Well, you don't know the issues existing when you try to kick a party. The party is called "NPD" (Nationale Partei Deutschlands) and there were agents from federal organisations to collect information and such stuff but they acted for both sides so it could not be forbidden due to mistakes while investigating.

And the government is afraid of more failures and mistakes so a new attempt must be completely sure/safe.

Other fascist orgs can be forbidden easier by looking on their "constitutions".
