I have to say this could very easily have been used maliciously: you called in to the creditors, gave the a phone number, and in return they gave you an address (which all you had to do was say "yes" to) and a name (again, just say "yeah, that's me"). Hopefully she got to watch this, if she wasn't lying then she was clearly confused as to what happened, as all it took was a phone number and out came personal info.

The truth of the matter is, debt collection agencies are NOT allowed to provide the information to the caller, he has to give the information to the collector in order to properly identify himself, including his SSN number. If that information is not given to the collector by the caller, he did not properly identify himself and any info such as balances and credit report information is in violation of the FDCPA. well the collector did not break fdcpa it would have been a bona-fide error there was no law broken; also the person said that she disclosed info to an "unauthorized 3rd party" by his own omission he was unauthorized therefore it was id theft and a 3rd party if viewed as fraud can pursue legal action even if its not their id being used

I worked at customer service once, and was taught to be aware of that: Unless we got a *specific affirmative* answer, never assume we were speaking to the account holder. Unknowingly, she did release his info to an unauthorized 3rd party.

these are the kinds of people who cannot pay their debts and just do something that they think would give them make them earn money easily.. in the first place the lady did not do anything illegal, once a customer gives the reference phone no. to the collector she can pull up the records, and in the recording the guy said yes when asked if he was the person, the identity was verified by the magic word "yes".

i would try to obtain info by distracting the rep from verifying anything other than the name, if no address, date of birth, or ssn is verified and info is released... you can sue the company and the individual for up to 10k each in a federal courtroom. just make sure the actual party the matter is involiving is making the call
taking this to court would result in the caller being tried for false impersonation, misleading a licensed financial institution, and in some courts, fraud. fdcpa law allows you to verify by reading address to consumer and them saying yes or no to determine id, sad but true... i teach the laws!

However, if credit purchases of property with no supporting documents stating paid in full, certain collectors are allowed to pursue post-BK to allocate secured items which have a purchase-money security interest. A major important tip if purchased within certain time then BK is filed, Bk judge will agree automatic fraud.

I know contingency is too big of a word for you to understand so I'll explain. That means they don't charge you until you win your case. I know because I won $1,800 from collection agencies that left illegal voicemails for me. Research before you post... if you don't it makes you look REALLY stupid.

How much experience do you have or is this personal vendetta for all who may abuse this industry. This can be interpreted as a scheme devised to evade a legally signed agreement by transfering accountability to someone else or entity. Always make sure with an attorney to know pros & cons before any action or reference is made on the net to avoid any illegality issues.

The truth of the matter is, debt collection agencies are NOT allowed to provide the information to the caller, he has to give the information to the collector in order to properly identify himself, including his SSN number. If that information is not given to the collector by the caller, he did not properly identify himself and any info such as balances and credit report information is in violation of the FDCPA. This collector got PWNED!

With laws consistently changing based on the amount of debtors forthcoming to their obligations, its no wonder why they've added extra measures on terms. Did you read the terms before signing the app, its a legally binding contract. Everything now is based on credit, what if you're in dire need of cash again?

well the collector did not break fdcpa it would have been a bona-fide error there was no law broken; also the person said that she disclosed info to an "unauthorized 3rd party" by his own omission he was unauthorized therefore it was id theft and a 3rd party if viewed as fraud can pursue legal action even if its not their id being used

I would just like to say, that I work for a collections company, and I agree with the makers of this video, that the woman on the phone did release private info. The woman did not verify any info, as soon as the man said that he was (falsely) the debtor, the woman gave all the actual debtors information. If she needed to verify by address, she should have asked the man tell HER the address. Anyone can say "Yes, thats my address!"

This is not what happened here at all. The point of this video was a social engineering experiment proving collection agencies do not engage in good security practices.

Yes there are collection agencies who need to train their staff better to avoid privacy breaches, like that poorly trained woman, but this video is just too extreme and pointless exploitation. Another stupid collection agency was harassing me, so I hired a lawyer and sent them copies of their illegal voicemails plus details of their illegal threats, and they are working on getting a nice settlement for me. I worked at customer service once, and was taught to be aware of that: Unless we got a *specific affirmative* answer, never assume we were speaking to the account holder. Unknowingly, she did release his info to an unauthorized 3rd party.

The rep was simply doing her job... Nothing wrong and certainly nothing illegal... the debt collector always has the upper hand because it is not they who owe the debt.... If one borrows money it is only logical that they pay it back... One should pay their bills and/or work out a solution with the original creditor before the account goes to 3rd party for it is they who tend to be very aggressive in their collection tactics and do not offer reasonable solutions....

i would try to obtain info by distracting the rep from verifying anything other than the name, if no address, date of birth, or ssn is verified and info is released... you can sue the company and the individual for up to 10k each in a federal courtroom. just make sure the actual party the matter is involiving is making the call

taking this to court would result in the caller being tried for false impersonation, misleading a licensed financial institution, and in some courts, fraud. fdcpa law allows you to verify by reading address to consumer and them saying yes or no to determine id, sad but true... i teach the laws!

@nfwvideo - Well, at least you're half right. I do BK collections going on 6 years now on creditor's rights. When BK filed, the financial agreement will be included in BK. However, if credit purchases of property with no supporting documents stating paid in full, certain collectors are allowed to pursue post-BK to allocate secured items which have a purchase-money security interest. A major important tip if purchased within certain time then BK is filed, Bk judge will agree automatic fraud.
