It's not a baby yet, it's a few cells. The little girl had no say in the matter about whether she wanted a child or not. The father should absolutely be punished (as should anyone who harms a child).
In any case, it comes down to choice for this little girl, her guardian/mother (if the girl chooses to involve that person), her doctor, and her god. The government should stay the hell out.
Is there really a right answer to that question though? Abortion can be very traumatic, as would carrying the child to full-term and giving birth. Being put in the position a girl like that would be in, both decisions would have lifelong consequences for her. Even if she considered adoption, there might not be many parents wanting a newborn conceived in such a situation.

Guarantee that if laws that require parental consent stay on the books, kids will find illegal, unsafe methods to get an abortion if it means hiding their sexual activity from their parents. The death rate amongst teenagers would go up and their pregnancies would go with them.
