However, since it was something that was recurring, my best bet is that she would have time to call the police as opposed to just dealing with it. This Pharmacist really did go too far! I mean, the suspect was unconscious and not moving. There was no reason to shoot someone six times. I find it very inhumane when someone does that. There is literally no reason for the six gun shots. He went back to trade guns. That pharmacist was out to kill someone. I am a Martial Arts teacher and not a lawyer but I teach my students that when you or others are in fear for your/their lives or bodly harm they may act by using reasonable force that will end the direct threat to them and or others. The first shot rendered the young man unconsciousus the other 5 shots were beyond reasonable force.
What if(S) have to many variables.I am not a police officer (just a Martial Arts Instructor) but what I would have done was to lock up the store had the women go to a safe place in the store call 911 from the safe place within the store. I would have removed the weapon(s) from the young man and made sure he was secured (meaning that he had no more weapons on him and he was not able to harm anyone else) and the scene was also secured then waited for EMCA and the police to come.

I was not there,so I do not know where the young man fall after being shot to the head but leaving him unsupervised (to get another gun) to me is a greater risk then having the gun trained on him advancing on him and making sure he was secured. It is standard operating procedure for the DA to over charge a case, then plea it down to what the person is really guilty of. My question is did he discharge his weapon at the other fleeing suspect. The first robber probably died instantly from the head shot and putting a few more rounds in him would be irrelevant.
Assuming he discharged his weapon at the 2nd fleeing robber a charge of up to attempted murder would be appropriate to bring before the people.

However, since it was something that was recurring, my best bet is that she would have time to call the police as opposed to just dealing with it. This happened once, and the man couldn't have just called the police while they had a gun in his face, as it would've given them more of an incentive to shoot him. He did the right thing by returning fire. Was shooting 5 times excessive? Yes, but who gives a fuck.

The first shot rendered the young man unconsciousus the other 5 shots were beyond reasonable force.

What if(S) have to many variables.I am not a police officer (just a Martial Arts Instructor) but what I would have done was to lock up the store had the women go to a safe place in the store call 911 from the safe place within the store. I would have removed the weapon(s) from the young man and made sure he was secured (meaning that he had no more weapons on him and he was not able to harm anyone else) and the scene was also secured then waited for EMCA and the police to come.

I was not there,so I do not know where the young man fall after being shot to the head but leaving him unsupervised (to get another gun) to me is a greater risk then having the gun trained on him advancing on him and making sure he was secured. He said they both fired at him, a bullet grazed him, the kid tried to stand up and cursed at him, shot the kid then went after the second guy, was a Gulf war veteran, killed people with .50, suffers PTSD, wounded in mortar attack which disabled him.
FACTS:

It is standard operating procedure for the DA to over charge a case, then plea it down to what the person is really guilty of. My question is did he discharge his weapon at the other fleeing suspect. The first robber probably died instantly from the head shot and putting a few more rounds in him would be irrelevant.
Assuming he discharged his weapon at the 2nd fleeing robber a charge of up to attempted murder would be appropriate to bring before the people.

Justified! It's obvious the old man was scared and defended himself. With the fear of God pumping through a man's veins after having been shot at it's only natural for the victim to ensure that the threat of imminent danger has been contained.
I would have made sure that anyone who tried killing me was absolutely dead too, even if I pumped another 50 rounds into them. Love how vicitims of violent crimes are seen as nutjobs when they react to a situation like this. How would you?

@stoltz90 this thug was no child. he was committing a thought out crime and i feel no loss that he was killed. however, once he was down and not a threat, the pharmacist had no need to return and pump more slugs into him. if he wanted to make sure he was dead he could have continued firing until he hit the floor and the threat was removed. we can only presume the thug was unconscious as we can't see him on the floor. could he have been trying to get up and did he have a weapon?

The shop owner fired once, hitting a kid in the head. He then chases another out and fires at the kid running away 3 times in public. Returns to the store, gets another weapon and fires 5 rounds point blank into the already incapacitated suspect. How can self defense be even remotely considered?!? If im chasing you down the street shooting at you, or if I shoot you 5 times while you're unconcious..how is that self defense?! That guy went WAY too far. It was murder.
