I've never met a bigot who admitted to being a bigot. Here's a good test for yourself. If you're accused of being a bigot, and you get all offended and deny it, you probably are. If you blow it off, because you KNOW it's not true and stick to your argument, you're probably not. Ben Stein's an ignorant dick. Ron Paul, as usual, is right.
Didint Ben Stein used to host some kind of money game show...why the fuck is he even on CNN talking with Ron Paul...I want to see Obama talking with Ron Paul oh wait Obama is never even here...hes always on vacation...
Wow, apparantly ben stein is in fox news pocket. See how he uses the tactic of trying to anger his criticizer? Prepare your homes people, we are going to be welcoming a huge influx of intellectually deprived refugees once people turn off the Faux News tabloid sensationalist BullSh1t.
Stein's a joke. The only true contribution he's made in the world is to say "Bueller, Bueller, Bueller..." over and over in a movie. Now, we should give him a lot of credit, because it was a very, very difficult acting job. Think about it: He had to repeat the same word over and over again! But he pulled it off beautifully, and I'm shocked that he wasn't even nominated for an Academy Award.
@dijhili I think Ron Paul is spot on. If Islamic militant groups were occupying American soil, and killing OUR people, I'm positive you wouldn't think twice about committing terrorist acts against them.
@rigbchas we were not occupiers of Iraq of Afghanistan prior to 911. It is irrelavent, radical Islam attacks anyone that is not of the faith. Did Spain occupy? Did France occupy? Did Britain occupy? No. Radical Islam is following the will of the Koran. Either convert or kill all non believers.
@dijhili Al Queda is a cult. Just like Jim Jones claiming he was a Christian. Should we go after Christians because of radicals like the bigoted Christian Identity Movement preaching their hatred?
@dijhili I have a copy. I also have a Bible where Jesus is quoted as saying "I bring the sword". Is that where the Christian Identity Movement gets their dogma?
Ben Stein is a tick sucking excuse for a human being promoting the banking cartels and corporations agenda of theft. He makes about as much sense as a someone making a case that farts can be painted green. He also has the intellectual wit of a sick slug.
They've been attacked for millenia. They are completely surrounded by people who make no secret about wanting them wiped from the map! Pardon them for being a bit paranoid!

@mots35 I agree Jews are hated by some folks all over the world and Israel is surrounded by countries that would like to see them exterminated. But my dislike for Ben is mostly for his stupid economic opinions from the past. Watched him calling Peter Schiff stupid in 2007 because Peter was accurately forecasting the housing crisis and all the economic banking failure of 2008. Being Jewish has nothing to do with my thinking Ben is a Jerk. He backs Obamas agenda and I do not.
Ben Stien's an idiot. Ron clearly and patiently explained a very simple concept to him,and Ben whined like a 5 year old who can't understand why the kid down the street wants to be left alone (or has any human rights to be left alone) Ben Stien's attitude is exactly the kind of mentality that gets us involved over on someone else's block as if we have any right to be there in the first place.

You fu..ed up and your going to HELL, becouse some of us KNOW that the Zionist criminal Group were behind most fasle falg opertions, such as killing all those people on 911.
When you have someone such as Ron(with many followers) telling us on national TV that BEN HIDDEN and his 19 thieves (with their pocket knifes) did the Job on 911, I say that's deflection from the real criminals (the Zionist Jewish group), And that is what I call a "Shell".
@crankycactus I listen to him when I go to sleep... His ridiculously monotone voice puts me to sleep....but that would probably explain the violent dreams too.
Name one other candidate that can school Ben Bernake like he can and does. Hes extremely knowledgable on Hisory, Economics, and has far more than 2 or 3 . I suggest you watch the debates again, and please name a more competent/educated/qualified candidate.
CIA, has been calling repercussions from negative US policy - 'Blowback' since the 1950's., overthrowing Iraqi and Iranian govt.s
bin Laden's list of motivations was : Lebanon 1980's, continuing Palestinian conflict [finance and military support of Israel], Air Force bases in Saudi Arabia - 1991 G.H.W. Bushs [1st Gulf War].
vs
the G.W. Bush 'bumper sticker' - illogic of them 'envying our freedom' - preposterously stupid' - the pseudo-religiously despise our freedom/culture/morality !
Nothing, he stated part of the problem in the Middle East is our occupation [Iraq, Afghanistan] that offends 'some' of their people - in response to terrorism in general and the Christmas/crotch bomber, in this discussion. He was bringing up a rational way to analyze it, motivation - should not be ignored.
Ben Stein, seemed, to take it as a personal attack of Israeli's occupation of Palestinian land; and accused him of being anti-Semitic.
Why is he a Douchebag ... Ron Paul is the man! He is the only Politician that Vote how he feels. Unlike the rest of the Jackasses in Washington who are paid for !!!
BTW, Who do you like ? I bet you I can pull more dirt on the person you like then you can on Paul . Go look up his voting record then come back and talk to me ... Paul is a douchebag ...... Yeah ok
Folks, if you are called "anti-Semitic" because you are winning an argument about AMERICAN foreign policy, LEARN from Ron Paul. NEVER deny the charge; doing so will only encourage your attacker. HIT your attacker back, HARD. Raise your voice and say "That's a vicious attack and I won't stand for it." BE ANGRY.
@Skeptic121 if you live in a closed /semi closed primary state , you MUST register as a Republican in order to vote Ron Paul in the crucial primary election . I suspect RP has a lot of Dem supporters who may be disappointed when they go to the polls if they do not change party affiliations . The closed /SEMI CLOSED states are : AZ, CO, CT,DEL,FL,MA,MD,HI,PA,NY,NE,SD,UT,WV,KY,LA,OK,OR.
Typical Fox snooze, a portion of truth - but distorted.
That video claims al Qaeda originated on the Arabian Peninsula. al Qaeda - "the base" - began in Pakistan
during the Russian invasion/occupation of Afghanistan.
The Saudi Peninsula issue that pissed of terrorists; was G.H.W. Bush's putting Air Force Bases there during the Kuwait [1st gulf War], and leaving them there after it.
Those politicians, lawyers & hacks who ignore the 9th and 10th Amendments and insist that the Commerce Clause and the term Necessary and Proper give Gov't UNLIMITED POWER are Statist Tyrants who are committing HIGH TREASON!!
They MUST be removed from power by using TRUTH to EXPOSE their lies. This is why the 1st and 2nd Amendments exist!
NEVER give up you Constitutional Protected Natural Freedoms and NEVER SURRENDER!
What constitutional rights have been taken from you? The rights you have by virtue of the Constitution result from a social agreement we have made among ourselves. Your natural rights are those that exist outside those created by human-made constitutions and laws. Congressional use of the Commerce Clause is constitutional, and our government doesn't consist of Statist Tyrants.
If you read ANY of the founders writings on the subject, you will discover that the first 10 Amendments know as the Bill of Rights exist to SECURE our NATURAL rights FROM Statism.
Now read the un-Patriot Act and understand that anything NOT listed as a Federal Enumerated Power (10th) is NOT something that they can do... period!
It's up to the States or to the People... PERIOD! Congress can NOT force us to buy a PRODUCT which is Health Insurance. Can the State Gov'ts...
As to rather of not the federal government can force you to purchase medical insurance, there is no provision in the Constitution stating as much (unless you hold the preamble as Constitutional), however, there is nothing denying Congress the right to provide less expensive and better insurance than do private industries, as they do with Medicare and VA. (continued)
However, states can require you to carry insurance. Congress can also require companies whose products or industry cross state lines to carry insurance. The first 9 Amendments confer certain negative freedoms to protect us from federal (but not state) governments. Positive freedoms were not part of the Constitution until the 13th Amendment. None of these were considered natural rights. (continued)
On one item, I agree with you. I think the Patriot act should have never been passed. I opposed it from the beginning. Certain parts of it, if ever ruled upon by a court, should be held unconstitutional.
Congress can regulate the commerce cross state lines, but the production & employment happens WITHIN state lines and Congress has NO authority within the several States.
Original intent: Regulate means to KEEP REGULAR.
The Federal Gov't can force companies to buy LIABILITY insurance to protect customers when the products are sold accross State lines and the STATES may force companies to buy insurance for their employees which are employed WITHIN the STATE!
Actually, the extent of the commerce cause is very broad and allows congress great latitude within the states. Congress can intervene in state by virtue of some amendments beginning with the 13th. Also, some treaties, once signed by the president and approved by the Senate can give the federal government the ability to act in certain state matters. The federal government can make certain funds available only it the state uses them in an approved manner. (continued)
Furthermore, federal courts have exclusive jurisdiction in certain areas such as bankruptcy, and the Supreme Court can overrule any state court, even if all reverent events occurred within the state, if a constitutional question is raised. (continued)
Also, the federal government owns a lot of land and employees a good number of employees in each state. If you shoot your mailman while he is on duty, threaten a federal judge assigned to your state, or steal the postcard from your neighbors box, you have violated federal (and state) law. Mail fraud too is a federal crime. As for crimes on federal land such as national parks, post offices, and federal buildings, the federal government can take action.
Postal Service is a VERY SPECIFIC enumerated Federal power whereas REGULATE and COMMERCE are vague terms and thus specifically REGULATED in scope by the 9th and 10th Amendments.
In order to expand the power to Regulate Commerce beyond the SPECIFIC ENUMERATED POWERS, the Constitution requires Amendment NOT interpretation because interpretation itself is vague and thus leads to Tyranny.
The Framers were vague in many things while drafting the Constitution for a reason. They were drafting a Constitution, not drafting laws. The Constitution was drafted in 1787. The 9th and 10th Amendments were drafted in 1791. They did not limit the commerce clause or any of the other methods by which the federal government could intervene in the affairs of a single state. The 13th Amendment was different because it, in section 2, allowed congress to enforce freedom in each state (Continued)
With the 13th Amendment, Americans gained their first positive freedom. Now look to the 14th Amendment. Until the early 20th century, the first 8 amendments were not binding on the states. Over the past century, most (but not all) of the first 8 amendments were made binding on the states by way of the 14th Amendment. In this manner, the federal government can constitutional intervene in state affairs in certain situations.
ALL of the Amendments are designed specifically to CORRECT VAGUENESS and as time passes so does word useage and that is why Original Intent is so important.
The Federal is a creature and creation of the several States and that is why the Bill of Rights were enacted to protect the creators from their monster which exists to protect them from other nations and from each other.
Amendments are created to change the change the Constitution, Leading Justices such as Scila disdain original intent and instead look to the plain language of the law,
The common use of language (words) changes over time. Therefore, using plain language to interpret law instead of original language to APPLY the law as originally intended is in fact making law from the bench.
When the judiciary interprets law it is IN FACT making law and is therefore guilty of TREASON and TYRANNY!
The 1st & 2nd Amendments exist so that We, the People can NULLIFY the resulting Tyranny and maintain a Free State!
Living Constitution through Amendment NOT interpretation!
I largely agree with you that conservative judges are often wrong to ignore original intent, but the judiciary is merely following our common law system, adopted by the founding fathers.
"conservative judges... ignore original intent... judiciary is merely following our common law system, adopted by the founding fathers."
Now I KNOW that you have NO idea what you are talking about. You dont know the difference between conservative & liberal. You dont understand activism nor do you understand the Common Law System or anything about the founding fathers or American History. I know now that I am wasting my time throwing purls of wisdom as ignorant swine.
Oh, I know some little of the Framers. I received my undergraduate degree in history, In law school, one of my constitutional law teachers was a famous constitutional scholar. Don't be too quick to dismiss my statements without looking them up yourself.
I spent 2 years in the bowels of UVA Law Library researching truth vs. the revisionist CRAP being spewed out in Statist Schools and Regressive Socialist Universities.
Propaganda designed to fill the empty heads of children and give Statists MORE power than they are supposed to have.
Books and letters disappeared mid-research for librarian safe-keeping.
FACT: After & resulting from the Civil War, history was twisted into the Top-Down mold of Hamilton & Lincoln.
Should I ever come across a copy of Hamiton's Curse, I assure you I will read it. And yes, the Constitution was alter after the Civil War, but mostly for the better. The 14th Amendment for example, was an important addition. True, in the late 19th and early 20th century, it was misapplied to benefit big companies (and still is at times), it was later applied to citizens of the states and brought them real freedoms. (continued)
Hamilton was instrumental in drafting the Constitution, and Lincoln was the greatest president ever. Both were farsighted and responsible for much of the freedom we enjoy today.
You may want to research NULLIFICATION and ask yourself (and others) why 33 State legislatures have voted to reclaim State Sovereignty under the 10th Amendment and why that movement is accelerating.
HINT: It has to do with the fact the progressivism is NOT progress and liberalism is favors Big Government, LESS liberty, Fewer Individual Rights and Higher Taxation on EVERYONE!!
Can you tell me how any "liberal" or NeoCon isn't just a Regressive Fascist-Collectivist-Marxist asshole?
Nullification is unconstitutional. Nullification failed in its nascent form during the Framers' generation, it was defeated by Jackson, and Lincoln drove a stake through its heart. Any state law that attempts to vacate a constitutional federal law is null and void. It cannot be enforced without federal assent.
Are you saying that all my law school professors, some of whom are nationally renown, were lying to me? Or are you saying that you know more of the laws and Constitution than they do?
I am very liberal, and I tell you that liberals and neo-conservatives are completely different creatures. As for me, I'm not sure which category you would place me, but I believe the Constitution to be the premier source of law in the US.
As for my law school teachers, some were liberal, some were conservative. They were not engaged in some conspiracy to brainwash students.Hell, they sometimes disagreed with each other on legal theory.
Both Liberals and NeoCons are Statists, they only disagree on where to spend other people's debt and who to drop bombs on.
Do a search on YouTube for:
The American Form of Gov't.
I think you will find the left vs. right paradigm eye opening. Statists us it to keep us fighting ourselves while they sneak in and rob "We, the People" blind by stealing or liberty to gain wealth and power for themselves.
NeoCon vs. Liberal is a false-flag operation against our liberty!
I'm not sure what you are saying, If you think big business can harm government, I agree. That's why I want the government to regulate it. If you think government is of necessity harmful, I disagree, Government has help to win two world wars, eliminate smallpox and polio, sent humans to the moon, funded countless studies enabling us to learn more of ourselves and our universe, saved millions of lives by building sewer systems, enabled public education, provided safe drinking water, and on and on
When Judicial Activism allows the gov't to ignore the 9th and 10th Amendments, Corporatism replaces Free Market Capitalism because corporations & special interest groups support politicians who redistribute taxpayer $ to them. Military Industrial Complex, Banks, Auto Companies, and so on.
I am NOT against gov't, but like our founders I believe that competition among the States for taxpayers forces state and local gov'ts to do a better job of offering services than any federal monopoly could.
I agree that democratic capitalism is good and necessary with respect to things such as food, shoes, clothing, and similar items, but not in all things. I all agree that corporations have too much influence in congress, Their contributions and lobbying must be curbed. Nor do not believe the 9th and 10th Amendments are abused. Federal monies given to states allow the states great discretion on how the monies may be spent for the most part. But this often results in local corruption.
When you say "Federal monies given to states..." You REALLY mean Local taxpayer (extortion) RETURNED with strings attached.
Corruption will always be in politics, but corruption at the local or State level is MUCH less harmful than corrpution at the Federal level because people can vote with their feet.
Vote with their feet means to MOVE to another location (state or city) without having to leave the country this works because of tax base migration.
The poorer states, generally the Republican states, usually receive more money from the Federal government than they put in where as the richer states receive less. Yes, there is often strings attached. I grew up in the Deep South where public money was often and publicly abused. When I was a public school teacher, I saw educational mandates made by people who knew nothing about teaching methods, subject matter, or the needs of the students. (continued)
Sometimes, local control, while seeming good, is bad. (I am not saying that federal government is always better.) Ideally and in the vast majority of cases, spending decisions are made at the state and local level. Unfortunately, people vote for state and local officials, such as DAs and school boards without looking at their records. (continued)
A law professor once told me, "No DA has never won an election by saying a defendant was innocent; DA are elected by the number of people they send to prison, specifically death row. Consider the number of prisoners freed in recent years by DNA or other exculpatory evidence. (continued)
Now, the Supreme Court is about to hear a case from two men who possess evidence that DAs sent them to prison for over 20 years while knowing someone else did the crime. The new DA was new and wanted to make a name for himself, so he and his office helped the local police in framing two young African-Americans strangers, although all the evidence pointed to someone else. (continued)
There currently exists state laws protecting DAs who knowingly convict the innocent. The state's defense is "There is no constitutional right not to framed." The plaintiffs' argue that the DAs went beyond the law when they aided the police in knowingly framing innocent men before the trial stage. They would still be in prison were in not for the new evidence.
Did you know that Illinois death row was largely emptied by DNA tests and by evidence discovered by university journalism students?
The Commerce Clause WAS very broad UNTIL the 9th and 10th Amendments limited them.
That's why the 13th Amendment was NOT simply an executive order. They WERE honoring their Oath by Honoring and Defending the Constitution. This is NO longer the case.
The Senate can not give ANY power to the Gov't NOT specifically enumerated WITHOUT Constitutional Amendments.
Any return of taxpayer money to any State with strings (bribery) is unlawful and unconstitutional.
Yep, Regressive statists HATE the 10th Amendment so they simply ignore it. READ IT AGAIN!
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
Where does it say specifically that the gov't can force people to buy any product?

To answer mr paul, they are terrorists because they subscribe to a religion whose leaders were militant and preached waging war on all non-muslims. In addition, their holy texts ie the Koran and hadiths reinforce this violent and an imperial world view.
Mr. Stein's frustration is obvious. Its high time we recongnize the apologist rationalization for genocide and anti-semitism and CALL THEM OUT!
This sounds like a box of cats tossed into a bonfire. And Larry thinks it's hilarious and fascinating. More sensible and civilized debate can be found in the back of an elementary school bus. Paul won't play the game at all. Stein does nothing but play games. And Sheila in the middle seizes the opportunity to be the grown up in the room. It's like Jon Stewart meets Monty Python.
LOL! the jew race card... it's guys like him that make goys like me anti-semitic... he wants everyone to be anti-semitic...? fine, give him what he wants... he thinks, like a moron, that he can win every argument by calling us anti-semitic...! LOL! fine, then we are... fuck you... you're nothing but a big stupid jew... when is the half price sale for palestinian organs? can i get a rabbi...? LOL! jews used to laugh at other races... now jews are the joke...

The real racism in this country isnt white on black ITS BLACK ON WHITE and almost as important is liberals like you who hate the Jews for no reason. Ben Stein is absolutly correct and Ron Paul is a moron.
...and you're just sucking around to keep in good with the organ dealers - just in case, LOL! he's still a big stupid jew... listen to him play the race card... and you... you know nothing about cards... americans play checkers - jews play chess... just like a car dealer, they'll talk you into sending your kids to die for israel - looks good on you... and i don't hate jews... i don't know any... and i don't care... all i said was "he was a big stupid jew"... Ron Paul is way beyond you, anyway...
This comment has received too many negative votesshow
First off Ron Paul is a moron who hates the Jews. He is an anti semite just like you. The real racism in this country as I said before is black on white and big media/liberalism against the Jews IE ANTI SEMITISM!!!!
but wait a minute... why do you think that it matters if one is an anti-semite or not... where does that matter... you can call me an anti-semite all day and i wouldn't flip my latke over it... after the organ rabbis paraded through the media in chains, do you really think that anyone cares if you call them an anti-semite... holy fuck... being called a pro-semite might upset people... that would mean the same as "organ robber"... of course i'm an anti-semite... report me to your JDL...
anti-semite is merely another word for intelligent goyim... ("watch out! he's aware of us! he's an anti-semite! he's an anti-semite! look - there's an anti-semite! last year, they'd have you upside down with a fucking fork up your ass! you can talk, ... but now since the organ rabbis, we lost our big moral club! even the holocaust cover won't help us now!") BTW, what does goyim mean? and what is a shiksa...?
hey... big one! what does goyim mean? why does the word GOYIM exist? and? what is a shiksa...? does SHIKSA have a special meaning...? i notice that jews always refer to us as goyim... and to white females as shiksas... what is the etymology of these words...?
Americans are not occupiers at all. We have given the blood of our sons and daughter in ASIA, Europe, and the middle east. We destroyed Japan THEN REBUILT IT AND LEFT. Go spew your liberal BS elsewhere!!!!
we should be here with natural gas and solar and our own interests...china will run eight by while we bog down in socialism and reliance on special interests dictating our future

If it were about oil gas wouldn't have hit almost 5 dollers a few years back and gas wouldn't be almost 3 dollers today. Furthermore Israel is our only true ally and friend and we must support them. Finally alturnative resources are bs and will take years a cost way more than just drilling for Oil here. Have I made my point?
Who runs the government of Japan? Could you please tell me? Last time I checked my friend the only reason we had bases there is two fold...because the government wants us there and two we said in that agreement long ago that we would protect japan against China if it came to that. Learn your history you liberal moron.
@thebig1 You admit that WE HAVEN'T LEFT JAPAN and assume that I'm a "liberal" which just proves that you're a clown. You can't back up your argument without contradicting yourself and resorting to pejoratives, typical "conservative" douche baggery. You still think that taking Iraq's oil is about lower gas prices and that deficit spending on war is good for the economy, obviously you don't understand how things work and have no sense of history beyond the last four weeks.
First of all clown you are a liberal. Second of all we haven't taken a drop of Iraq's oil NOT ONE DROP. Deficit spending is never good and I took Bush to task for it aswell, but you didn't know that did you? Obama is spending us right out of existance, so instead of voting for him like you did in 08 how bout you think for yourself look at the issues next time around.
Dude, the US never left Japan. There are still 40.000 troops over there.
Your country is broke as hell, but yet maintains it 750+ military bases in a 130 countries, costing 1,2 trillion dollars a year (which it has to borrow from China LOL).
Your treasury even doubled the money supply last year. Talk about a recipe for disaster.
If Americans aren't occupiers then why are their troops in Uraguay? Why are their troops in Germany still? WW2 ended 65 years ago. Sure American foreign policy has a good history, but it also has a bad history. Ask Chileans, Guatamalens and Iranians.
Stein was totally wrong in saying that. The anti-semitic card is always pulled when ever someone feels defensive. Ron Paul was NOT refering to any country in particular, yet Stein assumes it is Israel.
This comment has received too many negative votesshow
RP wasnt being anti-semitic, but his argument was retarded. They aren't terrorists because we are occupiers. It's the other damn way around. If he was referring to Israel, well the US isnt occupying. Israel began occupying Gaza and WB after THREE wars started by hostile, xenophobic, racist, religious-nut, right-wing elements of the surrounding communities. To blame the US for what Israel does would involve anti-semitic conspiracy theories - in which MANY Ron Paul supporters are known to believe.
A big reason for 9/11 is the US blind aid for Israel, and the zionists who allow 500,000 Iraq's to die..Madeleine Albright, Clinton Sec of State...Zionist...condoned 500,000 deaths of mulsims...read up on it
The big reason for 9.11 is blind aid for Israel by the US, and zionists like Madeleine Albreight, sec of State under Clinton, and Wolfowitz, who were both satisfied with 500,000 iraqis dead in the 90's b/c of sanctions. 500,000 dead and most americans dont see its the Zionists behind our policies..wake UP..Stein is one right in front of you.

Give me liberty, or give me DEATH!
yakyakyak69 2 years ago
What constitutional rights have been taken from you? The rights you have by virtue of the Constitution result from a social agreement we have made among ourselves. Your natural rights are those that exist outside those created by human-made constitutions and laws. Congressional use of the Commerce Clause is constitutional, and our government doesn't consist of Statist Tyrants.
LarcheOsborne 2 years ago
WRONG!
Can the State Gov'ts...
yakyakyak69 2 years ago
As to rather of not the federal government can force you to purchase medical insurance, there is no provision in the Constitution stating as much (unless you hold the preamble as Constitutional), however, there is nothing denying Congress the right to provide less expensive and better insurance than do private industries, as they do with Medicare and VA. (continued)
LarcheOsborne 2 years ago
However, states can require you to carry insurance. Congress can also require companies whose products or industry cross state lines to carry insurance. The first 9 Amendments confer certain negative freedoms to protect us from federal (but not state) governments. Positive freedoms were not part of the Constitution until the 13th Amendment. None of these were considered natural rights. (continued)
LarcheOsborne 2 years ago
On one item, I agree with you. I think the Patriot act should have never been passed. I opposed it from the beginning. Certain parts of it, if ever ruled upon by a court, should be held unconstitutional.
LarcheOsborne 2 years ago 3
Congress can regulate the commerce cross state lines, but the production & employment happens WITHIN state lines and Congress has NO authority within the several States.
Original intent: Regulate means to KEEP REGULAR.
The Federal Gov't can force companies to buy LIABILITY insurance to protect customers when the products are sold accross State lines and the STATES may force companies to buy insurance for their employees which are employed WITHIN the STATE!
Competition is GOOD!
yakyakyak69 2 years ago
Actually, the extent of the commerce cause is very broad and allows congress great latitude within the states. Congress can intervene in state by virtue of some amendments beginning with the 13th. Also, some treaties, once signed by the president and approved by the Senate can give the federal government the ability to act in certain state matters. The federal government can make certain funds available only it the state uses them in an approved manner. (continued)
LarcheOsborne 2 years ago
Furthermore, federal courts have exclusive jurisdiction in certain areas such as bankruptcy, and the Supreme Court can overrule any state court, even if all reverent events occurred within the state, if a constitutional question is raised. (continued)
LarcheOsborne 2 years ago
Also, the federal government owns a lot of land and employees a good number of employees in each state. If you shoot your mailman while he is on duty, threaten a federal judge assigned to your state, or steal the postcard from your neighbors box, you have violated federal (and state) law. Mail fraud too is a federal crime. As for crimes on federal land such as national parks, post offices, and federal buildings, the federal government can take action.
LarcheOsborne 2 years ago
Postal Service is a VERY SPECIFIC enumerated Federal power whereas REGULATE and COMMERCE are vague terms and thus specifically REGULATED in scope by the 9th and 10th Amendments.
In order to expand the power to Regulate Commerce beyond the SPECIFIC ENUMERATED POWERS, the Constitution requires Amendment NOT interpretation because interpretation itself is vague and thus leads to Tyranny.
Specific = known = fair
Vague = interpreted = unfair
yakyakyak69 2 years ago
The Framers were vague in many things while drafting the Constitution for a reason. They were drafting a Constitution, not drafting laws. The Constitution was drafted in 1787. The 9th and 10th Amendments were drafted in 1791. They did not limit the commerce clause or any of the other methods by which the federal government could intervene in the affairs of a single state. The 13th Amendment was different because it, in section 2, allowed congress to enforce freedom in each state (Continued)
LarcheOsborne 2 years ago
With the 13th Amendment, Americans gained their first positive freedom. Now look to the 14th Amendment. Until the early 20th century, the first 8 amendments were not binding on the states. Over the past century, most (but not all) of the first 8 amendments were made binding on the states by way of the 14th Amendment. In this manner, the federal government can constitutional intervene in state affairs in certain situations.
LarcheOsborne 2 years ago
ALL of the Amendments are designed specifically to CORRECT VAGUENESS and as time passes so does word useage and that is why Original Intent is so important.
The Federal is a creature and creation of the several States and that is why the Bill of Rights were enacted to protect the creators from their monster which exists to protect them from other nations and from each other.
yakyakyak69 2 years ago
Amendments are created to change the change the Constitution, Leading Justices such as Scila disdain original intent and instead look to the plain language of the law,
LarcheOsborne 2 years ago
The common use of language (words) changes over time. Therefore, using plain language to interpret law instead of original language to APPLY the law as originally intended is in fact making law from the bench.
When the judiciary interprets law it is IN FACT making law and is therefore guilty of TREASON and TYRANNY!
The 1st & 2nd Amendments exist so that We, the People can NULLIFY the resulting Tyranny and maintain a Free State!
Living Constitution through Amendment NOT interpretation!
yakyakyak69 2 years ago
I largely agree with you that conservative judges are often wrong to ignore original intent, but the judiciary is merely following our common law system, adopted by the founding fathers.

Both were farsighted and responsible for much of the freedom we enjoy today.

yakyakyak69 2 years ago
Nullification is unconstitutional. Nullification failed in its nascent form during the Framers' generation, it was defeated by Jackson, and Lincoln drove a stake through its heart. Any state law that attempts to vacate a constitutional federal law is null and void. It cannot be enforced without federal assent.

As for my law school teachers, some were liberal, some were conservative. They were not engaged in some conspiracy to brainwash students.Hell, they sometimes disagreed with each other on legal theory.

NeoCon vs. Liberal is a false-flag operation against our liberty!
yakyakyak69 2 years ago
I'm not sure what you are saying, If you think big business can harm government, I agree. That's why I want the government to regulate it. If you think government is of necessity harmful, I disagree, Government has help to win two world wars, eliminate smallpox and polio, sent humans to the moon, funded countless studies enabling us to learn more of ourselves and our universe, saved millions of lives by building sewer systems, enabled public education, provided safe drinking water, and on and on
LarcheOsborne 2 years ago
When Judicial Activism allows the gov't to ignore the 9th and 10th Amendments, Corporatism replaces Free Market Capitalism because corporations & special interest groups support politicians who redistribute taxpayer $ to them. Military Industrial Complex, Banks, Auto Companies, and so on.
I am NOT against gov't, but like our founders I believe that competition among the States for taxpayers forces state and local gov'ts to do a better job of offering services than any federal monopoly could.
yakyakyak69 2 years ago
I agree that democratic capitalism is good and necessary with respect to things such as food, shoes, clothing, and similar items, but not in all things. I all agree that corporations have too much influence in congress, Their contributions and lobbying must be curbed. Nor do not believe the 9th and 10th Amendments are abused. Federal monies given to states allow the states great discretion on how the monies may be spent for the most part. But this often results in local corruption.
LarcheOsborne 2 years ago
LarcheOsborne,
When you say "Federal monies given to states..." You REALLY mean Local taxpayer (extortion) RETURNED with strings attached.
Corruption will always be in politics, but corruption at the local or State level is MUCH less harmful than corrpution at the Federal level because people can vote with their feet.
Vote with their feet means to MOVE to another location (state or city) without having to leave the country this works because of tax base migration.
yakyakyak69 2 years ago
The poorer states, generally the Republican states, usually receive more money from the Federal government than they put in where as the richer states receive less. Yes, there is often strings attached. I grew up in the Deep South where public money was often and publicly abused. When I was a public school teacher, I saw educational mandates made by people who knew nothing about teaching methods, subject matter, or the needs of the students. (continued)
LarcheOsborne 2 years ago
Sometimes, local control, while seeming good, is bad. (I am not saying that federal government is always better.) Ideally and in the vast majority of cases, spending decisions are made at the state and local level. Unfortunately, people vote for state and local officials, such as DAs and school boards without looking at their records. (continued)
LarcheOsborne 2 years ago
A law professor once told me, "No DA has never won an election by saying a defendant was innocent; DA are elected by the number of people they send to prison, specifically death row. Consider the number of prisoners freed in recent years by DNA or other exculpatory evidence. (continued)
LarcheOsborne 2 years ago
Now, the Supreme Court is about to hear a case from two men who possess evidence that DAs sent them to prison for over 20 years while knowing someone else did the crime. The new DA was new and wanted to make a name for himself, so he and his office helped the local police in framing two young African-Americans strangers, although all the evidence pointed to someone else. (continued)
LarcheOsborne 2 years ago
There currently exists state laws protecting DAs who knowingly convict the innocent. The state's defense is "There is no constitutional right not to framed." The plaintiffs' argue that the DAs went beyond the law when they aided the police in knowingly framing innocent men before the trial stage. They would still be in prison were in not for the new evidence.
Did you know that Illinois death row was largely emptied by DNA tests and by evidence discovered by university journalism students?
LarcheOsborne 2 years ago
The Commerce Clause WAS very broad UNTIL the 9th and 10th Amendments limited them.
That's why the 13th Amendment was NOT simply an executive order. They WERE honoring their Oath by Honoring and Defending the Constitution. This is NO longer the case.
The Senate can not give ANY power to the Gov't NOT specifically enumerated WITHOUT Constitutional Amendments.
Any return of taxpayer money to any State with strings (bribery) is unlawful and unconstitutional.

The real racism in this country isnt white on black ITS BLACK ON WHITE and almost as important is liberals like you who hate the Jews for no reason. Ben Stein is absolutly correct and Ron Paul is a moron.
thebig1 2 years ago
...and you're just sucking around to keep in good with the organ dealers - just in case, LOL! he's still a big stupid jew... listen to him play the race card... and you... you know nothing about cards... americans play checkers - jews play chess... just like a car dealer, they'll talk you into sending your kids to die for israel - looks good on you... and i don't hate jews... i don't know any... and i don't care... all i said was "he was a big stupid jew"... Ron Paul is way beyond you, anyway...

First off Ron Paul is a moron who hates the Jews. He is an anti semite just like you. The real racism in this country as I said before is black on white and big media/liberalism against the Jews IE ANTI SEMITISM!!!!
thebig1 2 years ago
Big media against the Jews? On what planet do you live on? Big media is owned and operated by Jews.
kdixon7783B 2 years ago 3
but wait a minute... why do you think that it matters if one is an anti-semite or not... where does that matter... you can call me an anti-semite all day and i wouldn't flip my latke over it... after the organ rabbis paraded through the media in chains, do you really think that anyone cares if you call them an anti-semite... holy fuck... being called a pro-semite might upset people... that would mean the same as "organ robber"... of course i'm an anti-semite... report me to your JDL...
CrackerJackLee 2 years ago
anti-semite is merely another word for intelligent goyim...

This is ONE of the most IGNORANT posts I've ever read.
Apparently, (thebig1) doesn't even know what anti-Semitism is!
Read the book: Hamiltons Curse and get a clue!
yakyakyak69 2 years ago 2
hey... big one! what does goyim mean? why does the word GOYIM exist? and? what is a shiksa...? does SHIKSA have a special meaning...? i notice that jews always refer to us as goyim... and to white females as shiksas... what is the etymology of these words...?

I used to like Ben Stein. Then he turned into a crazy hack who spews bullshit. How is calling America occupiers anti- semitic?

@pegcitybenzino both of them are full of shit

Americans are not occupiers at all. We have given the blood of our sons and daughter in ASIA, Europe, and the middle east. We destroyed Japan THEN REBUILT IT AND LEFT. Go spew your liberal BS elsewhere!!!!

we are over there for oil and israel. period.
we should be here with natural gas and solar and our own interests...china will run eight by while we bog down in socialism and reliance on special interests dictating our future

@thebig1 When, exactly, did we leave Japan? We STILL have bases in Japan and Germany! You obviously don't know what you're talking about.
Marvin27 2 years ago 2
Who runs the government of Japan? Could you please tell me? Last time I checked my friend the only reason we had bases there is two fold...because the government wants us there and two we said in that agreement long ago that we would protect japan against China if it came to that. Learn your history you liberal moron.
thebig1 2 years ago
@thebig1 You admit that WE HAVEN'T LEFT JAPAN and assume that I'm a "liberal" which just proves that you're a clown. You can't back up your argument without contradicting yourself and resorting to pejoratives, typical "conservative" douche baggery. You still think that taking Iraq's oil is about lower gas prices and that deficit spending on war is good for the economy, obviously you don't understand how things work and have no sense of history beyond the last four weeks.
Marvin27 2 years ago
First of all clown you are a liberal. Second of all we haven't taken a drop of Iraq's oil NOT ONE DROP. Deficit spending is never good and I took Bush to task for it aswell, but you didn't know that did you? Obama is spending us right out of existance, so instead of voting for him like you did in 08 how bout you think for yourself look at the issues next time around.
thebig1 2 years ago
Nice try there, clown shoes, but I didn't vote for the O-Bomb. I would keep playing with you, but I'm allergic to trolls.

Talk about a recipe for disaster.
namehoela 2 years ago 2
If Americans aren't occupiers then why are their troops in Uraguay? Why are their troops in Germany still? WW2 ended 65 years ago. Sure American foreign policy has a good history, but it also has a bad history. Ask Chileans, Guatamalens and Iranians.
pegcitybenzino 2 years ago 2
Thiose countries want us there. I'd prefer we werent there but thats the way it is
thebig1 2 years ago
Stein was totally wrong in saying that. The anti-semitic card is always pulled when ever someone feels defensive. Ron Paul was NOT refering to any country in particular, yet Stein assumes it is Israel.

OHiOfiOviriiO 2 years ago
I'm not familiar with any US Israel connection.
With that said, you are saying we are occupiers because they are terrorist? Why would anybody want to be a terrorist then?
I'm honestly dreading your answer.

A big reason for 9/11 is the US blind aid for Israel, and the zionists who allow 500,000 Iraq's to die..Madeleine Albright, Clinton Sec of State...Zionist...condoned 500,000 deaths of mulsims...read up on it
Go12Go 2 years ago 3
The big reason for 9.11 is blind aid for Israel by the US, and zionists like Madeleine Albreight, sec of State under Clinton, and Wolfowitz, who were both satisfied with 500,000 iraqis dead in the 90's b/c of sanctions. 500,000 dead and most americans dont see its the Zionists behind our policies..wake UP..Stein is one right in front of you.
