication of a corrupt court and corrupt officials. There can be defects or lack of credibility in affidavits, otherwise they must be accepted as fact and law unless rebutted by sworn testimony. A corrupt court will pretend they can ignore a defendant's evidence and testimony. That is when you have to know some law, know how to object and know how to put the court (the judge) in liability for its failures and violations. Many courts don't protect, they violate.

  • @minivanjack Keep in mind that I am not an attorney and I do not give legal advice. I am on Youtube for entertainment and mutual exchange of information. The more you personally know about the law the more successful you will be. We are up against some very greedy and evil people. There are many other people getting fed up these days with government violations and you can find groups, resources and information with searches for topics that concern you. The law library can be very helpful to you.

  • @Albukhshi Remember, in order for an affidavit to be powerful it must not be rebuttable with truth and fact, or it must not be rebutted by the receiving party. Also, there are a lot of judges who like to ignore the law and make up their own rules. Technically a court may not rule against an unrebutted affidavit, but judges often do not seem to care what the law says they must do. I am not a lawyer or legal adviser. These are just opinions based on my experiences.

  • @Albukhshi Include all the elements: A clear title of contents with the word "Affidavit", a statement of fact, a demand or claim for remedy, a clear statement of terms and conditions if the affidavit is not rebutted within 30 days and the signed, sworn notarized statement "under penalty of perjury".

  • @Albukhshi Also remember, if your affidavit is dishonored you may have to pursue remedy through legal action. If your affidavit is well done your legal pursuit will be much easier. Usually courts (judges) expect you to give your opponent three chances (three affidavits), each with demand and titled "second notice", "third notice" and then to send them a final (fourth) affidavit "Notice of Default". Always send by certified mail and save the signed cards. And NEVER send the original, just copies.

  • @Fekenator Affidavits are used in court every day. The only variables are what is in the affidavit and how honest or corrupt the court is. A corrupt court can destroy anything, but an honest court cannot over-ride or rule against an affidavit unless there is a rebutting affidavit from the defendant of plaintiff. Affidavits are sworn testimony. The court may not testify. (disclaimer: I am not a lawyer or legal professional.)

The video is mostly about "representatives" that fail to represent the people who voted for them. 90% of Americans opposed the bailouts and "stimulus" programs, 80% are against the war in Afghanistan. Anyone in Congress who voted for those is a traitor and a criminal in fraud against the American people.

I'd be interested to know what you think of the whole "free sovernign" movement I've heard of where people use affidavits and stop accepting cash, paying taxes, and unlicense their vehicles. Some people say its just a bunch of false legalese and some say its the real thing. I have no idea what to believe.

    The sovereign movement, while it may seem radical, is simply a re-assertion of original intent of our founding fathers, and if that movement does not succeed the only alternative for Americans is slavery under world government for many many decades. Government never bestows freedom. Freedom only exists where it is demanded and taken.

    I am not entirely clear on what you are doing, but any process that would be accepted by a court as a sworn statement should be effective as an affidavit. It would stand as law unless rebutted by another affidavit if those were the conditions of the original affidavit.

  • @PoorMansPlato A fax of a notarized statement should generally be accepted since you can provide the original. Anything digital is subject to hacking and forging. I would avoid that if possible.

  • @PoorMansPlato I am not familiar with e-signing. Faxing should be OK but it's not as "legal" as Certified U.S. Mail. With affidavits you generally don't send the original, so the fax may be OK in some cases as long as you maintain a record of confirmation of delivery which some fax machines can make.

  • I am danish. As I see it, we have no opportunites like this, at least I can't figure it out, far from.

    We neither seem to have the possibility to get "free man on the land" or "Alberta" status.

    I am slowly coming to the conclussion that the people of this country, are held firmer in place by law, than in most other countries.
