This is why the use of acronyms (i.e. "DWI) is way to rampant. One hears DWI and doesn't THINK, an assumption is just made. If one hears "Driving while Intoxicated" it means DRIVING (not sitting or sleeping) while intoxicated. And FUCK the "case law" excuse given by the prosecutor. If that's the case law, then no more convictions for DWI under these circumstances UNTIL THE CASE LAW IS CHANGED!! This case is about prohibition, not about DWI thanks to MADD.
I saw this happen on COPS once. The officer said that you can be sleeping in the car while intoxicated but have to be seated in the back or in the passenger seat. If you sleep behind the wheel then thats' when they can arrest you. I forget which state they were in but I thought it was unfair at the time but I can see both sides to the arguement
Unconstitutional laws as in this particular state are passed by a lobbying group known as MADD. Clearly this is about prohibition, not about driving while intoxicated. Next time walk home or stay outside, but don't get in the vehicle until later on when you can work on changing these unconstitutional laws. What a tragedy.
@jamesr197307 I understand your point, but if an intoxicated person decides to walk home, they still run the risk of bein' arrested for "public drunk." I've actually witnessed this happen before. Like I said earlier, it's a catch 22.
@YellowBoy21 At the man's BAC level, probably could have walked just fine to not have any problems with officers. Plus, public intoxication is a minor offense compared to DWI. My point was, he was sleeping in his own property (vehicle) in a public parking lot, shouldn't be about walking home, it should be about sleeping in your car and being left alone, intoxicated or sober, period.... there was no DWI involved, that requires driving, or atleast it should of course.
