This has been tried by several people on several occasions in several locations within the first circuit. Every time, the court has ruled against the defendant. Can't knock this guy for finding a loop hole though. From a practical stand point however, it's a safety issue. I know many people don't want to hear it, but they may feel differently if an untrained, untested or proven to be unsafe driver killed their family member and noone had any legal recourse to prevent or do anything about it.

@sankofa669 First, No we don't. Second...of course a study such as that would indicate that licensed driver's were involved in more accidents than non-licensed drivers. Simply because the vast majority of driver's are licensed. People are going to comply and obtain driver's licenses if they wish to operate a motor vehicle upon a way, or they are going to be arrested and prosecuted under the penalties prescribed by the law. No need for any case info. This man is a freak and I have dealt with many of these. This has gone to the higher courts many times. The legal definition of driving is "being in actual physical control of a conveyance." This includes all motor vehicles, bicycles, golf carts and yes, even lawn mowers.

When someone takes it upon themself to use their own constitutional rights to violate someone else's, that in and of itself is unconstitutional as well as immoral. The fact remains that speed limits (especially within city limits, or rural roads) are absolutely necessary to lessen the severity of accidental collisions. Also, the ability to safely operate a motor vehicle becomes greater at slower safer speeds. Most jurisdictions in the USA prosecute "driving to endanger" an arrestable criminal offense. This includes but is not limited to operating motor vehicle at excessive rate of speed.

This has been tried by several people on several occasions in several locations within the first circuit. Every time, the court has ruled against the defendant. Can't knock this guy for finding a loop hole though. From a practical stand point however, it's a safety issue. I know many people don't want to hear it, but they may feel differently if an untrained, untested or proven to be unsafe driver killed their family member and noone had any legal recourse to prevent or do anything about it.

@sankofa669 First, No we don't. Second...of course a study such as that would indicate that licensed driver's were involved in more accidents than non-licensed drivers. Simply because the vast majority of driver's are licensed. People are going to comply and obtain driver's licenses if they wish to operate a motor vehicle upon a way, or they are going to be arrested and prosecuted under the penalties prescribed by the law. No need for any case info. This man is a freak and I have dealt with many of these. This has gone to the higher courts many times. The legal definition of driving is "being in actual physical control of a conveyance." This includes all motor vehicles, bicycles, golf carts and yes, even lawn mowers.

It is analogous and similar to the expressions "for all intents and purposes" or "in fact." (taxi, limo, bus and truck drivers etc... I understand that if you would stop me, for whatever the reason, you would have to prove to me that I've committed a crime. OK guys, lets keep in mind NEPolice1979 is a peace officer first and foremost. He's also a policy enforcement officer but i think his heart's in the right place. Hopefully he'll look into some of the things mentioned here and see the truth for what it is.
I used to be angry at all cops myself for a while but i came to the realization that mostly their not aware of what it is they're doing; and when it comes down to it, they will risk their lives to save you, just keep it in mind.

I'm in agreement with someone who supports liberty and constitutional rights. When someone takes it upon themself to use their own constitutional rights to violate someone else's, that in and of itself is unconstitutional as well as immoral. The issue i'd have with Mr. Sprinkle results from his decision to use his lawful right, to then break the law while creating a potentially hazardous circumstance on the roadway by which other motorists could have been injured or killed. It's that simple.

Nobody memorizes them all, that is a redundant question. The fact remains that speed limits (especially within city limits, or rural roads) are absolutely necessary to lessen the severity of accidental collisions. Also, the ability to safely operate a motor vehicle becomes greater at slower safer speeds. Pre emptive wars are a whole different topic, stop clumping something of that severity with something as simple as local ordinances, which by the way, the state reserves the right to enforce.

'Who decides what the speed limit is and what gives them this authority?'
The legislative body(s) of each state which are democratically elected by the people of said state and appointed to the position of law maker(s) for that purpose thereby have the authority to write, cast a vote, and pass, amend or repeal legislation within their representative state. @NDNPolice Nice of you to join in on a 1 year old conversation. anyway, let us examine what you have said here. Does your state statute have an enacting or enabling clause on the face of the document; and does it comply with your state lesgislative rules. Most states require a quoted enacting clause or its void, not to mention it goes way back into common law.

@vme02 The state i reside in, as well as work in does not have nor does it recognize any aspect of common law. You may have previously researched common law and if you had, you know it's origins are found with the King's court or 'Curia Regis' of the English middle ages. Common law had little to do with individual rights, rather it consisted of procedural remedies with very little in the way of individual liberty.

It is all about individual freedoms and always has been. The US has its entire law based on the foundations of common law. @NDNPolice Here's free lesson for you. Anywhere in the world that used to be a British colony at any time has its entire law based on the common law. The US is still under common law. Under common law: That which is not expressly forbidden in allowed, how's that for individual freedom. Also: you may do as you which as long as you do not infringe on the life, liberty, rights or property of another. I bet you thought the US invented 'liberty', it shows your small mind.

@NDNPolice You really have a difficulty in letting go of your dogma. Did they tell you in this course that the US constitution is entirely entrenched in the common law? Or maybe the framers just made it up and all of a sudden you had a whole new set of laws seperate from the common law overnight? I've already said previously that the state i work for does NOT recognize common law period! You seem to think you know more than the instructors at the police academy and every state rep. we employ to write legislation. You don't even concede that the origins of common law are found in England in the middle ages. Since you don't even know this, whats the basis of your 'knowledge'?

@NDNPolice Actually, Unless your STATE REJECTS the U.S. Constitution, the "common Law" is effective in YOUR state. Your Police Acad. instructors need to read the first and last Sentence of the 7th Amendment to the U.S. constituion. Do you not take an Oath to UPhold the U.S. constitution? if not... your right. IF YOU DO, then your instructiors are WRONG or idiots or both. And Common Law goes back to the Old Testiment. Roots start there.

Common law is NOT valid in this state. Only laws which are specifically enacted by statute are enforceable within this state.
Do you actually feel as though it's a good thing that under 'common law' the king sheltered his soldiers in any home, and/or searched it without the owner's consent OR a warrant at any time he pleased? Is a system absent a rule such as the 4th amendment, which protects the individual from unreasonable searches and seizures justified? If that's your opinion, I disagree.

@vme02 Thankfully vme, for those of us who beleive in our great nation of the United States of America...we the people vote, the winner (whether each individual agrees or not) is the candidate who obtains the majority of the electoral votes. (Or so we hope, fraudulent practices aside).
A statute is a law. Two different words but in meaning the same thing.
A statute is a 'law' enacted by the legislative branch of a government.
The people of said society give that statute it's force.

@NDNPolice A de facto standard is a standard (formal or informal) that has achieved a dominant position, by tradition, enforcement, or market dominance. It has not necessarily received formal approval by way of a standardization process, and may not have an official standards document.
This de facto standard is what you enforce for the past 150 years round about that the federal government has been running under and read real good this comment... you legally cant enforce or pass any law...

It's fantastic to know there are people such as Mr. Sprinkle on the road way who have absolutely no regard for the safety of other motorists. Blowing by a mother and her children (or anybody for that matter) doing 90 mph in a 65 mph zone is dangerous, selfish and quite frankly, anybody who operates a motor vehicle at excessive rates of speed is committing an arrestable offense in most jurisdictions.

It wouldn't bother you in any way to be safely driving down the roadway with your family, while some selfish individual with no regard for the life of you or that of your family, speeds by you at an excessive rate of speed? Potential for fatality goes up with every mph. Furthermore, with other motorists doing the speed limit, this creates an even bigger hazard. Liberty is the pursuit of freedom to do as one pleases so long as in doing so they do not impede on anothers ability to do the same.

§2413. Driving to endanger
1. Definition. A person commits a Class E crime if, with criminal negligence as defined in Title 17-A, that person drives a motor vehicle in any place in a manner that endangers the property of another or a person, including the operator or passenger in the motor vehicle being driven.
Most jurisdictions in the USA prosecute "driving to endanger" an arrestable criminal offense. This includes but is not limited to operating motor vehicle at excessive rate of speed.

You're right. People should just be able to drive around recklessly with no accountability or responsibility. If you're ever the victim of an accident which results in your death or severe injury, i doubt if you'd be singing the same tune. You'd be a hypocrite if you considered legal action as a result.

In this jurisdiction, if you are in violation of the speed limit you could be cited and fined. This is per order of the state. The state gov. is made up of officials who were elected by THE PEOPLE. Therefore, the policies and laws created by the governing body are indirectly implemented by the residents of the state. You would pay the fine, or eventually your license would be suspended nation wide. If you were caught omv after that, you could be arrested. This says the law by the ppl for the ppl
