The photographer is 100% correct. The law uses the term "reasonable expectation of privacy." Which means he can take all the pictures he wants of anyone in public, including people in the windows of their own homes.

To the poster of this video: (A) I don't know why you're answering the Officer's questions - not smart. Give him your name and tell him "I'm sorry Officer, I'm not interested in answering any question that I'm not legally obligated to answer." Then shut-up. If your standing behind an officer and it makes him or her feel uncomfortable, the officer definitely has the right to have you re position yourself or stand somewhere else during the officers traffic stop. The officer doesn't know who you are... You could be a wanted felon, murderer, who knows? It's an officer safety issue for you to be lingering around an officer as they conduct their investigation. Think of it from their point of view.

You might want to check your state laws a little closer, I don't have time right now or I would. But a lot of laws regarding taping phone conversations revlolve around the fact that if one party on the phone conversation knows the conversation is being taped, then it is legal. Check the laws first.
In CA there is an expectation of privacy during phone conversations, so if you don't inform the person you're recording, then you're violating CA wiretapping laws.
CA wiretapping laws are all based on an expectation of privacy and whether or not it exists.
It does not exist in public spaces or a on public sidewalk.

True the officer had no right to privacy on the street, but if the actions of the photographer interfere with the officer's duty or become disorderly, then the officer may arrest the man for disorderly conduct. @ShiekUrBooty Is that a good thing? Laws are not always right. Look at the US Constitution which has been Amended numerous times. In the past it was not illegal to keep slaves and women could not vote - was that right? Was the law to be respected without question? Even though it was not forbidden in law many people knew this was wrong out of social morality and respect for their fellow human-beings. Laws/rules are introduced to control populations not free us.
Yeah, it's a good thing that people, companies and governments don't have an expectation of a right to privacy in public because that's how crimes and attrocities are easily hidden.

The cop went about this wrong way. I would have gone with the "you being behind me and taking photographs is making me nervous and preventing me from doing my job and dealing with this other person, so please move" route.
Then if the guy was still there after that I would have said: "sir, you're delaying me from performing my duties, I can't deal with two people at once, if you don't leave now I'm going to arrest you for delaying/obstructing a peace officer"

The photographer is 100% correct. The law uses the term "reasonable expectation of privacy." Which means he can take all the pictures he wants of anyone in public, including people in the windows of their own homes.

To the poster of this video: (A) I don't know why you're answering the Officer's questions - not smart. Give him your name and tell him "I'm sorry Officer, I'm not interested in answering any question that I'm not legally obligated to answer." Then shut-up. Here's he low down... If your standing behind an officer and it makes him or her feel uncomfortable, the officer definitely has the right to have you re position yourself or stand somewhere else during the officers traffic stop. The officer doesn't know who you are... You could be a wanted felon, murderer, who knows? It's an officer safety issue for you to be lingering around an officer as they conduct their investigation. Think of it from their point of view.

A public sidewalk that's not taped off means you can stand anywhere you want and that is exactly what the other people, WHO DIDN'T HAVE A CAMERAS, were doing. However, they weren't unlawfully told to keep moving.
The camera was the issue.

I suggest you re check the footage the officer walked over and pointed to his badge showing you his number. You were so obviously looking to start an argument with a. Cop. There is expectation of privacy over the telephone, so recording without their knowledge may cause you legal problems in CA. However, a call to the police station is already being recorded.

You might want to check your state laws a little closer, I don't have time right now or I would. But a lot of laws regarding taping phone conversations revlolve around the fact that if one party on the phone conversation knows the conversation is being taped, then it is legal. Check the laws first.

In CA there is an expectation of privacy during phone conversations, so if you don't inform the person you're recording, then you're violating CA wiretapping laws.
CA wiretapping laws are all based on an expectation of privacy and whether or not it exists.
It does not exist in public spaces or a on public sidewalk.

It will come down to this. Does the officer have a right to REQUEST no pictures. If so the request could be denied. The officer knew he had no right to command no pictures, bid diffence between a request and command, the anti 1st Amendment blogers don't know the camera man had a right to refues the request. True the officer had no right to privacy on the street, but if the actions of the photographer interfere with the officer's duty or become disorderly, then the officer may arrest the man for disorderly conduct. One thing a person should know about disorderly conduct is that it literally is; any activity that may upset a police officer.

There are no laws covering these social etiquettes, however most polite people follow them. The people officer in the video followed the law allowing the photographer to take pictures without arrest. However the photographer did not respect the officers request to stop. That is rude

If they can't handle such a minuscule imposition as having their picture taken by their master, they're in the wrong line of work. Spitting is a potential health hazard, refusing to relinquish your seat to an elderly or infirm person is a disregard to another's well-being. Making racist comments is an act which degrades others.

@dazzagazza6969 And, the Officer in the video DID NOT act at all in the spirit of the law. He detained and questioned the photographer without reasonable suspicion. Yes, technically, the detainment was not unlawful as the photog didn't protest the detainment. But, that matters little - the Officer intimidated the photog into the detainment and into submitting to questioning, when, had he known he had a choice in the matter, obviously would have submitted to neither.

In the past it was not illegal to keep slaves and women could not vote - was that right? Was the law to be respected without question? Even though it was not forbidden in law many people knew this was wrong out of social morality and respect for their fellow human-beings. Laws/rules are introduced to control populations not free us.

Yeah, it's a good thing that people, companies and governments don't have an expectation of a right to privacy in public because that's how crimes and attrocities are easily hidden.
Police have less of an expectation of privacy in public because it is the people authorize the existance of police and their powers. Therefore since police are the servants of the people who created them, their activities must be transparent to us, so that police de-creation with Amendment II powers is not invoked
