  • On the hate crime topic, taking it one step further. The law has set up special classes of citizens, kill a cop special sentence, kill a postman special sentence, juvenile victim special sentence, elderly victim special sentence. Does the weakness, strength, employer or anything else make one person or class of persons worthy of greater protection under the law? I won't take a position other than to say that I recall no public debate on the topic prior to passing these special laws.

But after reading Jim Marrs' Book, The Rise of the Fourth Reich, I am convinced that there really are nazis around and they are more powerful now than ever. To get really into the nuts and bolts of it, Google between the lines by Dave Emory. He's been covering this issue for years and has podcasts available for the illiterate masses. Listen and learn! It will soon make sense.

There is a difference between 'hate' crimes which in it's essence is targeting a particular GROUP of people - ie. gays, blacks, hispanics, PALESTINIANS, Jews, rather than a single individual. Therefore, your robbery-analogy is mistaken. Or would you NOT agree, that the incitement of hate + violence against blacks in the 60's was directed toward a particular GROUP of people, rather than against individuals? There is a huge difference, actually>

If someone robs a liquor store + kills the clerk in the process, he/she may not actually HATE that clerk at all, they just want the money. So yes, there is a difference.   • Palestinians are the subject of violence like other groups. Look at it this way and tell me what you think. If a group of thugs was out trolling for people they hated in order to do violence to them and they attack a group of (insert name here) but in that group there are a couple of people who are not of the group they hate, just happen to be with them. All end up dead, killed by the thugs. Are the victims who were not of the targeted group any less dead? How do you justify a harsher...

  • sentence for the one just because they are of a particular group? Of course people are targeted, like the 60's and blacks. One could also make the case that when people steal they target a group of people "those with money", and they incite action against them. It's an extreme jump but it is a valid point. Any time you cross the line from thought to action you're subject to penalty if you commit a crime, same crime, same punishment. IMO.

  • Ella you always have great insight but I think we will have to disagree on this issue. Even if groups are targeted because of "hate" as long as no crimes are committed against them they are guilty of nothing. The guy killing the clerk in the store is just as guilty as someone who kills a gay or black because he hates them. Motive can be mitigating in my view but not a method of worsening a crime. You start at a certain level, the crime and the damage, it can be mitigated but not made worse.

  • If you have "enhanced sentencing" for hate crimes ( in essence you're being punished for what you think), then it says that some people are inherently more important than others. In some instances the crime is called a "hate" crime based upon circumstantial evidence and not on the real motive. Crimes are committed for all manner of reasons. Why not have enhanced sentencing for all manner of motives?  Love, disdain, lack of empathy, psychopathy.

  • Great video!! Good points! Ever watch Frank Zappa's Free Speech debate on Crossfire? It's on YouTube. That was on the profanity/freedon of speech issue in the 80s (Christian parents VS the music industry.) I thought Zappa was brilliant in that interview. He maintained that freedom of speech must be maintained, and unfortionately that must include hateful, disgusting and propaganistic statements--which of course can be debunked through freedom of speech. If you remove any of them, we lost it all.

  • Like Norman Finkelstein wrote in his book The Holocaust Industry its a racket to make money off the dead. He really gets my admiration because he exposes the horrors done to the Palestinians. How come the American news did not have it on the front pages all the bombings Israel did even using phosphorus bombs on the civilians of Gaza killing over 3,000 in 22 days a few months back. Israelis still keep them in a concentration camp, go visit Gaza and see how life is for them, thanks to Israel.

  • Indeed maybe just a nutcase.  It isn't the end of the world. Maybe the solution is to have guards that are trained? Metal detectors that work? I've been to that museum and let me tell you there are metal detectors and guards and it is very secure, it just seems very suspicious that he could get in there with any gun let alone a rifle.

So explain to me how it is "worse" or deserving of more punishment, if someone is killed for the money they carry (killer wants money, covets it off of dead guy, obviously dislikes fact dead guy has money and he doesn't, cares nothing for his life) or if they are killed because they are gay or black or Jewish? What does it matter, they're both dead and the action involves hate. Are gays, blacks, hispanics, or Jews "worth" more than a dead white person?

  • well hate crimes can be against white ppl as well, such as black panthers targeting a white person. If the criminal attacks a jew because he's rich, then it's not a hate crime. If he attacks him because he's jew then it is a hate crime. I agree with what you're saying but the difference is the jew can choose to be rich or not, though he can't choose whether he's jew or not. That's possibly why hate crimes are treated differently?

  • The end result is the same, someone hurt or dead. I don't recall any cases where someone was prosecuted for a hate crime against white people. If they have I'd love to know about it. One could easily argue that the wiring of your mind makes it so you have no choice but to hate the people you do, so that you have no control over that as well. Bear in mind I don't condone violence of any kind against anyone unless it is rightly deserved.

  • Sure end result is the same, but you can say that about anything. for example, a person dies, but there are two scenarios, either you killed him because you wanted to rob him, or you killed him because he was trying to rob you (at gun point). Of course end result is he's dead, but the reasons for why he is dead is very important. About the wiring of your brain, I guess that's why they treat mentally ill people differently in terms of punishments.

  • I'd say there are mitigating circumstances that could be considered to lessen ones sentence if you were truly mentally ill etc. But if you purposely murder someone, regardless of reason, that person is dead, you killed him, why should you be punished more if he was gay and you hated gays. It is like saying that gay people are more valuable than straight people.

  • This is a tough one to figure out. I guess a hate crime is determined solely on one's membership to a certain group: racial, gender, religious, etc. and is instigated solely on that on some kind of arbitrary superficial level so that you could replace that person with any other person within that same group and that would have triggered the crime, and solely because they weren't in this group the crime could have been avoided.

  • But if you were to arbitrarily kill a human, because they were human, because you're a serial killer or something, I guess that should also be a hate crime. It's very vague.

  • Here's an interesting thought though. We say that thought crime should not be punished, but what about damage to information, or infringements of information, such as copyright etc. Damaging/altering someone's hard drive, wouldn't you say, is comparable to yelling things in their ear and changing their state of mind, memory, experiences etc.

    So if you disseminate information, malicious information, aren't you negatively affecting the collective consciousness of society? Or you frighten someone

  • Well there are laws against Libel and Slander. There are also property crimes which protect information as well.

    Also if you talk about killing a group of people, isn't that conspiring to commit a crime? I'm a little rusty on my laws, but isn't that prosecutable? Such as if you were to say you were going to assassinate the prez, even if you haven't done anything, I'm sure something can be done to you.

  • We had a recent case where a guy was found not guilty of a hate crime. He had said, and I'll paraphrase, "Hitler killed all those jews because they were killing the economy of Europe. Their greed and their hording was hurting everyone so he rounded them up and killed them. The problem was he didn't kill them all so the world is having the same problems again." He did however lose his "Order of Canada" medal. He said those things on a radio talk show. He was Native Canadian if anyone cares.

  • You missed my point. The action done by this man (allegedly) will be used to make it illegal to think or say what you want. It will be used to encroach on freedom of speech and lead to censorship and thought crime. It isn't the case yet, but it may become so.

  • Hate crime is another way to curb the 1st amendment. Hate crimes will turn out to be thought crimes in the future. If you write the wrong things on the internet, they will have the authority to label it as a hate crime and shut it down. If you say the wrong things, they will arrest and fine you with a hate crime. I know where all of this leads.
