If you don't like the law as it reads now, work to change it or remove it. When you have border patrol check points that are far from a border; there will be challenges to their legality. @ohannahdad Its hard to say what the procedure is in these videos because the man doesnt even answer the questions there maybe more to it. if these check points function anything like the border crossing then everyone in the car would be looked up and questioned for papers/identification. Can't even enter this country without a passport and a check in of where ur going and how long ur staying. If there is suspicion they search the car Ive crossed the border many many times. more strict at night

About the only authority agents have at these types of checkpoints is to ask questions about nationality, and look for plain view violations of the law.
Agents have much wider and sweeping powers at border crossings.

The border itself should be guarded better, and maybe have more demanding laws at checkpoints up to 75-100 mi from the border. As of now these cheeckpoints are seen as unconstitutional, and people don't want them. Some laws may have to be changed to make this work.

30 new Federal "check points" are scheduled to be set-up every year for the next 20 years. They will be located within 100 miles of our borders, including Canada, and within 100 miles of our sea coasts. That includes a lot of major cities.

Your behavior was entirely uncalled for. I've been through hundreds of those internal check points and the only question they ask is "what country are you a citizen of." Once the individual states the US they send you on your way unless they have reason to believe the individual is smuggling illegal aliens or the individual is illegal. They might ask for an ID. The Fourth Amendment to the United States Constitution is the part of the Bill of Rights which guards against unreasonable searches and seizures. The amendment specifically requires search and arrest warrants be judicially sanctioned and supported by probable cause.

@ohannahdad Its hard to say what the procedure is in these videos because the man doesnt even answer the questions there maybe more to it. if these check points function anything like the border crossing then everyone in the car would be looked up and questioned for papers/identification. Can't even enter this country without a passport and a check in of where ur going and how long ur staying. If there is suspicion they search the car Ive crossed the border many many times. more strict at night

About the only authority agents have at these types of checkpoints is to ask questions about nationality, and look for plain view violations of the law.
Agents have much wider and sweeping powers at border crossings.

@heavymetal9alchemist What I was seeing was people being stopped for 5-10 seconds and sent on their way. Operating like this I don't see how they can have an impressive arrest record. The border itself should be guarded better, and maybe have more demanding laws at checkpoints up to 75-100 mi from the border. As of now these cheeckpoints are seen as unconstitutional, and people don't want them. Some laws may have to be changed to make this work.

The Border Patrol's job is to patrol the border Msbea345. This checkpoint wasn't setup along the border but rather along an East-West highway inside the country no where near the border.
If an agent attempts to search a vehicle or extend a detention absent consent or probable cause at such checkpoints, they are in fact violating the law.

Driving a vehicle on public property does not void the constitutional amendments that protect against illegal search and seizure.

Your behavior was entirely uncalled for. I've been through hundreds of those internal check points and the only question they ask is "what country are you a citizen of." Once the individual states the US they send you on your way unless they have reason to believe the individual is smuggling illegal aliens or the individual is illegal. They might ask for an ID. I bet you raise hell about all the illegal aliens in this country and when they do something about it you act like an ass. Sad.

Funny. That's not the way I am treated at these types of checkpoints, and I go through them all of the time.
If I am in one of my vehicles, they usually just smile and wave me through.
If I am in a different vehicle of mine, they have always asked my citizenship, there I am going, where I've been, why I was there, where I live...
I guess it boils down to what they think they can get away with. Always test those limits, don't-cha know.
