I feel, that child support should be payed. I also feel, that each person should be assigned a case worker. Both parents should be made to work by law. If one looses/ or fired at job, then he or she reports to the case worker 1 month after the job has been lost and support is then modified for only 3 months (to find meaningful employment). And you only get 5 job losses over an 18 yr period If child is disabled, then you both get to take a tax decuction based on the cost of care for the child.

Did you get your kids birth certificates when they were born?

If you did

1). That is the states proof that you admittedly abandoned them (and that eventually MAYBE you will come back to claim them)

2). If you had a marriage "license", (u got a license, because having kids without one would have been illegal, right?), Your license/permit you thereby entered into a 3 party limited liability contract with the state, and it gets to make claim for the "fruit of you and your wife's "labor"=kids

The child support syetem id screwed up! The men that pay every month and are steady with there payments and then miss a few payments should at least get some sort of leinancey due to the fact that they are trying. I missed a few payments this year and last year but while working two jobs the FOC was taking money from both my pay checks to cover the arrearages. I now pay $678.84 a month for just my oldest son. And his mom feels the need to call me and complain about her bills not being payed.

But much more needs to be done. I envision, the creation of a national organization. This organization would do three things. First teach noncustodial parents the law and how to use it . Two, help these people to restore their property and finances. Third, begin a massive campaign to educate people on what we are doing and why. The way to win , is to cut off the money,power and control. refute the lies.

Google "Petition for Child Support Reform". Find the website, read the content and sign the petition. This isn't about the best interest of the children and it never has been. It's been about making states and county money which is tax payer dollars paid as funding by the federal government for child support enforcement. It's an incentive. The more the states report it takes them to enforce these cases, the more funding the feds pay. Welfare Reform Act IV-D is the basis of it all.

Sorry ran out of room, File what is called a collateral attack, ie attack the original jurisdicton of the court. The courts are corrupt, but when it is established that they did not any real authority, they have to give it up.

It get better if that judge refuses to obey the law and make the fraud go away. You can, by FRCP rule 60, go straight to the federal courts. This takes it out of their venue , they are not immune from federal law and that scares the shit out of them.

thered702, the courts are courts of contract, but getting them to recognize this and abide the limits it imposes is nearly impossible. That does not work! I have found something that does work, because its based on their own rules. Fact most child support orders are void, the court , did not have jurisdiction to make any such ruling. There are 4 elements that give court jurisdiction and most the time one or more of those elements is missing. File a case ,challenge the jurisdiction.

my brothers ex wife holds his kids hostage he has never missed a support payment ever but she still wont give him his kids on his weekends cops wont do nothing nor will the courts. she also is a very bad mother renting out there bedrooms to workers passing thru and forceing them to sleep on the couch. the list of what she put those kids thru is endless but there is no justice my bro works hard has a nice house but cant get his kids from the court she kicked them out once and the went to him

I see the problem here being, they took you license because you did not pay your child support in the first place. and now you want it back to take care of yourself.

What the #@## do you think your child/children are going to do while you get yourself together. That is the problem with a lot of men if they leave, they wash their hands of everything, then get mad if they are called on it.

my baby mamma was order to pay 100 in child support. She doesn't even pay that. The child support office said she doesn't have to pay any child support because she is on welfare and ssi. If i didn't pay child support i would go to jail. But she gets a free pass.

I'am sick and tired dead beat moms and the government that support them!!

child support services are all third party interlopers with no contract, therefore no claim to demand any money from anyone. once in court and they accuse you of not paying up, have them produce the contract you signed saying that you agreed to pay this. tell them you agree to pay in full in return for the original contract. an offer to pay refused, is a debt forgiven. courts are commerce. commerce is contracts. no contract, no case.

@thered702 you r absolutely right. I am going through a similar problem. My sons' mother is sending me to court on April 4th, 2011. Because I missed an Oct. 2010 payment due to a high electric bill that was $90 And I was only able to pay a $100-$150 for a few months to try to catch up on my child support. But a constable came to my house to issue me a petition saying that I'm being sued. This past week I was able to send $300 out of $338 hernandezralph32@hotmail.com email me If you have advice.

they do this thing on the Radio on this channel 'The Edge', a segment called 'dickin with a dead beat dad' and basically Billy Madison (who i think may have been fired! (probably for being homophobic and sexist)(yay)) prank calls these men who are thousands of dollars behind in child support payments and 1 out of 3 legitimately can't even support themselves, but most really are dead beats. one of the ones that was out of a job admitted to being a failure as a father, and it wasn't funny AT ALL.

Frustrating, isn't it? I'm not sure for your state, but check on this: The child support enforcement office should be required to do a review and adjustment of your child support when they find out about a situation like yours. You shouldn't have to take it back to court and that guy on the phone should have initiated the process right on the spot. Receiving federal funds is predicated on the State's compliance with ALL the provisions of the program. Don't let them skirt their duties. Good Luck
