Theres no moisture on mars dude so theres nothing to freeze and make the surface hard. try taking really really dry sand and putting it in your freezer take it out in a couple days and pick it up it will actually be more fine than normal since the particles wont stick together. so long as no moisture got to it.
NASA has never confirmed that there is water on Mars at any other location than possibly at the poles, and there has been no evidence to that other than light spectral analysis, which is by no means conclusive. It could be ice of a Nitrogen nature, or even acidic. Erosion that looks like it may have been made by a liquid of some type, is possible, but no evidence has been shown that it was water, when in the past that time frame was, whether it be last week, last month, or 1 million years ago.
There is no reason to believe that you would find permafrost at any location on Mars just because it is cold enough for it to thrive. We might find permafrost at the poles. Cold temperatures and moisture are completely 2 different things.
There has to be a large percentage of moisture in the soil, meaning water of a hydrogen and oxygen composition. If the hydrogen and oxygen has any other gases in the mix, or the hydrogen and oxygen are not in a 2 to 1 part mixture in the soil, then any moisture will never become frozen as water, no matter how cold it gets, but the hydrogen, or oxygen would freeze as very small crystals, in small amounts, and probably a lot deeper in the soil.
Since when should dry Rock freeze?? Have you ever been in the desert? By night? When temperatures drops below freezing point? Does dry sand become solid at such temperatures???
@salmynka actually there is water on mars.... in the last b&w picture shows erosion on mars. which just so happens to mean that there is water. and even nasa confirms there is water on mars.

the ground doesn't have to be solid just because it's very cold there, if there's lack of water, there's lack of a 'cold binder'. the abundance of water is what makes the ground go solid if it's cold, if there's no water, there's nothing to hold the dust together! it needs a fluid binder for it to work! idiots!

People keep on about like On mars but what about Life inside mars What if whatever once lived out side now lives underground we humans could do that if we had better tech who isnt to say that there planet could of had somthing like globle warming or somthing and they went underground because they where into the future than we are ?
it does look as though mars could have sustained life at one point in time. but they search for clues that would sustain life on earth, is it not possible that life started there but in a completely different way? they may not have even needed water, heat, oxygen etc. what are the odds that 2 planets so close together in this vast universe would go through the same evolutionary steps?
i worked and jsc in houston... they have said that there was once water on mars... veryyyyy long time ago... the "rivers" that u see in the photos are longggg gone... tho they have found ice on mars but very very little

the reason the ground isnt frozen is because their is no water to freeze and therefore keep sand together.

There is NO WATER on Mars therefore the 'soil' (rock dust actually as soil implies vegetation) cannot freeze.
