Last year the Supreme Court ruled the term 'navigable waterways' in the CWA did NOT give regulators the right to govern anything beyond what a boat will fit into. Effectively nullifying the entire wetland protection apparatus of the federal government that has evolved over recent decades. So Congress is resurrecting those protections in more explicit language.

Pollutants infiltrate groundwater through waterways (not just navigable ones) and do not decompose in aquifers for decades. Preventing industries and farmers from dumping their toxic waste into our waterways prevents it from ending up in our drinking water!
