  • Before jumping all over the police, did anyone think that maybe the people that the guy confronted told them something different? He uses the words "lectured". Maybe the cops just wanted to make sure that he knew the rules so he didn't get in trouble. After all, he wasn't arrested or anything, so they obviously didn't have a problem with what he did.

  • That would have never happened here were I live. I open carry all the time here in the city of Phoenix and in a situation like this the police here would have asked why even worry about a cac permit ? Ya don't need one, just open carry. I have several friends on the local pd and they are disgusted with cops all over that try to infringe on their right to carry, and especially their right to defend them selves.

  • Right, wrong, or indifferent, this incident perfectly illustrates why you should IMMEDIATELY CALL 911 after any incident in which you have to flash, draw, or fire your carry weapon in order to prevent an attack or grievous bodily harm. If you call dispatch first and inform them that you were just threatened and had to reply with a threat involving your carry weapon, you are on much better footing, legally.

  • I'm curious to know what the 911 tapes hav on them.  If the call doesnt match the action of the police, then the prob is w/ the police otherwise, the 911 operator. Secondly, if u know the owner of the bldg, then it seems appropriate to confront the group to minimize prop damage. I've done the same w/ no further escalating prob from police.

  • Ridiculous. This man was restrained in the face of a threatening group that outnumbered him significantly. I wouldn't have shot them either, but technically he had the right if he was actually in fear. The police should have said good job taking it easy on them and protecting your neighbors property. The cops are just worried that if citizens start doing that they will be out of a job.

Whether one feels that way when attacked by four teenagers, not kids, when they threaten to "kick ass" would depend on the teens and person being threatened. I believe we could find four teenagers that would put that fear in any reasonable man. Being beaten by four teenagers can, and has, result in death.

I see a group preparing to commit a violent felony, arson, one of whom is holding a deadly weapon, gas plus lighter, and doesn't run like punk kids but instead turns to attack a lone, apparently unarmed man trying to look out for his neighbor. They thought they could physically beat this man into submission and I will take their word. Unarmed is not true because their numbers alone qualify as a disparity of force if they were near full grown.

  • In Missouri, the only mistake this guy made was NOT immediately calling 911 and giving his name, stating that he had to show his weapon to diffuse threats of assault. During the CCW class I attended, they told us that the First Caller is the Victim....the Second Caller is usually the Perp..*shrugs* If you carry a gun, carry a cell!!!! They're both equally important....

  • Oh and by the way, they seized all of my property including several expensive guns inside the house. A few were quite expensive and hard to find, I have not gotten them back until this day. The police said they would charge him with trespassing/vandalism and never did. I was a victim and they didn't help me.

    The knife was a 1 inch swiss army knife... why did this happen to me and cause so much emotional damage to my family and I.

  • He lied and I was blamed for something I didn't do in protecting my neighborhood from kids that had come in from other areas and were destroying my property. One reading this must think I am not telling the whole story or I did something illegal... I never did and I truly would never hurt anyone or do anything but I feel I have the constitutional right to feel secure in my person. God bless America and screw the corrupt courts/police.

  • This is all without asking me any questions or hearing my side of the story solely based on the miscreant's testimony. Consider that I come from an affluent area but still work hard for my stuff. I have never ever ever been found guilty of even a speeding ticket in the past.

    It turns out in the court documents that the kid lied. He changed his story and said that I was holding the knife to his throat telling him I was going to kill him and they arrested me for that.

  • Before the second arraignment hearing I was drug tested and put on a sort of pre-trail release program where I had to stay in my home (house arrest). Finally, I went to court and was offered a plea deal of which after 6 months of good behavior it was completely expounged and I have no record anymore.

    Keep in mind that I never pointed a knife at the kid and he was actually larger than I am. It is an open carry state for all weapons where I live. (4/5)

  • I thought they were going to release me. They then told me I was being charged with felony menacing and take me to jail and book me. I was the only person in there with full chains and handcuffs on me, everyone else was not restrained at all in booking. They told me I was a dangerous person threatening the lives of children.

    I had $50,000 bail which I had to pay in full. The next day I appeared in court and had that reduced... (3/3)

  • They extract me from the residence and shove my head to the ground striking me. They are yelling at me telling me how "people in this country" obey the law (one of my relatives in the house was from spain). They start yelling at me asking where the knife was. I tell them and fully cooperate.

    At this point I am detained in the back of a squad car. I ask if I can tell my side of the story and the deputy says "No, we don't need your statement. it is a zero tolerance policy." (2/2)

  • This EXACT same thing happened to me. There was a kid vandalizing a statue in my front yard (a very expensive one) so I come outside with a legal knife holstered at my side. He runs off and about 30 minutes later comes back. I go across the street and confront him saying I will call police or tell his parents for what happened.

    30 minutes later the police show up at my house. They send in 10 heavily armed men and barricade the street with AR-15 armed sheriffs surrounding my house. (1/2)

  • Why is this guy so clueless? Every state has very specific gun laws there should be no confusion. Either it's an open carry state or it's not. Either they allow Concealed Carry Endorsements or they don't. The either had a right to carry or he didn't. This doesn't make sense to me. I carry a handgun every day and I'm very clear of the laws and the consequences if I use it in a manner NOT compliant with those laws. This should be simple. Am I missing something?

  • We should all reject government approved permission slips to bear arms. Open carry has benefits, that in my opinion, far exceed what concealed carry has to offer. Sure you could surprise a criminal with a hidden firearm, but that escalates the situation. I would rather not have to draw/brandish my weapon. Open carry can prevent the situation all together because criminals value self-preservation and will likely seek out an easier target because they know the would-have-been victim is armed.

  • @BayAreaOpenCarry I disagree. Open carry, while well within ur rights, is like hanging a target on ur chest. Better to make the criminals guess if ur armed or not. I carry concealed 24/7 while outside my home, and no one will know Im armed till his chest hurts and he doesnt know why.

  • In my opinion he probably shouldn't have lifted up his shirt and said "probably not the best idea". This can be taken as intimidation in some places. He should have just put his hand on the pistol ready to draw as soon as they took a step towards him. Most people will understood this motion and if they don't stop the second they see it, then draw your pistol. Walking over with a camera and snapping several shots of them in the act would have been a good idea too.

  • @oatogether damn right its intimidation to show someone your gun! and not in just some places, in all places. however you fail to realise that the firearm is unloaded...if you wait too long who knows what they will do and as a human their fight or flight instinct might kick in, and if hes already advancing on you he might just fight. its not lawful to carry a loaded firearm, you can carry an unloaded gun with bullets on your person 76-10-50 is the statute (but thats for Utah....)

  • @gotgank uhm... i think your mistaken... a gun can be unloaded with the magazine still in it... it looks the same. and no its not useless because a trained person can load it in just a few seconds and i know that ridleyreport open carries lawfully, without one hot in the chamber however you dont know about random people but then again he was concealing the gun so i dont know the particular laws about concealed but i think you can carry it loaded, but then again i dont know much about concealed

  • @obamasucksdick99 I don't know about your state, but in mine you CAN open carry a pistol that is loaded. It has to be in plain view to be considered open. However, to conceal a pistol on you in my state your have to have a CCW permit. What is the point of carrying an empty gun? If you think just because you have a gun on you it is going to scare away someone, you're wrong. What happens when that person has a gun as well... and it is loaded. You're dead!

Please respect one another, recognize that police must do what they are told by those leading them, and please respect that call too.   • Knoxville, TN. Dude with a Carry Permit & gun in his own car was charged with possession of a firearm. When the cops pulled him over, he told them he was armed and had a Carry Permit. Now he's in jail, that's bullshit!

  • The thing with the police is that who ever calls first is the winner. Those kids made up a story, told their parents, told the cops and by the time the cops showed up, he was already guilty even though he was the victim of vandalism. If he had called the police, told them what ACTUALLY happened, and filed his report first ... there probably would not have been a problem. Probably would have been a good idea to record the situation as well.

    Unfortunately I am not kidding about the FEMA Camps, which they call "Residential Centers", but any place that has a double 20' high fence topped by inward facing Razor Wire is a Prison, especially when the Federal Signs say that it is a felony to assist anyone to escape from it.   • @MrDeadly25 Yes, agreed. It makes things unclear when it comes pursing rights and liberties in the UK due to a lack of a solid constitution. I'm keen to assert my rights as much as possible, and am also investigating the concepts of lawful / legal, common law vs statutory law, but at least in the UK the legal system seems to have vastly different ideas about these concepts to the 'Free man of The Land" viewpoint.

    It still seems like there'd be mayhem if people could open carry over here tho

  • @lgarvey You seem to have some common sense, so I have to ask you. Why do you think there would be so much mayhem? Do to people's unfamiliarity with firearms? That can be fixed. People not knowing when self defense is justified a moral and just society? That can be legally explained (Common sense will go a long way though.) Are people too rude to each other and only care about themselves? When every law abiding citizen chooses to carry a gun then suddenly people will be nicer to one another.

  • @MrDeadly25 I just imagine typical brawls turning into gunfights. There's a lot of situations, particularly recently, where gangs of youths have beaten up and stabbed a person. Admittedly if people were able to carry fire arms, they'd be a solid deterrent. But if those firearms got into the hands of the thugs/criminals (as they often do anyway), there'd be an increase in violence, and situations where people might get physically assaulted might end up in shoot outs.

  • @lgarvey I do understand your point but do you think that people would just get in fights when they know that both parties involved and everyone else witnessing the incident would have firearms? Again, for the policy of carrying firearms to work "perfectly" it puts the responsibility on each and every law abiding citizen to carry a gun. Also if criminals knew that EVERY person they would be trying to victimize had a gun, I think that would be too much of a deterrent for most thugs and gangs.

    There are only two states of being for Citizens; they are either free or they are slave/subjects. The first comes with a bit of danger and insecurity, plus a whole lot of personal responsibility. The second comes with the possible sense of false security, but there is the danger of being the victim of the very governments that are supposed to protect you. In the 20th Century alone over 56 million innocent people were murdered by their own governments after being disarmed.

  • The Government is all about power and control. If the Citizens are armed and can protect themselves, there is less need of cops and courts. That is not acceptable to the Power hungry in Government. What they want is unarmed and fearful sheep who they can fleece at will without danger to them selves or their power.

  • Good call by the armed citizen. His only mistake was not calling the Police. This led to the juvies calling, and reporting a man with a gun. If the citizen called first, it would have gone much different.

  • @gotgank I can't agree more unfortunately. The general rule seems to be - whoever calls the police first is the victim as far as law enforcement is concerned.

  • @abitofxtacy Correct. His girlfriend called the police immediately(police record) showing his doing the proper thing. The "Kids" were probably minorities,and,well, you know what happens in that case!

  • @abitofxtacy I had heard that, but if so, why did the Cops respond to the kids location 1st? Vandalism in progress is a hot run, unless Police response time is dismal there, theres no reason the Cops wouldnt have been there in minutes. Keep in mind we are getting this 3rd hand.

  • @gotgank Cops will always respond first to the location of a weapon. The location of the weapon will be the main priority of an incident no matter where the first call comes from.

  • @ohannahdad U misunderstand. If the citizens girlfriend called in a criminal damaging in progress as he went out the door, the Cops should have been there in minutes. Especially if she told them the citizen was going out to confront them. It doens't make sense. Dont get me wrong, I applaud this citizen for getting involved, and pretty much how he handled it. I just question if they called 911 right away. Oh, and I am a Cop.

  • @gotgank This incident sounds strange. UR correct in mentioning that the girlfriend made the criminal damage call as he was going out the door; that should have been the first order of business. Then there was mention of slow response to such calls in this area. Then I wonder what these young "vandals" told the cops they were doing when this guy showed or pulled a gun. They also said he put a round in the gun. How else would they know the gun was empty? Strange story. Feels like there's more!!

  • @skoVBA2 Sure, but why didnt the Cops go to his house first? Thats a "hot" run. The Cops should have gone to the incident in progress location first, not the kids house, later, after THEY called. Not enuff info here, much room for doubt that we are getting the whole, complete story.

  • @gotgank It is stated at the beginning that his wife was calling the police while he was investigating the situation. But their call was only about the vandalism, not the events that unfolded during the actual encounter. The delinquents, like most other less-than-useful youth civilians, hyped up what the truth was and told their parents or called the police themselves making an erroneous report.

  • @Reynard13Fuchs From my exerience, the Police "should" have responded post haste to an "in progress" crime, vandalism or not. I have doubts as to wether he really called, or just decided to handle it himself. He can STATE anything he wants, that doesnt mean I have to believe him.
