we must use words with mathematical precision.

Rothbard calls the state criminal.

The problem is that crimes are legally defined, and thus defined by the state.

You can't say the state is evil either,

because that's theologically defined.

So really, you need to say that the state is

really, really bad,

Justice precedes law. To say that law defines justice would make justice arbitrary. Stealing from someone using coercive force is an injustice. Stealing from a huge number of people is a huge injustice. It doesn't matter that it's the state that does it and defines it as being legal.
