The prosecution really had no rebuttal witnesses to challenge the abuse claim - they also didn't have any character witnesses on behalf of the victims - Jose Menendez, in particular, did not seem to be well-liked, and many people were frightened of him and were not sorry to see him go. Of course, murder is never the solution and yes the brothers should be punished, but the parents weren't exactly innocent victims. The family seemed very dysfunctional and there was probably a lot of pain.
