Interesting thought though, when he talks about how 'not serious' rapists are the ones who get short sentences whereas 'serious' rapists get longer sentences, is that actually all that true? I wouldn't imagine that many 'not serious' rapists get convicted as I would imagine there would be a lack of evidence eg medical evidence. So I think her statistic probably is representative of all rapists and a lot of very violent rapists, as these are the ones who are more likely to get convicted no?
I'm surprised how through all of this arguing no-one says 'why don't we just call 16y.o. + 15y.o. sex something other than rape?' Because yeah rape is a serious thing, and no-one wants to trivialise it. But by calling that rape this whole argument ensues over whether all rape is the same etcetc. When it's something as serious as that surely you can't put these things in the same category? Not that I'm saying that underage sex isn't also serious, because it is.
@MarkB1ngham is this something that happens to you often? At whatever point a person expresses their desire not to engage in coitus, if the disagreeable sexual act then continues it IS rape. Are you trying to say if someone leaves it to the last minute to say 'no' then it is the other person's right to continue because they are 'owed' something?

the issue that springs to mind here isn't the length of the sentence, it's the lack of rehabilitation. any sentence, no matter how long, is useless if they are only going to re-offend when they get out.
There is a ridiculous frenzy about this. Fact is that the interviewer and the general public don't understand basic statistics and basic principles of the law. It is an emotive topic but this shouldn't get in the way of common sense.
I think he was discussing the difference between 'legal rape' which can include a 16 year old boy having sex with his willing 15 year old girlfriend and the forcible violation of somebody who is not willing at all. There is a BIG difference.
@psychozo - if the 15 year old girl is your daughter, your view would be very different - RAPE is RAPE (unless you are some sort of peodophile who thinks 15 year old girls getting raped is somehow less serious)...You think some forms of rape are not serious and you are entitled to your opinion - my opinion is you should be behind bars along Clarke and all rapists - you are definately a threat to society if you consider a 15 year old getting raped is not serious!
