You were kind of in the wrong. The officer was right, you were veering closer the barrier. However once he decided to stop you so he could do a check, he shouldn't of let you through, I found that more disturbing. The fact that he thought you were suspicious(rightly or wrongly so, but he thought you were suspicious) and let you through without checking you. If he is going to do that, no point him being there

Took a lot of guts to do that. You need a live video and audeo feed going to to a recording site somewhere else so that if they did anything agreesive the evidence would be elsewhere and not only on your person or vehicle. They would just eliminate the recording in the camera as they always do when they take it to the next level. I am not sure the teflon coated cover over the place would allow an electric signal to get out though. This same, so called, solar cover is used at the Denver Airport !
I can appreciate the purpose of these videos and am loving them so far, but I've got to admit that I was worried you were going to accidentally hit that agent when you drove in. How exactly were you manipulating the camera while driving? The agent kind of had a point about the camera being a hazard although he probably should have expressed it differently. I hope that if you're still doing this you have come up with a safer way to handle the camera, but keep up the great work.

If you were crossing the border illegally, would you take a road? Specifically, would you take a road that you know has a high probability of having immigration checkpoints? I assume (maybe incorrectly, granted) the answer is no. But would you probably end up on a road that heads to a larger metropolitan area? Or a road that crosses state borders? Probably.
That's why there's a Border Patrol CTVadim. The agency's job is to patrol the border in between official ports of entry. If they were doing their job properly, there would be no need to harass domestic traffic inside the country absent suspicion.

For instance, it sounds like you're unaware of the fact that Border Patrol agents are part of Customs & Border Protection which is a federal agency under the Department of Homeland Security. This means Border Patrol agents are Homeland Security agents as well and any operation conducted by Border Patrol agents can reasonably be referred to as Homeland Security operations.

The Courts are ruling that the operation of a Cell Phone inhibits you in the safe operation of your vehicle. Either give the camera to someone else or mount it.

I went through one of those checkpoints last week near Calexico. They asked what my citizenship was and where I was coming from. 1 min later and I was out of there. I thought they were going to tell me to pull over to secondary, because I had 4 wheels and tires in the back seat and trunk. Not to mention a pistol in a lock box, in the trunk. lol I was shitting bricks.

You failed to address the larger issue however. In order to "ask" people their citizenship, is it also reasonable to stop, seize, interrogate and search them absent suspicion just because they happen to be within 100 air miles of the border?
The "armed agents of the government" are Police Officers, lets not take this out of proportion. And it is not like we are out hunting to stop just you, we stop a certain number of cars, for every certain amount we let through, it is completely random, unless you are cleary drunk, have done a driver switch, or your plate comes back stolen.

I just saw the video of the Baptist pastor who was beaten and tazed. Apparently within 100 miles of the border is a "Constitution free zone" where they can detain and search you with no cause.
We are not compelling you to answer out question, we ask you a question, and if you refuse, we have every right to remove you from your vehicle, and ensure that you have not been drinking. In 3rd world dictatorships, there are checkpoints everyday, everywhere, ours is once a month at max in two places. Our DUI checkpoints, usually result in a minimum of 12 arrests for about 4 hours work, and many times much higher. We also get several arrests for warrants, get stolen vehicles, etc.

As an armed government agent, you have no right to remove anyone from their vehicle merely because they don't answer your questions. This isn't Iraq & SCOTUS has made this amply clear in multiple rulings.
Take for instance Kolender v Lawson, a case involving reasonable suspicion:
"...and, most importantly, the suspect must be free to leave after a short time and to decline to answer the questions put to him."
You are free to leave after a "short" period of time, but we decide how short that time is, we can give you the DUI Tests, and then we can decide that you need a blood test or a breath test at the station, and it can take all night to get you through
Actually, a court of law ultimately decides what constitutes a 'short time'. A court of law also decides whether or not you had the necessary probable cause to 'deliver' a blood test, breath test or any other DUI test.
Given your responses here however, it's clear you routinely engage in illegal enforcement activity under color of law by purposefully violating people's rights. I appreciate you being so open regarding your disregard for the rights of others. It makes my job that much easier.

The 4th amendment stops us from stopping you without cause, that is why we are not allowed to stop every car, we stop a certain number and allow a certain number to pass, so there goes your 4th amendment, and as for the 5th amendment says you do not have to testify if it will incriminate you, but we are not asking you to testify, we ask 2 simple questions, and one of them is have you had anything to drink, this doesn't incriminate you, because you can have one drink and still be alright to drive
While the courts have upheld brief seizures at sobriety checkpoints for the sole purpose of checking for impaired drivers, you have no legal authority to compel an answer to questions.. The legal basis for this is the 5th amendment.
Further, 4th amendment protections at checkpoints are based upon their narrow scope. When you attempt to compel someone to answer questions under threat of arrest, you've exceeded that scope, opened yourself up to legal action & removed your qualified immunity.
Actually, this is incorrect.. This opens the person that answered this question 'yes, only 1' to having their vehicle searched due to probable cause due to their admittance that they had in fact been drinking & driving.
@USSpecOps93 Of course it's a big deal being stopped, seized detained & investigated by armed agents of the government absent any reason to believe you've done anything wrong.
Suspicionless checkpoints are the hallmark of 3rd world dictatorships not first world constitutional republics.

You were kind of in the wrong. The officer was right, you were veering closer the barrier. However once he decided to stop you so he could do a check, he shouldn't of let you through, I found that more disturbing. The fact that he thought you were suspicious(rightly or wrongly so, but he thought you were suspicious) and let you through without checking you. If he is going to do that, no point him being there

Took a lot of guts to do that. You need a live video and audeo feed going to to a recording site somewhere else so that if they did anything agreesive the evidence would be elsewhere and not only on your person or vehicle. They would just eliminate the recording in the camera as they always do when they take it to the next level. I am not sure the teflon coated cover over the place would allow an electric signal to get out though. This same, so called, solar cover is used at the Denver Airport !

I can appreciate the purpose of these videos and am loving them so far, but I've got to admit that I was worried you were going to accidentally hit that agent when you drove in. How exactly were you manipulating the camera while driving? The agent kind of had a point about the camera being a hazard although he probably should have expressed it differently. I hope that if you're still doing this you have come up with a safer way to handle the camera, but keep up the great work.

It's neither a permanent checkpoint, nor has it been setup along a highway leading to or from the border. Even it is was however, agents need consent or probable cause to extend the detention past the initial brief questioning or to search.
You'll find that in U.S. v. Martinez-Fuerte as well.

That's why there's a Border Patrol CTVadim. The agency's job is to patrol the border in between official ports of entry. If they were doing their job properly, there would be no need to harass domestic traffic inside the country absent suspicion.

@CheckpointUSA It's reasonable to assume that drug runners/people traffickers expect checkpoints at highways leading to/from the border, and would avoid them appropriately. So to set up a checkpoint along a roadway that indirectly leads to/from the border -- especially one with lots of connecting roads that lead to the border -- would be an appropriate method of interdiction.

For instance, it sounds like you're unaware of the fact that Border Patrol agents are part of Customs & Border Protection which is a federal agency under the Department of Homeland Security. This means Border Patrol agents are Homeland Security agents as well and any operation conducted by Border Patrol agents can reasonably be referred to as Homeland Security operations.

If a cop pulls you over and ask you for your ID guess what?....you have to show it. If a federal agent ask you about your immigration status guess what?...you have to show proof of it. Well at least you were right about one thing specopspr. I was indeed being detained since every vehicle entering a checkpoint is being temporarily seized & the occupants detained. You're wrong about federal agents having the power to indefinitely detain until citizenship is established however.
In fact, the Supreme Court has ruled that at these types of checkpoints, agents must wave vehicles through after a brief seizure in the absence of consent or probable cause.

With regards to you're statement that all I had to say was yes to the question from the federal agents while being seized, you'll note from all my videos that in reality, I didn't have to say anything at all. That is of course one of the primary points of my videos.

It sounds like you're unfamiliar with U.S. Supreme Court decisions i U.S. v Martinez-Fuerte and Brignoni-Ponce Sdfrien. Here's a few quotes to help you out:

Don't take this the wrong way but Agent Roman was about to kick you loose several times when he was asking your citizenship.
The Courts are ruling that the operation of a Cell Phone inhibits you in the safe operation of your vehicle. Either give the camera to someone else or mount it.
Be sure to give them plenty of room to maneuver. Its dangerous for them to be out there. You see videos of cops and targets getting slammed by drunks. Don't be a contributing factor to one of those. Good Luck

I went through one of those checkpoints last week near Calexico. They asked what my citizenship was and where I was coming from. 1 min later and I was out of there. I thought they were going to tell me to pull over to secondary, because I had 4 wheels and tires in the back seat and trunk. Not to mention a pistol in a lock box, in the trunk. lol I was shitting bricks.

it is a citizens duty to resist people who usurp authority under the pretense of security. If you do not stand up for your rights, they will be taken from you. I am from Canada and have been stopped numerous times to "see who you are" THEY DO NOT HAVE THAT RIGHT. My response is always the same. "Why are you asking for my ID" if the answer is anything other than a specific accusation of wrongdoing, my next response is "I'm sorry sir, you are beyond your scope of authority." KEEP IT UP.

Seems to me that you just need something to rant about, so why not DHS or BP. If you have an issue with their policies, take it to the people that make them. He was doing his job as dictated by DHS. The "armed agents of the government" are Police Officers, lets not take this out of proportion. And it is not like we are out hunting to stop just you, we stop a certain number of cars, for every certain amount we let through, it is completely random, unless you are cleary drunk, have done a driver switch, or your plate comes back stolen.

We are not compelling you to answer out question, we ask you a question, and if you refuse, we have every right to remove you from your vehicle, and ensure that you have not been drinking. In 3rd world dictatorships, there are checkpoints everyday, everywhere, ours is once a month at max in two places. Our DUI checkpoints, usually result in a minimum of 12 arrests for about 4 hours work, and many times much higher. We also get several arrests for warrants, get stolen vehicles, etc.

As an armed government agent, you have no right to remove anyone from their vehicle merely because they don't answer your questions. This isn't Iraq & SCOTUS has made this amply clear in multiple rulings.
Take for instance Kolender v Lawson, a case involving reasonable suspicion:
"...and, most importantly, the suspect must be free to leave after a short time and to decline to answer the questions put to him."

Actually, a court of law ultimately decides what constitutes a 'short time'. A court of law also decides whether or not you had the necessary probable cause to 'deliver' a blood test, breath test or any other DUI test.
Given your responses here however, it's clear you routinely engage in illegal enforcement activity under color of law by purposefully violating people's rights. I appreciate you being so open regarding your disregard for the rights of others. It makes my job that much easier.

And what is the difference between a Immigration checkpoint there, a DUI checkpoint in BH, or a suspect search Checkpoint in Los Angeles? They are all forms of checkpoints trying to find something or someone

The 4th amendment stops us from stopping you without cause, that is why we are not allowed to stop every car, we stop a certain number and allow a certain number to pass, so there goes your 4th amendment, and as for the 5th amendment says you do not have to testify if it will incriminate you, but we are not asking you to testify, we ask 2 simple questions, and one of them is have you had anything to drink, this doesn't incriminate you, because you can have one drink and still be alright to drive

While the courts have upheld brief seizures at sobriety checkpoints for the sole purpose of checking for impaired drivers, you have no legal authority to compel an answer to questions.. The legal basis for this is the 5th amendment.
Further, 4th amendment protections at checkpoints are based upon their narrow scope. When you attempt to compel someone to answer questions under threat of arrest, you've exceeded that scope, opened yourself up to legal action & removed your qualified immunity.
