The arbitration includes a non-disclosure clause *and* in this case KBR arranged it so that the "judge" is appointed by KBR. There were multiple cases of rape forced into arbitration by KBR. Subsequent female applicants never heard of them, never heard of the danger they faced, because of forced arbitration. this issue to me seems to be all about defense contractor lobbyists and campaign donations influence on legislation. Franken is abusing this rape story to push forward loosely related legislation. Everyone is against gang rape, but encouraging more lawsuits of sexual harassment could be potentially very bad. It is very difficult to prove sexual harassment and can be a result of a misunderstanding. Arbitration helps weed out the poor cases. If you remove arbitration, many women who are fired will be filing for sexual harassment and will force companies to lose millions in settlements.

Libertarian take: The Franken amendment interferes with freedom of contract. The victim of force here already can seek redress in the CRIMINAL courts regardless of any contract. Since most civil cases are settled out of court, it is reasonable for a business to have an arbitrarion clause.. They did not 'force' her to settle, she agreed to arbitrate, and now is flipping the script. And it IS demagogic to frame any bill in terms of "if you oppose this, you must be pro-rape," anti-American, et al.
You misunderstand, The contractors were preventing her from seeking a solution from the Criminal court claiming that the proper venue to address the issue was arbitration. Now if she had an issue with compensation for services rendered, for a disciplinary issue or other mundane charge, arbitration would be a viable alternative and if she indeed singed the contract, the only alternative. Arbitration is not the proper venue for RAPE or any other criminal activity.
I agree on rape being a criminal matter that trumps contract, but the solution was reforming the jurisdictional issue preventing her from seeking a criminal justice remedy, not to outlaw arbitration clauses that head off civil litigation.

He is not advocating that any other civil complaint be addressed by the court. I have been involved in arbitration cases. KBR had no advantage over any other party.

this issue to me seems to be all about defense contractor lobbyists and campaign donations influence on legislation. Issues of sexual harassment in the work place are hard to prove but if the case is weak the prosecutor/attorney's will not take the case its not worth their time in the end the only thing that matters to either side is what monetary value can be gained or lost, unless the case involves rape or physical abuse then some form of prison justice needs to be attained

RAPE is crimminal charge and cannot be heard in a private court. To do so would be to say that a contract can quickly outweigh the legal system in this country. that you can sign away your rights...sorry but that is not possible and crimminal cases are always the domian of legal courts. Franken is abusing this rape story to push forward loosely related legislation. Everyone is against gang rape, but encouraging more lawsuits of sexual harassment could be potentially very bad. It is very difficult to prove sexual harassment and can be a result of a misunderstanding. Arbitration helps weed out the poor cases. If you remove arbitration, many women who are fired will be filing for sexual harassment and will force companies to lose millions in settlements.

Libertarian take: The Franken amendment interferes with freedom of contract. The victim of force here already can seek redress in the CRIMINAL courts regardless of any contract. Since most civil cases are settled out of court, it is reasonable for a business to have an arbitrarion clause.. They did not 'force' her to settle, she agreed to arbitrate, and now is flipping the script. And it IS demagogic to frame any bill in terms of "if you oppose this, you must be pro-rape," anti-American, et al.

You misunderstand, The contractors were preventing her from seeking a solution from the Criminal court claiming that the proper venue to address the issue was arbitration. Now if she had an issue with compensation for services rendered, for a disciplinary issue or other mundane charge, arbitration would be a viable alternative and if she indeed singed the contract, the only alternative. Arbitration is not the proper venue for RAPE or any other criminal activity.

What Al Franken was proposing is that the loop hole demanding that criminal charges be address by arbitration be removed. A reasonable request. He is not advocating that any other civil complaint be addressed by the court. Basically with this wording, a defense contractor could be working on something massive such as the next F-22, but by this amendment, the government would be required to drop both it and the contractor's millions upon millions of dollars invested were a simple sexual discrimination suit in civil court to be lost (which lets face it, all it takes is a supervisor's sexist remark).
This is in violation of the security interests of the nation and, frankly, common sense.
