Well, in the 50's almost every white person in the South was a member or sympathizer of the KKK. You must remember that Strom Thurmond stood for president in 1948 on the Dixiecrat party ticket based on a racist segregationist policy and won 39 electoral college votes from the deep south which was the highest for a third party presidential candidate in history! If the business is completely non-reliant upon government services, then they may discriminate. However, there is probably not one legitimate business that doesn't rely upon government funded services such as fire protection, police protection, streets and sidewalks, and utilities.

You may think the Civil Rights Act is against the Constitution, but it's actually up to the Supreme Court to decide that, and they haven't found it unconstitutional. Libertarians like Rand Paul claim the free market will solve civil rights problems (and most others) and end discrimination, but it didn't exactly do a good job of ending slavery. That required legal government intervention.

I have a friend who spend a couple of stints in the pokey for felony theft. After about 15 years of good living he petitioned the governor to expunge his record and was successful. As others have noted, the political climate was completely different than today's situation. Byrd apologized for 40+ years, that should be long enough.

Well, in the 50's almost every white person in the South was a member or sympathizer of the KKK. You must remember that Strom Thurmond stood for president in 1948 on the Dixiecrat party ticket based on a racist segregationist policy and won 39 electoral college votes from the deep south which was the highest for a third party presidential candidate in history! Thurmond then left the Democratic party and joined the GOP which shared his ideals.

As for Byrd, for a person who was in the Klan, why did Byrd even use the word nigger on Fox News? I find it is very common for certain people to never see the effects of their actions on others. It is uniquely a ***** thing, here in America. Some here know every aspect of one culture, but most ****** have zero interest in knowing or even acknowledging the humanity of the others.

I don't know if there are actually any examples of that, though. Because the Democrat/Republican situation regarding racists hiding in their party flipped during the 1964, 65, and 68 Civil Rights and Voting RIghts Acts. Prior to that, most of the segregationists and racists were in the Democratic party (Dixicrat wing), and after that they either had to reform, or switch to the Republican party. (Which 'coincidentally' started talking about 'States Rights" at the same time. )

If the business is completely non-reliant upon government services, then they may discriminate. However, there is probably not one legitimate business that doesn't rely upon government funded services such as fire protection, police protection, streets and sidewalks, and utilities.

The Constitution guarantees majority rule, but also protection of minority rights. You may think the Civil Rights Act is against the Constitution, but it's actually up to the Supreme Court to decide that, and they haven't found it unconstitutional. Libertarians like Rand Paul claim the free market will solve civil rights problems (and most others) and end discrimination, but it didn't exactly do a good job of ending slavery. That required legal government intervention.

No, but it's the only way he'll change his behavior. The Libertarian alternative is to let the free market take care of human rights issues. I don't think any bigotted business owner would serve a minority he is prejudiced against because he may lose a few dollars in business, and he definitely wouldn't if he lives in an area where that minority constitutes a very small share of the market.

@fret2424 However, those same people can ask to have their felony record expunged once they prove they can be law-abiding citizens. I have a friend who spend a couple of stints in the pokey for felony theft. After about 15 years of good living he petitioned the governor to expunge his record and was successful. As others have noted, the political climate was completely different than today's situation. Byrd apologized for 40+ years, that should be long enough.
