This judge was working off zero evidence that this defendant had received any such earning statement. If a lawyer were to point around the room are start asking anybody and everybody questions regarding a case, any judge would have shut them down immediately; however, this judge thinks it's ok for him to do. It is my understanding that only citizen OVER the age of 25 used to receive them, so without knowing his age - there is a chance he never got one.
This is a classic diversionary tactic on behalf of that lawyer - She was losing and being pwned badly by the judge and saw his comment as a way out.
The judge didnt make the comment to infer she was an illegal alien, he said that to show that she must be getting sent those forms every year as a US citizen.

When you look at it it shows your Soc Sec. contributions for every year you worked and what your monthly benefit will be when you start collecting. Mine shows all my contributions back to 1974 as well as my entire salary history.

My father was a judge, when he was young and first starting he wanted to throw everyone in for as long as possible because of the scum he had to deal with, then he was told by his mentor that there just arent enough cells for that and to start trying to find more linient ways to deal with soem of the less serious crimes. Now he is well respected by everyone, and is a well balanced and fair person. This judge coud learn the same.

@cmbsoldja I'm not sure what backwards state you live in, but here in California we have judicial conduct rules for judges. You can access them online. Judge's actions and activites are extremely regulated, including some actions OUTSIDE of the courtroom.

First of all, the lawyer is there to defend her client, not get into a side discussion about her personal dealings with SSA. Second, the issue on the table (raised by the lawyer) was why the lawyer was not receiving a SS notice at her home. The judge's comment had to do with that.
While in the Marines i didn't get a W2 for 2 years, after my first deployment . Some people in prision havn't gotten it. Knowing the facts on the case would be what sways me one way or the other. The important thing in this case is that, It is not the Judges position to argue with the lawyers over something that can't be proven 100% received or not . Tax returns do not come as certified mail. To stipulate something that can't be proven by the judge is in poor taste.

@maxismax100 As far as I can tell the judge is talking about a SS statement, which is the statement that shows you how much you would be able to draw if you went on disability or retired based on what was paid in to that point. A W2 is mailed out by your EMPLOYER, not SS. Additionally SS statements are NOT filled with income tax, since all of that information is on your W2. The government knows you have a job when you file your W4.

@cmbsoldja I'm not sure what backwards state you live in, but here in California we have judicial conduct rules for judges. You can access them online. Judge's actions and activites are extremely regulated, including some actions OUTSIDE of the courtroom.

@UnscrupulousAgitator HAHA Have you ever been in a court room. A judge can say pretty much whatever they want. Any judiciary review would have looked at and concluded that it was an honest question. RETRIAL? Are you kidding me. Retrials are for serious mistakes like jury tampering or lawyer error. She would have to prove judicial malfeasance. This she cannot prove by what I have seen. And leaving her client int he court room alone would have been the bigger concern for any review.

First of all, the lawyer is there to defend her client, not get into a side discussion about her personal dealings with SSA. Second, the issue on the table (raised by the lawyer) was why the lawyer was not receiving a SS notice at her home. The judge's comment had to do with that.

While in the Marines i didn't get a W2 for 2 years, after my first deployment . Some people in prision havn't gotten it. Knowing the facts on the case would be what sways me one way or the other. The important thing in this case is that, It is not the Judges position to argue with the lawyers over something that can't be proven 100% received or not . Tax returns do not come as certified mail. To stipulate something that can't be proven by the judge is in poor taste.

@maxismax100 As far as I can tell the judge is talking about a SS statement, which is the statement that shows you how much you would be able to draw if you went on disability or retired based on what was paid in to that point. A W2 is mailed out by your EMPLOYER, not SS. Additionally SS statements are NOT filled with income tax, since all of that information is on your W2. The government knows you have a job when you file your W4.
