Even a Supreme Court Justice, Robert H. Jackson was quoted saying "any lawyer worth his salt will tell the suspect in no uncertain terms to make no statement to police under any circumstances." This comment implies that the police have the right to force you to provide them with the information they "need", which is not the case at all. Nor do they have the right to detain anyone they want. You must be suspected of having committed, committing, or about to commit a crime.

Most are ethical good people while there are some who aren't so good and make bad choices that affect peoples' view of us as a whole. That happens in any occupation.... teacher or pastors who take advantage of their authority and molest children of things of that nature, they give them all a bad rep even the they are the minority. So to answer your question, NO we do not threaten people to give us info...

  • @fine5oh I certainly agree with you at the point that there are bad and unethical people everywhere and in every profession - not just cops. I completely agree with you. And I agree there are good ethical cops. I am just not in agreement of the tactics used and the above the law mentality of cops (again, not all). There is audio of Sgts and Chiefs ordering their officers to detain people just as a punishment tactic - without charges.

And you can detain someone for the 3 reason you mentioned before, if they are detained for investigative questioning, or if you have reasonable articulatable suspicion, ex. someone walking around stores that are closed in the middle of the night. that person could legally be detained and asked what he is doing.

  • @fine5oh Investigative questioning? So are you saying that you could stop me, detain me, and force me to ID myself just to ask me questions like "did you see anyone come out of this store"? Of course if you are the one suspected of committing the crime, then you must ID. But what if I'm not and you just want to ask me questions. What's stopping me from refusing to answer and just walking away?

  • @1775novten If there is Reasonable suspicion like the example of the person walking around stores in the middle of the night, yes I can stop him and ask for ID and talk to him. Now if im questioning someone about if they saw something, I may or may not ask for ID.....

    But yes when people argue I usually do tell them to argue with the judge not me!

  • @fine5oh That's actually completely wrong but also worded weirdly. They do have the right (legal right) to detain you for an investigation. However, for them to have grounds to investigate you, you must be reasonably suspected of have commited, comitting or about to commit a crime. Ask some non-street lawyers and they'll tell you the same.

  • @munkykilr Its actually not completely wrong. Just like I said, one can be detained for investigative purposes. I know what I am talking because I am a police officer and I deal with this all the time. So sounds to me like you are the street lawyer.

And just because something is law, it doesn't make it lawful or constitutional. Unlawful "laws" are overturned all the time by the Supreme Court.

  • @1775novten We say that because people try to argue with us about what we can and cannot do and what is legal and what is not. Officers study the laws as much as lawyers do. We have to know the laws and stay updated and we know more about the law than most citizens do. And actually most officers who have degrees, at least on my dept, have them in criminal justice/law and some are lawyers. And if you are asking specifically about me, no I'm not a lawyer but like I said I study the current laws

  • @fine5oh I agree that it is in your best interest to study the laws and the citizens expect the police to know the laws, but that is not always the case. I understand that you study the law, but can't citizens also study the same laws? However, I completely understand that it could become annoying arguing with citizens, but I'd rather cops say "tell it to the judge" rather than "so you're a lawyer now". What if the citizen said "yes", would it change things? Of course not.

It was hard for me to find a good paying job because no one wanted to hire a "kid" even though I have tons of experience and education. so i joined the force and I actually love it! I'm in VA

  • @fine5oh honorable job. I was exposed to the "unwritten" quotas and code of silence. I just couldn't believe that good cops were expected to protect the bad ones. I wish I could find the video, but I recently watched one where an officer pulled over a suspected DUI and the driver turned out to be another cop. He was torn on what to do, so he called the Sgt. He came out and told the officer it was his discretion!!!! Then you could see the officer talking to another and the turmoil he was .....

  • @fine5oh going through. He said "If I arrest this cop and break the code, then I'll never get promoted again and my career will be over. If I don't arrest him and my dash cam video gets out, then I'll be fired." I was saddened that this officer had to go through this decision and the Sgt made him decide for himself. But this is what happens and it sickens me. Oh, and the officer decided to let the drunk cop go - even though he was sh*t faced.

  • @fine5oh Yes, and like I said, in order to detain someone to investigate them, you need to have at least reasonable suspicion. You should take a re-education class before spouting utter legal nonsense under a false pretense that LEOs know laws. I just won in an investigation with this very same issue and that's after they checked with their real lawyers.

  • @fine5oh Wrong! You do not have to talk to a cop, just because he wants you to. That's called the 5TH amendment. You can be detained. You do NOT have to produce ID unless you are driving and committed a violation. If UR not driving, an officer must know you are going to commit a crime, are committing or have already committed a crime. You cannot be transported without being CHARGED & ARRESTED. Miranda does NOT have to be read until questioning is about to begin.

  • @ohannahdad First of all, when did I ever say someone has to talk to a cop? NEVER. Dont put words in my mouth. You can be detained and you must present identification if asked. Yes, the officer must believe you will, have, or already committed a crime OR one can be detained for investigative purposes. You CAN be transported, for example if a show up needs to be done, without being arrested. I know what I'm talking because I am an officer. What you see on TV is not always how it really works!

  • @fine5oh And how it "really works" isn't always the legal way. Police falsely arrest and charge people all the time. Can you cite the statute that states that I must show you my ID whenever you ask for it? Because I can cite several Supreme Court case laws that state otherwise. Again, not saying you wouldn't arrest me and make my life hell for not showing it to you - you'd just be doing it unlawfully and without honor to your oath.

If I give an acceptable reason why I am there (ie) parking lot is a shortcut to my home...case closed!! Much of the time when I am out walking, I don't bring my wallet...consequently; no ID. I need ID if I'm driving and get stopped. If you transport someone who has been detained (to a show up) they are under arrest on suspicion of...

  • @fine5oh Your comment about what I see on tv challenges the validity of your being a LEO along with some of your responses. Any of these situations mentioned here can be overturned in court (just like traffic tickets) if one is willing to play the game. Get postponements, be willing to apeal to the next higher court etc. Most fines are set where they are "payable" so folks don't fight it. Did you know that if anybody in your state is exempt from wearing a seat belt; nobody has to wear them?

  • @fine5oh LEO has a right to detain for a reasonable length of time. During this time you do NOT have to produce ID nor do you have to answer any questions. There is NO definition of a "reasonable" length of time. If you stand silent for 20 min. and you feel that is long enough, you have the right to demand to have an officer in charge come to the scene.You cannot be transported while being detained. Most cops are control freaks. They don't like being challenged even when they know they're wrong!

  • It is a racial thing there is a double standard because a lot of these cops target black neighborhoods. Police have crime statstics for the city or county they police so in norfolk most of the people who commit crimes are blacks. Norfolk is prodominantly black.

  • Both of the men that were stopped were black men with white tshirts on bicycles. Clearly they were searching for someone and stopped people that fit the description of the person they were hunting. That is why they were asking for ID. Instead of trying to paint a picture of racism, why can't you just let these men do their jobs. Besides, one of the cops in your video was black. You should be happy that they are patrolling one of the worst neighborhoods in Norfolk, helping to keep you safe.

  • Man, this doesn't even scratch the surface of the problem. I'm a Norfolk resident and the police harass young white boys as well for 'riding too fast' on skateboards.

    HOWEVER when it has come to the police following up on two crimes that were committed against my property and even arresting drunk drivers WHO HAVE *JUST* CAUSED AN ACCIDENT, they're remarkably scant.

    It's a Norfolk problem, and it's ridiculous. No, it's downright dangerous to the citizens.

Incidentally, I'm not opposed to the application of capital punishment by the police. After all, a policeman has the right to self defense. When black youth stop resisting arrest, then the death penalty will be avoided. Until then, the execution of black youth on the streets by our police will save me, the taxpayer, some money.

The police in Norfolk do the best job they can trying to keep order it in order. If they're going around asking for people's id.....hmmmmm...... maybe they're looking for someone? It wouldn't be harassment if it was a black cop though. I know plenty of officers in Norfolk, black and white, that do an awesome job.

  • I drove through Norolk a few months ago. I didn't realize what a dispicable ghetto it really is. I didn't feel safe at all. I was glad to get away from there. I feared my life in the "community."

There are LOTS of nice neighboroods---million dollar neighborhoods---don't judge a place by 'riding through it', it says nothing about what's actually going on.   • As far-fetched as this may sound, the police may have initially received a complaint from a victim of a crime who, upon meeting responding police provided a description of the offender. The police - via broadcast of that complainant's description on police radio - may have stopped several persons in the "community: matching that description. Upon investigation, the persons were then released. The actual bad guy may have been arrested at another location or eluded police.

  • @yungheff100 Yeah, that happens. Lots of white people get stopped by cops in black neighborhoods. It's a common issue in Hampton Roads. Apparently they assume the white people are bringing in, buying or selling drugs. Racism works both ways here, people. It's not just white on black, but white on poor white. Lots of people don't seem to recognize how vicious whites can be towards each other. It's all wrong.

I understand you've had a run in with crooked cops but they're not all that way... but i guess there is a reason Norfolk's so bad, maybe the cops aren't doin there shit right.   • they are doing their jobs. They do the same things with other crimes, interrogate suspects. The guy on camera sounds like he is just scared of cops trying to incite hatred into our civil servants. There is more than 1 cop if there was an issue then the other cops would have said something.   • he coulda had some sorta warrent on him. but he was put in the car for detainment which is procedure. but they definitly over did the amount of officers at the scene, he wasnt doing anything violent so they didnt need back up. and that one officer was out of line taking your picture

  • @CNrite he was DETAINED, not arrested. there is a difference. They are allowed to do this if there was a violent crime in the area, and the people they detain fit a description. For instance, maybe a person committed a violent crime in the area and was described as an african american male riding a bicycle? Might explain the volume of police cars.

  • the more i watch this the more i get pissed off. yes, most cops have an ego problem and are on a power trip. i will not deny that. however - they have procedures that you and i do not know about because GUESS WHAT? we're not in the police dept. if someone commits and crime and no one sees it did it not happen? no the police have to investigate and check all people in the area. it's not police harassment. i'm glad they're out there doing something in the community.

  • you have NO idea what they boy did before riding. i work in park place and i know the kind of things that go on. officers pull people over and ask for ID to help narrow down suspects in an area. i hate to break it to you but park place is not a great neighborhood. i wouldnt even call it a mediocre neighborhood. it's not police harassment or racial profiling, it's called them doing their job and keeping a bad neighborhood from getting worse. it's that what we want? our children safe on the street

  • First off, as a retired officer I personally know that kids on bikes are used as lookouts for drug dealers in communities all over the country. The officer is within his rights to ask any person for identification( read code of V.A. .) However, the officer's rights were not violated by being video taped not because he is a public ser vent but because there is no expectation of privacy in the public arena

  • @knharrell1159 Well i find the whole "look out thing" to very far fetched. The officer didn't just ask for ID he ARRESTED the young man and put him in the back of a police car, thats the crime. He had no just cause for the arrest so that my friend IS against our constitutional rights.
