Most of the comments on here are from idiots who never even applied to college. I have read how the bar exam is read and graded and most of it is luck. They grade each person in under two minutes. Sad thing is you most likely deserved to pass your first time but they didnt observe your writings quick enough. Congrats

First the poor lady after the third time was probably not sleeping, eating or feeling well the days the days leading up to her subsequent tests. And on test day having an anxiety attack. Second standardizing testing is no means the best way to establish a persons intelligence when it comes to the real world. So to call her dumb is unfair. Second the fact that this woman had the courage not to quit on her dreams is amazing.

  • Maybe you shouldn't be in a career that you can't test into for almost a decade. I know great attorneys who didn't pass the first time.. but not 13 times. I mean true, no one asks, "How many times did you take the bar?" No one asks you how many times you took a driver's license test either, but you can usually tell they didn't do well when they broadside a tree for the fourth time, no? I wouldn't trust her preparation or concentration skills. Maybe that's just me.

  • @MIvarsson99 - No, she's probably just a person who thinks in the real world and had difficulty adjusting to the made-up world of bar exam. Usually the longer one is out of law school, and away from the theory, the harder it is to pass. The bar exam is not how law is really practiced.

  • I challenge those who criticize to put their money where their mouth is, so to speak, and take the CA Bar. THEN talk about it. But seriously, if you need a lawyer, are you really going to ask how many times it took for that attorney to pas the Bar? of course not.   • Congratulations!. I'm studying for it right now. Pretty awful experience. I am a little angry that law schools don't do more to prepare its students for the bar exam. It should be part of the curriculum, especially since law school is such a big investment. It just doesn't make sense that we have to take another expensive course to prepare.

  • @jetulik Perhaps someone who appreciates tenacity, which might likely translate to the kind of zealous representation that the code of professional responsibility asks for? At the end of the day, passing the California Bar Exam says the successful bar candidate knew enough of the law that was tested on those three days, had some measure of luck and had good test-taking skills. She may not be a great test-taker, but that doesn't necessarily preclude her from being a competent lawyer. Just MHO.

  • @jetulik This exam is hardly indicative of someone's actual lawyering skills. Plenty of terrible attorneys pass it, and plenty of great ones fail it. Some people have bad luck, and some people just struggle with this particular kind of brutal exam. But taking multiple attempts to pass the exam should not be taken to mean that the person is not fit to practice law.

There is no proof that those who pass the bar exam are more competent to practice law. The evidence is actually to the contrary. The state disciplinary agencies report over 100,000 ethics violations every year. These are licensed attorneys who violated federal and state law. And malpractice is higher now more than ever.

  • @jetulik Umm... the bar exam is a money making scam for the testing industry. It also allows law firms to charge egregious legal fees because the bar exam eliminates competition. It has nothing to do with competence. The bar exam does not test actually clinical skills, It test rote memorization. It actually makes attorneys less prepared for practice, Law schools teach the subjects that will be tested on the bar exam and neglect skill oriented courses.

  • @jetulik Are you aware that former Chief Justice of the U.S. Supreme Court, Charles Evan Hughes failed the bar exam 7 times before finally passing? If the Chief Justice on the highest court in the country can fail the bar exam, why are you holding this woman to a higher standard? Furthermore, most attorneys wouldn't be able to pass the bar exam without studying the material again. They are only competent to practice law during the examination. Afterwards, they forget the material.

  • People reading this should know that the California Bar exam is the most difficult bar exam in the country. It is a 3 day exam, 8 hours each day.

    In 2009, 60 percent of California Bar Exam takers failed, only 40 percent passed, and a majority of those 40 percent passers were multiple attempts.

    So people thinking this is some easy test, you really have no clue.

  • I'll admit it, I passed the Virginia bar on the second try. The first time, my nerves really got to me. The second time, it was a breeze, no nerves or anything at all. She's a stronger person than me, there is NO WAY I would take a bar exam 14 times. That's unbelievable. But, I'm happy for her.

    i prepared continuously for 5 years.

    But I learned confidence, patience, and persistence from my struggle.

    result I passed EIT and CMfgT exam in my 1st attempt.

Of course the decision to pursue law seems to have destroyed her life, so it is commendable that she passed.     You know, maybe you are right. Life really is TOO SHORT to be pushing a boulder up a hill 13 times to pass the CA bar. I know I could never have mentally survived 12 consecutive defeats. I passed on the first try, and several years later got licensed in another state via reciprocity. Thank God, no retakes for me!

  • I graduated from law school in 1998. I took the bar then, but got my failing MBE results after I'd gotten my job in the corporate sector. I eagerly followed bad advice to not retake the bar until I passed. I didn't take it for the second time in February 2009 and passed the essay again. I didn't pass the MBE when I took it again July '09. I take the MBE for the fourth time in 23 days (02/10). In the face of not passing, sustaining belief in myself is difficult. Thanks for posting this.

  • Actually, the more prestigious the school, the more they tend to not care about attendance. I attended a tier 1 school and never went to class and they didn't care. Why? Cuz they knew I'd probably pass on the first time anyway, which I did.

  • This woman's persistence is admirable, but would you choose to entrust your rights (and financial interests) with a lawyer who flunked the bar 13 times? I would not. The bar exam is not real life, but there are plenty of times in practice when one has to be able to work quickly and under pressure. Failing the exam 13 times portends poorly for future performance in crunch time.

  • Bar exam performance is irrelevant to choosing an attorney. If she does a good job practicing law, you choose her, if she doesn't you don't. Your choice is based on an assumed prediction. Let me ask you this question, who would you choose to represent you, a bad lawyer who passed the bar the first time, or an excellent lawyer who failed it 13 times?

  • Wow. I'm always disappointed by the really hateful comments that people leave on these sites.

    People don't generally fail the bar because they don't know the law. Everyone taking it graduated from law school and some of those who fail are actually attorneys from out of state.

    The main reason why people fail is because they have a hard time writing the exam i.e. condensing a voluminous amount of rules on any of 14 subjects, clearly and concisely in the short amount of time that's allotted.

  • I think the test is designed so that if you can pass it then you are qualified to be a lawyer, meaning that despite how many times you try, you'll just learn more and more until you're qualified enough. I see the 7 years as a learning period for her more than anything. I think taking seven years shows that she's a lawyer that will work very hard for you and not give up.

    California has the hardest bar exam. If you graduate from law school, taking a SUBJECTIVE test under harsh time constraints does not make a good practicing lawyer.

    It is an exclusionary bar. It would be better to allow graduates to practice immediately after graduating; let the free market determine who is good and who sucks.

    There a lot of shitty smart attorneys out there. Maybe you will find one. Flies are drawn to shit.

  • Just failed twice. Great video, pretty inspiring. I believe the correlation between passing the bar and being a competent lawyer certainly exists; you must have (or once had during the bar studies) the de minimis legal knowledge necessary to at least be able to recalled later on when needed. But I'd like to think passing the bar is only one of the lesser vital ingredients for a career of satisfying/successful law practice.

  • Oh the nerves of the Bar Exam. I heard they're releasing more tests soon. I remember being glued to my PMBR book...god. Also, profbamberger's videos are pretty good, he has simulated multistate questions..they're difficult but he says they're very similar to those on the Bar.
