    If you cannot pay, they can repossess the car and foreclose on your home. You can't clear student loans in bankruptcy. They can still garnish your social security.

    Although a person does have personal responsibility, student loan companies should at least have an income based payment plan. Charging credit-card like interest plus late fees,etc is crazy. This will be the next bubble that will burst.

  • If it's a private loan STOP paying it, stop trying to pay it, get a C&D order against it. The worst they can do is garnish wages and if you are barely earning anything to begin with they are not going to be able to garnish. Be sure to fire off C&D letters to stop the calls and harassment. After this is sent, any collection calls are now a thing you can sue them for. Record every call you can, catch their illegal practices on record.

    If it's a federal loan, get onto an IBR plan.

He got a regular job at a Marriot chain hotel...and he worked his way up to head chef. He STILL works there after all of these years. Going into debt for a chance at a career is STUPID. Don't feel bad..I am guilty of taking loans out as well. Sallie Mae is(WAS) one of my lenders. I just paid those sharks off in full last week after they owned my loans for only a week.

    There is currently legislation that would force Sallie Mae to work out settlements with students in the Congress as we speak. Google Private Student Loan Bill 2010. Thanks to John Bahner, it'll probably get shot down since he was paid over 200K by lobbyists last time to make them impossible to settle or file for.

  • @Braveslion --Not entirely... I'm not sure what this mans capabilities are, but I'm stuck in a similar situation and I graduated at the top of my High School and College class. When I started my degree the markets were great, but when 2008 rolled around and the economy collapsed, my job went with it. Not all of us are just irresponsible borrowers. The difference is that Sallie Mae assesses 0 risk, while the student and tax payers assume all risk.

    rachel believe it or not college for the most part is a scam... sure if your in a medical or enginering field it make sense to further that education. People are much better off going to a tech school and learning ACTUAL skills ie (plumbing, electric, engine techs) things like that. If i get through this class, i plan to courses in computer information systems, do anyone think this is a good field to go into or am i getting ripped off. When i first looked inot one of the computer classes, the book for one of them was called microsoft 2010, it's now 2011

If wha the starting pay is, is LESS than what you will OWE when you are done with school, then you shouldn't bother... example Business school Cost $57,000, Starting pay $33,000... Or put it another way, if said give me 57k and I would give you 33k would you?

    Student loans exploit the poor by putting them deeply in debt while the rich graduate debt free and are able to spend the money they would have given Sallie Mae buying a house, car or other things.

Now they're threatening lawsuits. LOL!!! WTF are they going to take from me? I have no money...and its in 2 private loans and 1 government loan, and the reason for these two different types of loans is beyond me. They won't even let me consolidate these 3 loans cause ones a "private" loan and the other one is a "gov" loan.

  • sallie mae is trying to get me to pay for a loan i co-signed. i sent them proof that i was a victim of i.d. theft. but they wrote me that there was not enough evidence that fraud was committed and i have to pay for the loan. they will not send any paperwork about the loan. so now i have to figure out how to take sallie mae to court and have a judge to dismiss their collections and fix my credit. anybody got any ideals to fix this problem?

A little bit of research shows that most high-priced culinary schools are scams and that the average restaurant cook can't hope to cover the costs of their schooling.   • @jjw0782 you can get thrown in jail if you default on your loan. As i said you sign a MPR, MASTER PROMISSORY NOTE. I myself have had to sign these and reading the entire thing, you would know that either 1 of 3 things can happen if they don't get the minimum payments. They will dock your pay, Or they will sue you if you don't have a job, and if you don't pay either way they can throw you in jail for up to 5 years and you still have to pay the money back because it was court ordered.

    You can't do that, cos the fed gov can withhold funds directly from your paycheck/social security/ your bank account if you fail to pay. Unlike credit card debt, student loans cannot be discharged thru bankruptcy, so instead of using a student loans to fund your education use you credit card, you can default on it if need be, and don't give a shit about your credit score, you can rebuild it a lot faster than you can pay back sallie mae.

The agencies that provide these services are getting their money from them hence the term "lending tree" . Even after bankruptcy, his checks will be garnished well into retirement- I know my mom is still paying hers that way

    I don't think these people realize that it's in the best interest of the tax payer if bankruptcy rights are restored. It would force Sallie Mae to settle student loan debts without a student being 'forced' into bankruptcy. It's just fiscally prudent

    I totally agree with this sentiment, but sadly it's not that easy :/ Thanks to legislation passed in 2005, private student loans are no longer able to be discharged in bankruptcy. I'm worse off than this guy actually, but there is nothing we can do about it. We literally sold our souls the minute we signed those papers. I wish I would have never gone to college :/

  • @ahalstea84 I'm not sure it's all his fault. The colleges provide students misinformation that shows they will likely be empolyed, and at a rate where they can afford to pay back on the loans. However, in reality it is very diffcult, especially for students, to find jobs after they graduate, or while they are in school. Yes, he may have known what the interest rate was, but he may not have known that the information the colleges gave him was in fact incorrect.

But this is the result of "free-market" deregulation, a free for all for big banks and loan sharks who don't have to worry about any consequences.

The whole reason Sallie Mae charges such high interest is because of the correlation of risk associated with lending to students; the risk of not getting their money back. However, they still charge high interest and have the power to garnish wages and confiscate any tax returns students may receive. SM has a 25 year window to do this. Most of these kids who get into these loans have no idea what they're getting into. Flee the county.

  • I went to college to better myself. Sallie Mae charges me more than I make in a month & that was for 1 loan. I got 12. I told them I couldn't pay, they refused to consolidate do to "insuffient income". And when I lost my job I asked what I could do, there answere "NOTHING." I barely make enough to pay rent, I can't pay them even close to what they're asking for. I can't handle it, I cry everyday. My boyfriend and I want to start a family. With SLM taking all my $ it will never happen.

  • Just for the record Xtremelyopinionated legal or not they have and continue to change around loans without any consent from the borrower. The number of loans I have for certain years from Sallie Mae has shrank without ANY physical or digital forms being sent to me. Interest rates increased from 6.7% on 8 loans to becoming 5 loans with ranges from 8.5% to 13% interest rates yet I've never signed off on anything from Sallie Mae allowing them to do so.

  • Sallie Mae is the devil!! They tried to take away some payment reduction offers in the terms of my loan and claimed that because they couldn't get a hold of me via email I lost the right to receive credits against my loan! I had to get the BBB involved to get them back.

    Federal Loan: Stafford Unsub/sub Loan (5.6-6.8%), Parent Plus, Graduate plus loans (8.5). These loans have FIXED rates, unlike Private VARIBALE rates.

  • As long as you keep your accounts in good standing you can put off payment for a very long time. You should read the fine print before signing anything. Remember they have income sensitive programs for repayment. I think it's something like 4% of your monthly wages go to paying the loans off. Of course it takes forever to pay it off then-like the rest of your life, but you did sign. I did, my princple is over one hundred thousand now. So try not to worry about it. Its what I do.

  • I only asked to be given a payment plan I could afford and they sent me a letter shortly after saying they sold my loans to Progressive Finance which added 24 percent interest to my loans. I had no say at all. SallieMae did this right after I called seeking a payment plan. My work checks were garnished for seven years. I paid thousands. Government Loans? Shame on the United States. Other countries offer healthcare and education. The United States offers insurance and government loans.
