Having seen not just this clip but many similar on tazers and pepperspray I think there's really only one verdict here: police has gotten a new, mostly non-lethal instrument of torture and they often have no compunction against using it on completely defenseless citizens. Police people may be angry, but it's not up to them to tazer, spray or beat defenseless, already subdued citizens. Measuring out punishment is something only the courts are mandated to do in civilized society.

There are many public servants, police included, that are truly trying to help people, but then stuff like this happens and destroys the bonds of respect and trust, which means they are more likely to have to use force, which means less trust, etc. We had a local police sergeant come into my practical law course, and one of the things he mentioned was this decline in respect over the course of his service, and more drastically since his childhood.

Right to protest is limited. I was in a student march in Dublin when a group broke into government buildings and had to be removed by force. Not exactly police brutality if you are breaking into a building and get 3 warnings to leave. Try it in the middle of a university... that's different.

The use of pepper spray here is completely justifiable. The protestor's were breaking the law, the police came to stop them. Verbal persuasion was inneffective, what do you expect police to do in that situation?
@Rovinpiper A peaceful protest is protected by the constitution. I expect that the police would go about getting a warrant to get these protesters removed. You know, due process. Once a court finds enough evidence to issue a warrant then the police simply handcuff each student peacefully, and there would be no need for pepper spray. This is police brutality. End of subject.

He gives you the facts, both sides of the story and asks what you think, he doesn't push any false information to you and generally has documentation of some form to back up his claims. A friend told me of a video that actually shows that the police had told the protesters for 5 minutes that they will be pepper sprayed if they don't move. The people sitting were apparently protesters that refused to move until some of the arrested protesters were released (which the police couldn't do) so the police warned them about the pepper spray and told them they were breaking the law which justified them (it is illegal and it does justify). If all that is true then the police were right.

@Ianniello In California, force used can not be in excess of force exerted against them. So, even though these protestors were breaking the law, by California mandate, it was illegal to use pepper spray against them because it was beyond the force required to enforce the law. The police could have simply grabbed them and moved them elsewhere, instead, they used a violent counter against nonviolent people.

@ftdRaw So if the police comes to your house and yells "police open the door" and you, protected under the fourth amendment asks for a warrant, but instead of a warrant the police calmly warns you that if you don't open the door they will break it down and take you under arrest, do you think that makes it legal because they warned you. Read the laws on the use of on non-lethal force and then talk. What is in question here is not whether they were warned, it is "what's it legal?"
I'm outside the Fox news bubble, after seeing several unedited versions of the last hour up to the event ~ I'd say the students deserved to get sprayed.... but not that much, nor from that close. They were blocking police from leaving with arrested detainees. They were also individually told they would be sprayed if they stayed there, I'd actually argue this is one of the few times I've seen a Fox clip that actually mentions "investigating" anything, rather than spewing their view.

So, parroting a completely fabricated figure about how much the government spends per day when the President is abroad requires no investigation, but video of students sitting with their arms locked on a college campus requires more investigation to confirm they didn't warrant being pepper sprayed multiple times. @robertattwater87 I respect the police, but the proper action would have been to remove students by hand (calling for back-up if needed) or step over the students and leave. In fact, the police could have left there looking like the good guys had they not resorted to violent methods. By violent, I don't mean lethal, but certainly physically damaging and excruciatingly painful methods.

No one would have been okay if the cop had pulled his gun and shot them, because no one is okay with the idea of a firearm as a "compliance tool." Just because you pay tuition and fees does not grant you any legal "ownership" of land anymore than your boss paying you for work grants them partial ownership of your car, or anything else you purchase and upkeep.
From what we see in the video, it is obvious that the students were peaceful. They are sitting. It would be different if they were standing and yelling or something. But they were sitting.

And in other footage you can see that the police tried to get them up peacefully, then tried to pick them up and take them away, and then they sprayed them in the face. @RTDice11 That still does not give the police the right to use pepper spray, I understand your point on the matter but there are limits set upon the police on the use of non-lethal devices, and these limits are centered solely on the defense of the police officer's safety and/or that of the general public, nowhere does it say "you shall use pepper spray to get people to move" had the students been violent in their protests then the pepper spray would be justified.
It all depends on where they were sitting and whether they had right to be there. And I doubt you have the right to camp on the UC Davis campus. Pepper spray was probably the first and best use of force option in this case.

I find it sickening that we now live in a country when unlimited money donations are considered legitimate political speech and political protests are considered punishable with police brutality.
Funnily enough the ACLU supports that distinction. The weird thing is though, that it's already illegal to purchase certain things said to harm society (certain munitions, various mind altering substances), but vastly more harmful purchases are endorsed (namely, political control - 93% of all Congress members in 2010 elections had higher expenditure on campaigns than their opponents). Is a purchase dialogue and tax curtailing speech? Is a fotune a legal document?
Having seen not just this clip but many similar on tazers and pepperspray I think there's really only one verdict here: police has gotten a new, mostly non-lethal instrument of torture and they often have no compunction against using it on completely defenseless citizens. Police people may be angry, but it's not up to them to tazer, spray or beat defenseless, already subdued citizens. Measuring out punishment is something only the courts are mandated to do in civilized society.

And since most Fox News viewers are braindead zombies who already have the most negative thoughts about these protests they will only get encouraged to hate the protests more. The use of pepper spray here is completely justifiable. The protestor's were breaking the law, the police came to stop them. Verbal persuasion was inneffective, what do you expect police to do in that situation?

@Rovinpiper A peaceful protest is protected by the constitution. I expect that the police would go about getting a warrant to get these protesters removed. You know, due process. Once a court finds enough evidence to issue a warrant then the police simply handcuff each student peacefully, and there would be no need for pepper spray. This is police brutality. End of subject.

@Robidogs There is a difference between searching for truth and putting your own spins or biases into videos. He gives you the facts, both sides of the story and asks what you think, he doesn't push any false information to you and generally has documentation of some form to back up his claims. These videos will hopefully get you thinking for yourself, but clearly some people just see what they want to see. And just so you know you don't need to search too hard to find FOX bias.

Especially when you show other clips against Fox for jumping to conclusions on other instances? A friend told me of a video that actually shows that the police had told the protesters for 5 minutes that they will be pepper sprayed if they don't move. The people sitting were apparently protesters that refused to move until some of the arrested protesters were released (which the police couldn't do) so the police warned them about the pepper spray and told them they were breaking the law which justified them (it is illegal and it does justify). If all that is true then the police were right.

@Ianniello Watch the video "Fox News Misreports Pepper Spray Legality?" by liberalviewer. It shows that in a past legal case pepper spraying peacfully sitting protesters has been found to be illegal as it breaches the fourth amendment right!
Anyway if it was legal, it still would not have been morally right, just like cheating on your girlfriend is legal, but still not the right thing to do....

@Ianniello In California, force used can not be in excess of force exerted against them. So, even though these protestors were breaking the law, by California mandate, it was illegal to use pepper spray against them because it was beyond the force required to enforce the law. The police could have simply grabbed them and moved them elsewhere, instead, they used a violent counter against nonviolent people.

did you see the other part of the video? what happened before this clip? the cop told all the protesters that they were going to get sprayed.and it was going to hurt.I was outraged,at first, then saw the first part off the video, there was alot of warnings.and they were told exactly what was going to happen, they were asked if they wanted to stay, its all on video:(

@ftdRaw So if the police comes to your house and yells "police open the door" and you, protected under the fourth amendment asks for a warrant, but instead of a warrant the police calmly warns you that if you don't open the door they will break it down and take you under arrest, do you think that makes it legal because they warned you. Read the laws on the use of on non-lethal force and then talk. What is in question here is not whether they were warned, it is "what's it legal?"

I'm outside the Fox news bubble, after seeing several unedited versions of the last hour up to the event ~ I'd say the students deserved to get sprayed.... but not that much, nor from that close. They were blocking police from leaving with arrested detainees. They were also individually told they would be sprayed if they stayed there, I'd actually argue this is one of the few times I've seen a Fox clip that actually mentions "investigating" anything, rather than spewing their view.

I don't think this clip is biased, it's actually fairly unbiased. I think it's reasonable to question whether the protests were violent given the outcome shown in the video. Not that I agree at all with the outcome or support Fox in any way, but still.

@robertattwater87 I respect the police, but the proper action would have been to remove students by hand (calling for back-up if needed) or step over the students and leave. In fact, the police could have left there looking like the good guys had they not resorted to violent methods. By violent, I don't mean lethal, but certainly physically damaging and excruciatingly painful methods.

No one would have been okay if the cop had pulled his gun and shot them, because no one is okay with the idea of a firearm as a "compliance tool." As with many who have posted on this video, I think you need to look into what the law actually says, not what you would like to believe. Citizen Media Law Project has a very good article on the matter under the title "Access to Public Property."
Just because you pay tuition and fees does not grant you any legal "ownership" of land anymore than your boss paying you for work grants them partial ownership of your car, or anything else you purchase and upkeep.

And in other footage you can see that the police tried to get them up peacefully, then tried to pick them up and take them away, and then they sprayed them in the face. Don't get me wrong, I support OWS's motives, but it's called "Civil Disobedience" for a reason, not "Civil-what-we're-doing-is-completely-legal-and-the police-have-no-right-to-stop-us-from-doing-it...obedience".

@RTDice11 That still does not give the police the right to use pepper spray, I understand your point on the matter but there are limits set upon the police on the use of non-lethal devices, and these limits are centered solely on the defense of the police officer's safety and/or that of the general public, nowhere does it say "you shall use pepper spray to get people to move" had the students been violent in their protests then the pepper spray would be justified.

It wasn't Fox best public attention -- which some may argue when it is. But Shephard Smith, host of two Fox News Shows(Studio B and The Fox Report), did give a majority response. Why nip pick the situation?
Megyn Kelly just got nasty hit to her credibility and Fox just got some attention -- for bad reasons. So right now is not good for them. It wouldn't surprise me if Megyn clarified her response in her show but it don't matter, the damage is done and they should move on and not talk about it

Funnily enough the ACLU supports that distinction. The weird thing is though, that it's already illegal to purchase certain things said to harm society (certain munitions, various mind altering substances), but vastly more harmful purchases are endorsed (namely, political control - 93% of all Congress members in 2010 elections had higher expenditure on campaigns than their opponents). Is a purchase dialogue and tax curtailing speech? Is a fotune a legal document?
