  • actually R tard, im in 10th grade and i just found out the hard way recording YOUR OWN everyday life is seriously illegal. because of the fact that people in the background werent informed and possible product placement. so shut up about copyright laws being obvious and for the dim witted to not understand

  • What you don't realize is that the voyeurism act doesn't include people on screen for less than 5 seconds.. .So if someones walking by no one cares... The product placement thing would be an issue, if the individual companies didn't consent to nearly every use of their product in video and audio publications...

  • I'm amazed that marvel hasn't shown you more support, you're quite obviously a True Believer, but alas the days when that mattered are long since passed. the real problem is that most of the characters, when appearing on film, are not even controlled by Marvel or DC but by the studios who optioned the movies. they should change the copyrights so that the characters can legally reappear on the web. you should be seeking work as a voice actor, you're extremely talented.

  • part 2- granted most parody song writers respect the artists and as a courtesy they usually get permission from the original artist, but by law this is not necessary as long as it is done in parody with new/ modified words. The difference between the Vanilla Ice example and a parody is Vanilla Ice lost based on a few bars because his work was serious (at keast ti him anyway) and directly copied other work. If Vanilla Ice had written a song parody using the same bars of music he would have won.

  • part 1- ref what's a parody and what isn't and the fact that mad magazine changes the names of the characters. It is all subject to court oppinion, IMO IJSRG would win but is it worth all the pain, costs and burnt bridges it might cause. David Bowie sued Vanilla Ice and won for him exactly copying a few bars of music. Parody song writers can legally change use every bar of existing music w/ out songwriters permission and a slong as they change the words and use as parody they are g-to-g.

  • yeah but the parody has to be technically different from the source material, and as they use actual action figures and names, it would still be copyright infringement

  • If this was copyright infringement, then it would be violating the terms of service of YouTube and all of IJSRG's videos would be removed. Parody can use the names and images of the source material and not be infringement. Example: Mad Magazine who's done literally hundreds of parodys on Marvel & DC characters.

    But what could happen is Marvel/DC could pursue legal action anyway which would incur huge legal fees for IJSRG.

  • You are missing a few facts Michaela. First, MAD magazine has never spoofed ANY Marvel or DC characters. Perhaps they may do parodies of BatDude or Spider-Guy, and perhaps these characters may have a Resemblance to certain Marvel and DC characters, but they would certainly never steal those copyrighted characters.

    Speaking simply, they chance character names and thereby have a loophole.

    Also, it not illegal to parody copyrighted materials As Long As you do not make a profit off it.

  • And Marvel already has a history of doing just that. Just ask Jim Shooter and Defiant comics. Or don't. Marvel put them out of business (and lost a lawsuit doing it)

  • Only 3.50? You should get more than that so I'll get two. If you feel you can't get the hundreds or thousands of T-shirts you might need to sell, first just try getting twenty or so. Then just autograph 'em and auction them off. That shouldn't be hard to pull off.

  • Just to be clear, if you look further up the list of ALL of the comments, you will see that there are a number of negative comments I have left up. The person in question accused us of stealing. How can we not be expected to respond to an inflammatory comment like that? We deleted the accusatory/offensive comments, that is all. We are all for free speech, but we will not tolerate baseless and false accusations. For the record, thank you for your support.

  • Why can't I delete comments on my own videos? The person in question whose comments I deleted was being rather accusatory, which I did not appreciate. His comment was also untrue, so I cleared it up with another comment. We did not start this. We are simply trying to ask for some support. It is rather disheartening to see this kind of reaction, I must say.

  • It is legal to sell the commentaries because we are only selling a recording of us talking. Selling the videos would be a problem. This is how it is legal for RiffTrax to sell commentaries to movies they don't own the rights to.

  • random dude- in regards to be advised againt a DVD by "the powers that be"- I guess you refer to marvel / DC? Of course they would advise againt it. I think it's legal (took 2 MBA law classes), but you might burn bridges and have to endure litigation (even though I think you would win, it would be paiful). Good work around to sell commentary. Also maybe you can sell the toys through your website? Maybe sell your own "unique" toys? Maybe get advertisers to pay you for product placement?

  • The problem with getting a donate button is that you need to be approved by PayPal as a non-profit organization. If you don't want the commentaries, but would still like to help the cause...why not just place an order or two (or more) and just delete the e-mails once you get them?

  • Not so. Donations aren't restricted to non-profit corporations; people are allowed to give money to anyone they please, you'll just have to claim it as income. I've been working with PayPal for many years and I can assure you that you'll be able to create a donation button without verifying so much as your identity.

  • Also...for those of you giving away free legal advice....if you're lawyers, great, you guys step up too against Marvel and start building the case. If not, then I'm pretty sure these people did their research. Lay off the advice, and drop a few coins in the jar.

  • To get away with selling DVDs of your videos you need to think outside the box, or about, rather. Make the DVDs free gifts with the purchase of the box they'll be shipped in! Perfectly legal. Better yet, say that the box will include just some random DVD for filler. OR, Just Some Random Music Instrument made out of a box and a Random DVD to make the music. It's not your fault if people destroy the your handicraft. Loop holes are all around, you just need to look for them.

    But it was all fun to listen to. I think Randomgirl's contributions really came out there where it doesn't so much just watching the videos. Great collaboration! It's worth every penny, especially if we get more videos.$3.50 is cheaper than most comic books!

  • have you guys tried packaging this and tying to sell to one the cable networks like spike tV , MTV or that video game network. i know you 'll probably have hard tim with cartoon network because the format has a strong resemblance to ROBOT CHICKEN and they don't want to confuse their inebriated audience , however there are far too many channels out there today who would love to pick up an inexpensive show such as yours
