Is it fair to lose your livelihood when companies lose nothing? Companies can downright lie and ruin your career. We have no protection. We need to abolish AT WILL and replace it with the same protection that companies have for themselves. If there is protocol to get hired there should be protocol to be fired. Just say NO to AT WILL. Where do I sign up for that?
you are wrong, buddy..in a free market, you are free to do as you please...anyway if u get Fired, you can apply for unemployment..its up to them to prove misconduct..as long as there is none, youre in
you were speaking with so much passion and i feel every word you said. jus yesterday i was fired at my job (COIT CLEANERS, BURLINGAME, CA) because a manager was very disrespectful, rude and loud with me for no good reason. i did the same to her in return and next thing you know. your fired! she wasnt fired or anything. i never knew an employer could do this. this is wrong! i have bills to pay and unemployment aint goin to cover it all. this is another reason why cali has a high unemployment rate
@DWES415 Ok, if you smarted off to the boss, I have no sympathy for you. The fact that she was rude to you, first, means nothing. Don't cross the boss.
@dstebbin so you will say its ok for your boss to talk to you any way he/she wants? she talks down to everyone and has many times. im not sayin i was right but she was in the wrong too. how come they didnt fire her also? i did great work there. i never got loud or anything with her, just let her know where i stand with her being like that towards me. i was there for 2 years and naver got written up and never disrespected anyone. you dont see an issue what that situation?
I agree man seriously this gives abusive managers tha ability to fire you for any reason even the illegal ones it does not matter all they have to say is no reason.
@auburn722 Well, there are ways to prove discrimination, even though no one admits it.
eHow has an article on "how to prove employment discrimination," if you'd care to go read it.
If you were even so much as treated differently without any clear reason, that will, at least, provoke an EEOC investigation, which is MUCH more likely to bear fruit than if you did it on your own.
thi was awesome.. i am a recent victim of a wrongful termination and have many issues that were wrong - i never received a handbook; application in the beginning and never a reason in writing. there are more things to it; i wish i could find out if a lawyr could at leas tell me based onb wat i know, if i have a case. thanks. any advice wold be welcomed
You can google "Civil Rights Attorneys in STATE" to find a lawyer who is competent in this kind of thing.
However, those two reasons you gave (no handbook and no reason in writing) are perfectly legal. You'll have to pin it to status as a protected class if you're going be able to sue him.
Have you looked into Walmart. They abuse the system more than any other employer on earth put together! They'll do anything to encourage employment turnover. Whether breaking a law or even taking advantage of a law that will give them reasons to fire anyone.
I'm well aware of Wal-Mart's human resources, living in the state where they are headquartered, myself. That is just one more notch on my belt, about the fact that at-will employment needs to go.
In your post you say that just because no one discriminates on second amendment grounds, does not mean they can't.This idea is still based on a technical wording of the document. The actual intent of the constitution is to prevent all discrimination ,public or private,If what your saying is true, why bother to say congress shall make no law if it can be so easily negated by the private sector it would be illogical for the constitution to say this in the first place, your simply playing with words.
Yes, that's exactly what the law is about: Playing with words. On numerous occassions, people have gotten off the hook on things like laws and contracts by saying "I know it's not what you meant, but it's not what you said."
To further address the absurd concept of the bill of rights only applies to government action ,not to the private sector.Conservatives champion this idea because it suggests that only the government can not restrict speech but your employer can, well apply this idea to the second amendment, the right to bear arms, that only the government can't take away this right but your employer can,and conservatives would raise holy hell! It would also mean you could be fired for joining the NRA wouldn't it?
ok I am not stating what you say is untrue. I am saying I was terminated becasue I was 7 months pregnant and I was fired without reason. and I contacted a lawyer and they stated cause I was unable to do the job! When I could.
Actually, not it's not. You see, the Bill of Rights doesn't extend to the private sector, only to government action. Trust me, if it were unconstitutional, it wouldn't be legal in the first place.
do you know where i can get more info on this. I dont see people fight this issue much. I mean if they can terminate without reason they means they can discrminate and not give you a reason
Actually, it means exactly that, and sometimes they do that. You can read about it in academic journals, which you can find at most libraries. In fact, my bibliography for the college paper that I used as my script for this video consisted entirely of academic journal articles.
thats a fair request. i've never felt good about the policy. i'm a lil' shocked about the ssn 666 business. in general i find at will in the interest of employers so i found it interesting that it is disliked on the managerial/employer side of the equation as well. how common are these lawsuits you describe where the employee sues the boss on non work related grounds?
i feel like workers should typically forego the customary 2 weeks notice b/c of so much rampant firing that happens.
I don't have an exact number, but it's common sense to think that they'll try and recover from a frivolous firing any way they can. I consider that to be common knowledge.
i am so anti-litigation in my outlook that i find it hard to imagine the extent of such suits. maybe b/c i find this type of action objectionable. the extent of this is what concerns me.
have you ever heard of binary economics which talks about sharing capital with the labor force rather than just furnishing wages? i learned about it here on youtube and it is brilliant. unfortunately not very well received presently by the established order. you should look into it. i find it fascinating.

@TheHAMMER77777 Maybe in a free market, that's true, but this isn't a 100% entirely free market.
I take it your a libertarian. However, your argument is based on the assumption that we live in a 100% entirely free market, which we don't.

@DWES415 The difference is that she has the bargaining power.
Hey, if you were in the army, and your drill sergeant talked to you that way, would you STILL talk back?
You're an adult, now. Act like one. Learn to hold your tongue.

@DWES415 I just did some research, and there might be a silver lining for you.
It's not discrimination, per se, but it IS a hostile work environment!
Read about it on Wikipedia and talk to lawyer about it tomorrow. It's pretty vague and can constitute just about any kind of hostility.

Technically, you can. Remember, your life off-shift is a legal reason to fire someone.
Just because no one DOES discriminate on second amendment grounds does not mean they CAN'T. Even conservatives agree to that.

If that doesn't work, you write a lawyer in your area, show him this video, and ask him to confirm what I say.
