@yasminamay13 I believe it is a common Golden Orb-weaving spider. Non-toxic and non-aggressive. They are usually found in garden type areas in the summer. Common in California. Also known for having big beautiful webs ;)
thx for letting me know... i have already moved it to another tree... as safely as i possible can without hurting it... i used 2 cups to catch it... and released it on a near by tree in the neighborhood... hopefully it'll have a better lunch fest there... because with me coming home and running into its web just scares the beegees out of me... loLz...
@TzV357 It's definitely the orb weaver type, all orbweavers spin webs like that. You'd be well within your rights to say you have an "orbweaver". This looks like the Furrow orb weaver to me.
@TzV357 I'm not an expert or anything but I'm pretty sure it's a western spotted orbweaver. (Neoscana Oaxacensis). I don't think it's a furrow orb weaver. They don't have the groove on their head like this one.

@1kingconan They start by joing three strands into a "Y" shape, normally. The rest is added on to that simple base.
