  • Security people can order you off the premises they are patrolling without reason. Stores/malls are private property and people do not have a right to protest and disturb the other shoppers.

    That said, I do believe puppy mills are disgusting and should be shut down but you're not going to get very far if you keep getting arrested for trespassing.

    They should have stood on public property outside with signs and protested THERE, not inside on private property.

  • Wow, 2 years later you guys are still watching this. I love the comments supporting me and my coworkers. Just to clarify for those of you that don't know or are just to dumb to know, under most if not all state laws a private citizen (which security officer's are) van make a citizens arrest if a crime is committed in their presents. in this situation the crime that was committed was criminal trespass.

  • I have read things and watched video's about pet stores and their abuse toward the animals they sell or buy, and I agree with protesting about it but don't you wan't to just buy your animal and get it out of the bad enviornment instead of starting all kinds of trouble for everyone by over filling an animal shelter? I just purchased a gerbil from a pet store and he looked horrible before I took him out of the enviornment he was in, now I'm sitting here watching him run around his aquarium happy.

  • I really didn't want to go to a mall, I just go there real quickly for a meal and left that is a way to avoid any attention like the security guy. If a hot chick says to me that she is not interested in me or something i just ran off as quickly as possible so I won't cause trouble.

Matthew Rossell wasn't arrested for protesting, he was arrested for Criminal Trespass because he was told 3 times before this that he could not protest in the mall (Private property). He came back and we arrested him. And using his daughter as a shield so we wouldn't arrest him everytime. And he wasn't some bystander who just spoke up. His wife is the ugly cheerleader who approached him after we took him.

People need to be made aware that most puppies bought from pet stores come from puppy mills where breeding bitches and stud dogs endure life long suffering, trapped in tiny cages, breeding litters until their bodies can't take any more. Our faithful companions deserve much better! Well done to everyone who fights to try and end this cruel trade.

  • The two (2) security guards who arrested the gentleman for speaking I HOPE were charged with FALSE ARREST. They CANNOT detain or take anyone into custody in this regard. There was NO Crime committed and they need to be sued and have their Security License REVOKED!

  • Security Officers do not have arrest power to arrest someone for Tresspassing (at least in Florida). The only case when a Security Officer can detain someone is for Retail Theft and there are very specific restrictions on those detainments. Only sworn Law Enforcement Officers can make arrests (with an exception for citizens arrests with specific limitations). Trespassing is not a crime unless the persons were warned first. They didn't arrest the cheerleaders..why not?

    so, you're saying that in florida, on private property, a person authorized by the owner of the property, cannot arrest someone for refusing to leave form the property after being directed to leave by the authorized person....sounds like a very flimzy law down there in florida.

  • it was not Florida, but I only can speak to florida law and most other states laws should be pretty similar. To answer your question, Trespassing After Warning is an arrestable offense, Yes. However, only a Sworn Law Enforcement Officer has the arrest power to make such an arrest NOT a Security Officer. Also, you are correct it's Private Property, however, it does have "public access" which does change things slightly.

  • Thank you Radical Cheerleaders for Animal Rights for participating in the nation wide crusade to end puppy mills and the stores that enable them. As a result Scamps no longer exist. Pet Store owners need to recognize that they may be next and avoid going out of business by going humane. Just SAY NO TO PUPPY MILLS.

I worked at a vet that had a contract with a pet store and I can't tell you how many puppies I had to wrap up in plastic because they died from being so sickly. No reputable breeder would EVER sell a puppy in a pet store! Go cheerleaders!!!

    On one hand, I kinda feel bad for the mall security. Even though they seem like such a-holes, I expect that they're probably just doing their job, and that they might risk losing their job if they decided to look the other way. It seems like the noble thing to do (to ignore the protest and allow it to continue), but I'm sure it's probably a difficult decision for them to make. At least, I hope so. I like to think they're not mindless, emotionless drones. :p

  • The puppies scamps sells have often later been put down due to parvo and other serious illnesses that kill a dog. One of the many complications of puppy mills. Unsanitary and horrible conditions.

    most of them are sick and need extensive vet care upon being boght and brought home, and sometimes put down because they are way too sick and the vet is unable to save them.

    By buying an animal from a store that gets their animals from horrible conditions such as seen in puppy mills, you are supporting the puppy mills.

    stop the demand, end the supply.

    It's sad, yes. These animals need to go to homes where they can be cared for, not stores that profit off them, sick or not.

  • BTW... Its not that they arrested them for protest, but under the public disturbance and trespassing. No matter what you do, they will lose unless they took it outside. Hand out fliers, cheer, have signs... OUTSIDE THE FRIGGIN MALL DOORS. A mall is not a park that is owned by the city.. its owned by an owner that wants to make money, if they didn't get written permission to do that... its trespassing. Its a building, not a park... its not public property. they ALLOW you INSIDE

  • I've read that malls have replaced the town square and that there are some protected forms of activity there because of that designation.

  • Having been involved in a mall protest before, it is true that it is usually private property and they can ask you to leave and if you don't it's tresspassing...

    HOWEVER

    My understanding also is that private security have no more legal authority to grab your body than an ordinary citizen doing a "citizen's arrest," which means I think it is legal to defend yourself against someone who isn't a police officer just grabbing you. Anyone know for sure?

  • Actually it's not that simple. Since 1980 it's been left up to the state courts and based off the state constitutions. Depends on your state boyo. In CA this would be completely legal. In OH it would be illegal. Oregon is a little stickier. Prior to 2000 it would have been legal...now probably not...though a case appealed to the OR Supreme Court right now might have a good chance of getting Stranahan v. Fred Meyer, Inc. reversed and opening malls once again to free speech.

    as one of the cheerleaders (no, I wasn't here due to prior engagements), I know for a fact this is very untrue. My own stuff comes much from Goodwill and the bins (goodwill as well) and other used resources.
