You don't have to break a law for an officer to put you in handcuffs. Officers can legally put you in handcuffs for just being mouthy and then take them off when you become more compliant. Interesting... So if he went on another show that would damage Fox in what way exactly? It would promote his own tv show and draw more viewers to Fox. Another Fox host, Bill O'Reilly, is a media whore. He regularly appears on other networks' shows - Letterman, Leno, John Stewart, ect. It's odd that Fox allows its number one host to freely appear on other networks but not a mid-level host like Napolitano. Perhaps Napolitano's contract is different because of his role for Fox as an analyst? Or perhaps, Napolitano, a former judge, is so crappy at his own profession that he signs ridiculous contracts that curtail his freedoms.

You don't have to break a law for an officer to put you in handcuffs. Officers can legally put you in handcuffs for just being mouthy and then take them off when you become more compliant. It doesn't necessarily mean you're going to be arrested. If you resist (brace, tense, push, pull, step away, run away, fight, etc) while an officer is trying to put handcuffs on you... you are guilty of "resisting arrest" even though you weren't necessarily under arrest at the time.

According to the law: Intent is almost always the only thing that matters. If I damage a stranger's property on accident it is a civil issue. If I damage a stranger's property on purpose it is criminal mischief (a crime).
"Choking" isn't choking (legally) until there is incapacitation. In the video you can see he only does it to establish physical control over the criminal resisting arrest - and not to deprive oxygen causing incapacitation.
