  • As well, I don't like how the FOX video is edited right after shep asserts that judge napolitano is for reduced regulation. Judge did not say this, but instead that regulations shouldn't be made by people that are incompetent. He most likely supports increased information supply to the regulators, but since the video was cut we'll never know how the editors have manipulated the coverage.

    Even if regulations were eliminated, it would have eliminated the 75m cap, incentivizing spill reductions.

  • Isn't it the responsibility of the government to provide regulation for moral hazard situations? The purpose of any firm is to maximize profits, nothing more, and nothing less. Why didn't the government do anything to prevent BP from committing more illegal actions? Obviously the small slaps on the wrist (fines) weren't enough to deter BP, they were simply operating in a manner that resulted in the highest profit. I hate what happened to the gulf, but sincerely believe that it's the gov's fault

I'm not aware of any of the details of the Pipa Alpha spill (though unless you misspelled, that name doesn't sound very American), but regardless, BP has to pay for it's mistakes. BP is not a part of the British Government, and is not responsible for enforcing punishment of American companies on behalf of the British people. And if you're gonna talk about what's right, then the right thing is for BP to compensate any people it harmed.

The point the Judge was trying to make was about how in the 90's the government started a program which gave businesses incentive to take risks by digging wells much deeper then the company would ever think of doing. Since in a true free market they are liable for their decisions, they would have never drilled that deep. But if the government will pay you TONS of money to dig extra deep.... Why not? Then lobby for legislation that limits liability if anything goes wrong.

  • First off, the oil spill was caused by BP's LACK of precautions so less government = more likely for further spills. Did our government fail? YES. But not how fox news would like you to believe.     Nobody is opposed to Oil companies drilling at 500 feet. People ARE opposed to oil companies drilling close to shore. These people include but are not limited to environmentalists. By forcing them to drill further from shore, they are also forcing them to drill in deeper water, because further from shore equals deeper water. And the Gulf of Mexico is very deep.

  • It is a government purpose is to regulate safety by "taking over" some freedoms of companies to make sure that accidents don't happen too often and that the employees have decent rights. And no I don't have problem with that nor should anyone else, even if you are a tea party or a libertarian. Without the government, there is no laws. BP has no insurance co. Why? b/c the fed. govt. said your maximum liability is 75 million. Show us a bank account with 75 million and you don't need any insurance." Way to get owned journalist.

  • @aaronsande 1st of all, I'm not a Republican, I'm a Libertarian. There is a big difference between the two parties. 2nd, the reason mr. Turk cut out that point is b/c he knows full well that if his liberal audience were to view it in its entirety, ponder it, and make sense of it, it would probably lower his viewing base. The federal government is incompetent to get anything right. In the end, Turk left out the point regarding insurance companies being more competent than the federal govt. :-)

  • @johnedwards1968 My view of government is that it governs best when it governs least. Napolitano--if you listen closely--is not defending BP because he said that BP should pay every penny for the damages. The point he was trying to make in regards to 500 feet was the point of state's rights as defined in the 10th ammendment of our constitution. Louisiana said they could drill @500 ft. But then along comes the fed govt. to regulate everything just like they always do. See how this is wrong?

  • the government had nothing to do with it. A spill is not easier to control in 500 feet than it is in 5000 feet. Human divers cannot go deeper than 300 feet . The reason the well continued to leak after the rupture is because BP didn't install the safety shut off valves, didn't properly cement the wellhead, didn't follow maintenence protocols, etc. Human greed and negligence by a greedy negligent corporate entity.
