If we all followed your belief nobody would be writing, painting, acting or the like. How can I earn a living if when I write a song anybody can record it and I don't get paid, yet I have spent the time, effort, talent writing, playing, and recording. 50 years after I have registered the copyright anyone can record it which is fair.

No it belongs to the person who owns the copyright. If it's not copyrighted then anyone has access to it. I don't know if Dan has copyrighted the track but I would assume so. I own all copyrights to all my songs and if someone was recording one without asking me first I'd be pretty pissed off about it. Unless it was for charity(If you know what I mean)
