Youtube are very inconsistent when it comes to policing copyrights. Search for Blackstar and you can find a video showing the full opening that has been up since Jan 2007. Why didn't they take it down?
I have watched the entire series of Lucky Star on Youtube. A year later and the videos are still up. Why don't they take action on that account?

It's a damn shame this happened like this. I thought the video clips really helped get the feel of whole review of each dvd. And yes that Mike Mozart guy seems to be quite the knowledgeable one. Anyways keep up the great vids and have a good one.
Seriously, go to Mike Mozart's JeepersMedia channel and see his 'Do You Feel Lucky' video. It's one of those videos that youtube doesn't want you to see.
I KNOW it sounds like I'm advertising, but this guy really knows his stuff, and he can get the ball rolling on things that nobody else here can. That's why youtube won't touch his review videos.

It's ridiculous, but you should still keep from using that content in your videos anyway, because before you know it you'll try to log in and find that your account has been disabled if you keep using that stuff. It happens all the time on here, and sometimes they don't warn you first and it'll count against you.
Good job knowing your rights, but you're not quite right. Well, everything you said is right except under that law you may only show a maximum of :30 of the clip in question, not the full thing.

True. I work in Canadian television and that's the general rule for us, I'm sure it's different for the internet though. I've had videos removed because I used copy written music, but if I'm not making any money off of my videos I don't see what the big deal is. It's essentially free promotion for the company/band!

Nope. Doesn't matter HOW you incorporate a video, the footage itself is still copyrighted. Whether you do a direct rip, film the screen, or whatever, it's still the same clip and still the same copyright.

You are well within your rights to show clips of a film in a review state and are in no violation to anything here on you tube. Someone made a huge mistake and they need to review their own policies again. Keep up the good work and don't be discouraged by the nonsense.

What's really funny is, Filmation (the company that made Blackstar) has been out of business for 20 years. And now BCI Eclipse (the company that released the DVDs) is being shut down. Soooooo....who's gonna sue 'em, exactly, in this case? ;) It just cracks me up that the ONE I get busted for is the one with the lowest profile, and that the fewest people have even heard of. Actually the British company; Entertainment Rights, brought out the Filmation back catalog from Hallmark, so technically they now own the international copyrights and they 'could' sue YouTube/Google, hence why they don't tend to read anything about 'fair use'. To them it either has to be home made or nothing at all! 'The morons'!
I know the name sounds extreame. But if you go onto their corporate website. It's actually quite colourfull as they specialise in children's programme distribution (hence the buy out) We could have had more He-Man releases here in the UK, but due to the fact another distributor had the rights, I think there is a silent argument between the current and ER's main distributor for the UK (Universal) in regards to He-Man. As for the other shows it's a total mystery?
However as soon as I have the money I'm going to buy those She-Ra and Bravestar box sets, and perhaps the American He-Man season 1 sets on the count of different special features. But we'll see, but I'm hoping to get them before these titles become a rariety!

There's also some mumbo-jumbo about this in the YouTube Partner agreement as well. Knowing how stupid big companies can be is one of the reasons why I have no interest in doing anything commercial with any of my videos, revenue-sharing included.
watch?v=qNsYsCrEljQ is a great example of Fair Use done right. That's VenetianPrincess' video with Trans-Siberian Orchestra music. Despite having the song in her video, she's had it up for years with the ad stuff switched off and it hasn't been taken down despite having a full song in it. =)

That's one of the reasons I talk about lesser known stuff a lot, to make people aware that they're available and let them know they're out there! That sucks, man. Did you appeal? I had a vid pulled for T.O.S., challenged it, and got it reinstated. Worked in 1 out of 2 cases, for me.

A simple solution would be to not use revenue sharing on videos with other people's content in them.
