Cigarettes get a mental pass by most people , they dont deserve it .Weather its a cigarette or hazardous material its deadly .The offender should go to jail or fined .
If a person would hold up a block of styrofoam or plastic and intentionally light it on fire polluting with chemicals that are known to cause cancer everyone would insist on jail .
5 years or 5,000 bucks? wth? how about just asking the guy to put it out and it's not allowed? seriously?!?!?!?
there are pedofiles who get less than this in jail time. there are drug dealers who get off scott free, if they become "rats". why should someone spend 5 years or 5 thousand bucks for making a dumb mistake? SERIOUSLY?
people need to get their dang priorities STRAIGHT....
people shouldn't be discriminated against because they have a bad habit.. i'm not a smoker... and if you are in a compack closed space, yeah you should smoke out or courtasy.. but damn
So the guy`s just come out of jail? It`s not unknown of course for discharged prisoners who`re faced with homelessness, or who feel more comfortable in jail than anywhere else because that`s what they`re used to, to offend again straight away in order to go back inside. And this seems a fairly harmless way of achieving that goal. I think judges are usually pretty wised up to it..

5 years jail is ridiculous, the tax payer pays for that.
if he was asked to not smoke and he did, a small fine and an apology, not 5 thousand dollars, ridiculous
next thing you'll know is they'll arrest you for being educated or fat or talking loudly about your political points of view, etc
