We have had "R.I.D.E" programs here (in toronto area) for years - where they checked if you were drunk driving by routinely stopping you. I didn't realize how orwellian that was until recently. I didn't know anything about this paradigm when they first started doing this.

In Pennsylvania they have defined the field sobriety test as only establishing probable cause. Of course, they use that as an excuse to abuse your 4th amendment rights in any way they can.

I was describing my experience in PA. Since then I did see a cop show on truTV where some angry meathead cop was pulling young adults off of boats and giving them DUIs and arresting them. The cop told them that if they didnt submit to the breathalyzer, they would be held down and have there blood draw by force back at the station.

If you refuse to submit to a blood test, you are just charged with the maximum possible DUI penalty. You are guilty until you prove your innocence, and you will probably never get that chance. Even if you prove you were sober, it doesnt matter, because the refusal is considered worse than an actual dui.

If you pay 4,000 to a lawyer who is buddies with the cop, you might be able to keep your license. But you will be forced to pay hundreds or thousands of dollars for classes, psychologists, call track (you have to call every month), fines, court fees, getting your car back, etc plus community service, And you will be put on probation which means you have NO RIGHTS AT ALL. This is for a first time offence.
