My 2 cents: The car driver was looking at the cop car which had stopped and was obviously doing something. The biker pulled in infront of him which normally (without a rubbernecking driver) would still have caused a car to brake (which is bad). But due to his rubbernecking the driver saw the dumb biker until it was too late.
the biker was not merging from the left hand lane because that is the hard shoulder and you can't drive in it. all the car drivers fault. The biker slowed down for the car merging back onto the motorway, car driver should have been paying more attention

The rider had seen some debris on the opposite carriageway, then by chance saw a traffic car parked in the layby, deciding to do the right thing he tried to pull into that layby to tell the officers, failing to do a left lifesaver he decellerated too fast to get in in time and left the car driver with no where to go. Thankfully he had invested in a good set of leathers, he sustained no broken bones, but has since given up riding

The car that hit him was moving faster and veered into the RH lane in an effort to avoid colliding with the bike which had appeared right in front of him. If the biker was crossing lanes then its the bikers responsiblity to take all precautions to make sure the lane he is switching too is clear. If, in this instance, was the case, then the fault is clearly the bikers. It did not look like the van was speeding.

No, if you watch closely you can see that the biker was correctly in the lane. The van driver probably looked left to what the cops were doing and thereby did not pay attention that he was faster than the biker in front of him.
The biker pulled in fornt of the car in a quite sudden maneuver actually. I also bet that before that he wasn't driving paralel with the van but came hard from the back overtaking the van and then tried to change lanes. look at 00:07 and you can clearly see the biker at the right of the image, and then pulling to the left. It was his responsability to assure that he can do that safely. i have nothing against bikers but i still thinck that it was the biker's fault.
This was probably the car driver's fault. You can see the car getting closer to the bike. I doubt that a biker would perform an illegal maneuver whilst the police are sitting on the hard shoulder. They would probably have their lights flashing if they're just pulled that driver.
My guess would be the car driver had his eye on what the police was doing instead of the road.
