I completely agree! I had a Discover card and some other debts, then I got laid off in late 2009 and couldn't pay anymore. Even if I could afford to make payments, it would only cover the interest and the principal would never go away! Enough is enough! I haven't made a payment to a financial institution since 2010. I had $27.00 on a BoA card that I didn't know about...for months (was overseas, had paid off card). I was able to get rid of most of the fees, pay them $50.00, and it was sorted, right? NO. They canceled my card and refused to do anything re: CRAs--my rating dropped from 790 to 580, at which time Chase increased my % to 30 as well... I could have paid Chase, but now I cannot...dumbasses. My credit score is shot, but they're not getting a freakin cent from me ever again--defaulting with pride.
As a starving Grad student I had a Bof A account as well. I struggled to keep any amount of money in the account and what little went in was eaten up by checking fees. When I thought I was okay and had enough in the account a checking fee would come in and the next thing I knew I was overdrawn and punished with a $28.00 NSF charge and that was in the year 2000! I dropped this useless greedy organization upon graduation in 2002 and joined a Credit Union. I will never go back!

I closed my BOA account years ago and stopped using their credit card until they deactivated the account for inactivity. That's what they get. FRAUD! Banks have no money invested in loans. When you signed your promissory note, they deposited it as a credit upon which they could lend 9 X that much. Then they handed you your own money which you created with your signature. They then charged you 3 X that much for book keeping entries. Or, they securitized it, sold it to a trust, making as much as 40%. Now they're a servicer with no right to foreclose. Look into "quiet title" actions, you get all your payments back and a release of lien.
If you borrowed the money, you singed contracts, agreed to their terms. Just live debt free. I'm climbing out of debt now, but every bit I owe, I asked for. The way to revolt is to not borrow. The Dave Ramsey way works!

Everyone should stop paying their bills except for local merchants. Withdraw all money from banks and use cash to make local purchases from local business'. The trustees are just as bad. They offered to reinstate my loan for %30 of late payments. I accepted. The paperwork never arrived. I called the bank and trustee daily but it still went to trustee sale. Nobody showed up, now the government owns it. I talked to RE lawyer and was told that this was a common practice!

Chase bank did this to me and I paid off the balance. It was hard and took me a while but as soon as I paid it off, I closed it. Paying off all your credit cards, than never using them again is the best way to revult. That's what I'm doing. They won't be able to steal from people if nobody uses their services.

As a starving Grad student I had a Bof A account as well. I struggled to keep any amount of money in the account and what little went in was eaten up by checking fees. When I thought I was okay and had enough in the account a checking fee would come in and the next thing I knew I was overdrawn and punished with a $28.00 NSF charge and that was in the year 2000! I dropped this useless greedy organization upon graduation in 2002 and joined a Credit Union. I will never go back!

FRAUD! Banks have no money invested in loans. When you signed your promissory note, they deposited it as a credit upon which they could lend 9 X that much. Then they handed you your own money which you created with your signature. They then charged you 3 X that much for book keeping entries. Or, they securitized it, sold it to a trust, making as much as 40%. Now they're a servicer with no right to foreclose. Look into "quiet title" actions, you get all your payments back and a release of lien.

We have similar situations in canada. The CEO of Air Canada earned in excess of $86 million last year. The customer service lines are now answered in India to save money. He layed off regular people here and sent the jobs there to save money so he would earn that much money. This is sick people.

Capital One needs to be investigated for internal identity theft. Got card...didn't have it but for a week. Fraud alert put on it for no reason. Called them.They wanted driver's license copy, utili. bill, and the kicker, paystub/1099/income tax form all this to prove it was me. I remember when I first discovered that banks allow purchases w/no funds. It was one of those "process large items first" then a string of smaller items. Total fees was 300+ for bout $25 worth of small purchases: gum burger coffee paper soda etc. I ended up telling off one of the bankers and left the bank for a local one that has since been bought out by the one I left. The most insidious part about this is that it is crafted specifically to exploit those who are least able to afford it.

Everyone should stop paying their bills except for local merchants. Withdraw all money from banks and use cash to make local purchases from local business'. Don't fly or drive unless absolutely neccessary.If only 25% of the population does this, they won't get money they'll be inundated with billing and frazzled by loss of revenue. If others see the effect and as word travels the effect on the rich will be catastrophic.

BOA acquired MBNA quite recently. Thet utilise the same tactics here in UK.
A "Customer" (ie, Cash Cow in MBNA speak) had a £20,000 debt written off at the High Court due to Section 78 CCA non-compliance and unacceptable Collection Practices by both MBNA and the firm they sold the debt to.
Sadly, if a greedy Corporate pisses on the general public and insists it's raining, there are many who merely reach for the umbrella rather than the Samurai Sword.

@awsomeshot furthermore: I understand your frustration I missed a payment by a day on my discover card once carrying a small balance of 500ish and they jacked the minium payment up to $75. I of course payed the balance off and the crazy interest they hit me with but my mistake it was in the agreement I signed. Its a buyer beware thing. I got 72k in college debt I could blame the system the government my parents my school but ultimately that is my responsibility.

I am no longer paying interest, and BOA have told me that anything I choose to pay will come straight off the balance. Point: Don't let them scare you. I have been a B of A customer since 1982. When B of A allowed my deceased mothers account to be robbed of $160,000.00, by fraud that was It. That was my inheritance of which they sent me a check of $10,000.00 and we are sorry but we cannot do anything.
I am now behind on my CC bills to B of A they are last to get paid, if at all. Our ELOC was pushed through 3 year ago the loan officernever took an application for employment as I was disabled.

The trustees are just as bad. They offered to reinstate my loan for %30 of late payments. I accepted. The paperwork never arrived. I called the bank and trustee daily but it still went to trustee sale. Nobody showed up, now the government owns it. I talked to RE lawyer and was told that this was a common practice!

I as well am close to eliminating all debt (exept mortgage but working on it) and have taken the recession as a wake up call. Remember one thing, they will all be held accountable for their actions immediately following death. Knowing their inevitable fate, we should be more inclined to pity them then to hate them. Chase bank did this to me and I paid off the balance. It was hard and took me a while but as soon as I paid it off, I closed it. Paying off all your credit cards, than never using them again is the best way to revult. That's what I'm doing. They won't be able to steal from people if nobody uses their services.

Please don't take this the wrong way. I am against credit card companies, the Fed, and the NWO. You can actuall sue your credit card company stating they refuse to settle a debt which is a violation. Sue them in small claims court and say you called and they refused to take a payment. Watch how fast they call you with a payoff arrangement.

you changer bank amreica to another credit card for 0% interest for xxx amount of months or so and than keep changing after that time is up than get another one until credit card is payed off that is what i did and never payed interest play the game , but be the winner

they can send you to jail for nonpayment of debt. that's right people, those of us who cannot or will not pay back debts can go to jail for it! it is an outrage that being poor is a crime.
on a tangential note: did you know that in the states of CA and AZ you can be arrested and fined up to $30,000 for being homeless. That's right, if a cop finds you sleeping, or even walking around, and you say you got no place to stay, then they can either escort you to a shelter, or they can jail you

@Rockerchic4God A judge issues an order to pay, you fail to meet that order, voila, you are in contempt and subject to imprisonment. Once you go into bankruptcy you are now involving the courts, with the courts maintaining the superior claim.

@mathdude28 This is completely wrong. People that know nothing of the law should not be posting, and people without a license to practice law, should not be giving legal advice. That is illegal. Debtor's prisons were abolished many years ago - 1833 to be exact.
No one anywhere in the U.S. can be legally jailed for debt other than child support.

They want us to back down when they pressure us and make us believe we have no HUMAN RIGHTS at all! Well, to hell with that!! If enough people do this...they will have no choice but to back down themselves! WE are the MAJORITY - NOT THEM! IMHO I think everyone should just be done with these big banks and if you must deal with one, choose a community bank to deal with.

You can, however, be sued by your creditors, but the suit will be filed in CIVIL court, NOT criminal. You can learn about your rights by visiting our website (Donaldson Williams, Inc.).

Credit is not money you own. It is not a green card for you to spend beyond your means, even if you carry a balance, this is not your money. You are right you have been duped, you played right into their hands by thinking that credit money is free.
