Judges generally like to read short and concise letters that get straight to the point. This is kind of long winded and wordy, drifting from social issue to personal appeal... I'm aware of what judges want because my father is a judge. good luck anyway I believe that it is impossible to "remove" sex offenders from the internet or society, it is also impossible to have a fair and honest justice system. :s

Edward had two convictions in the state of Florida and one in South Carolina. His first conviction occured in 1986 for sexual battery on a 14 year old boy. His second conviction was in 1987 again for sexual battery on a victim 12 years or older . His last conviction was for failing to register as a sexual predator. In all fairness Edarem was given a chance to comply with the law, he chose to show no regard for his conditions of his probation..NO child molester should be given leniency !
There was no second conviction - everything including his incarceration now is as a result of sex offender laws. Instead of making money and entertaining people he is now incarcerated on the taxpayers dime. If you need to make stuff up to defend your argument then it's not very convincing.

When I was 14, I was proactively seeking sexual partners - just because I failed to find any does not mean I would have been a "victim" if I had succeeded (if the person was over 18 in some states, or over 16 in others.)
It's probably inappropriate for adults to engage in sex with younger participants - but there is a big difference between inappropriate behavior and "a danger to all society for the rest of one's life". I don't support elimination of statutory rape laws, but I think the age of consent should be reduced to 16, and the penalty for consensual sex with a 14 or 15 year old be a fine, and it not be considered a sex crime.
Lower AOC works pretty well in Europe - in countries with lower STDs, lower teen pregnancy and much less public hysteria than here. I don't think a 7 year old can consent to sex - but do you seriously not remember being 15 years old? Think of the emotional trauma of these kids being labeled a victim, and knowing that their lovers had their lives ruined, because of them.

I read a story about a man who was on a sex offender registry for having sex with his high school sweetheart when their ages passed the legal limit. They are now married - but if you look at his page on the registry it sounds like he is some predator.

My point is that, in this case, we are dealing with someone who willfully tried to evade registration (private or not) & continued to try to circumnavigate court guidelines. You said 'Liberty compromised 'to protect others'. Sex offender registries have had zero impact on repeat offenses. My intuition told me it would make them worse, but no effect still proves my point. However, they do contribute to homelessness and create a new class of crime from dodging parole, such as in this case. Hurting the economy, and fascism are a steep price for not making anyone any safer.

As for Ed, my belief that sex offenders are "people who have made a mistake" and that sex offender registries are bad probably made me more amenable to the idea of defending him. But I don't think that invalidates or belittles the personal aspect.
There probably should be a registry for violent crimes (not just sexual) but it should not be public.
The founders of our country broke the law to dodge tyranny. Even Rosa Parks, whom we now hold in esteem was breaking the law.
The public is targeting sex offenders more and more with organized stalking efforts. They can't get a job, they can't live where they want - they can't even take a walk on Halloween or by a school. When it comes to sex offenders the consideration of the public is the main concern. The world doesn't work in accordance to the law, the law works in accordance to the world. Public consideration will ALWAYS be upheld in cases of sex offenders. I'm not saying he is deserving of such a punishment, I'm merely saying he is being bound by laws that don't necessarily make sense to people not directly involved but are there for a reason.

My greatest fear is that after we have completely shut "them" up, we begin to expand what "them" is. Personally, I think people who are hostile and intolerant, like yourself, are much bigger threats than people who have committed crimes two decades ago. After all, you threatened me for having an opinion. We've seen hostile and intolerant people attack others for opinions, or even an accusations of an "opinion", religion or people from Witch Trials to Communist trials to racial lynchings. To solve problems though, you need to use your brains, not your fists. Try to think about it.
I don't feel that he deserves constant harassment from people, but you have to protect the public. You feel that he's a hero for not obeying the rules of his probation and failing to register, so my question is:
Do you feel that felons who are convicted of gun crimes should have to follow the "unreasonable" rule of not allowed to own a gun and that it in fringes their right to the 2nd amendment?
Just because one may disagree with the law, doesn't mean they can just break them.
I don't believe that that sex offender registries keep us SIGNIFICANTLY safer. On the other hand, I do believe that making people who have a tendency to act out sexually not be able to integrate into society and not get a job might cause them to reoffend. Also, they may subconsciously believe that they deserve this treatment - which goes both ways, if they deserve it then they are evil - why not reoffend? I want it repealed.
Since I want it repealed, of course I will stand up and attempt to put a human face on the so-called "danger". Someone who clearly got a crap deal, and someone who I feel reasonably strongly had no desire to reoffend.

The comparison wasn't aimed towards actual crimes, but at the fact that godshiva felt his rights were being invaded, yet its part of the state he moved to (which he did w/o notifying the officials which is also one of the things he was in trouble for) law that sex offenders cant do what he was doing. Not only did he plead no contest to raping the 14-year old, He failed to register as a sex offender in 1998 and in 2006, "he was hit with the similar charge of failure to comply when he made the move out of state." He also avoided a 5 year sentence in 2007 (got 5 years probation) for failing to notify officials when its required to do so. Even though the rape of the 14 year old happened 20 years ago, he still violates the rules.

We aren't going to see eye-to-eye on whether individual rights supersede perceived safety of those who live in their communities who fear they might become victims. Judges generally like to read short and concise letters that get straight to the point. This is kind of long winded and wordy, drifting from social issue to personal appeal... I'm aware of what judges want because my father is a judge. good luck anyway I believe that it is impossible to "remove" sex offenders from the internet or society, it is also impossible to have a fair and honest justice system. :s

Edward had two convictions in the state of Florida and one in South Carolina. His first conviction occured in 1986 for sexual battery on a 14 year old boy. His second conviction was in 1987 again for sexual battery on a victim 12 years or older . His last conviction was for failing to register as a sexual predator. In all fairness Edarem was given a chance to comply with the law, he chose to show no regard for his conditions of his probation..NO child molester should be given leniency !

There was no second conviction - everything including his incarceration now is as a result of sex offender laws. Instead of making money and entertaining people he is now incarcerated on the taxpayers dime. If you need to make stuff up to defend your argument then it's not very convincing.
He was being harassed so he didn't register - gee big surprise then he did get rid of his computer which was complying with the law - and they still threw him in jail. Prison for life for existing?

Everyone has a reason to be hated, they're a jew, too liberal, too conservative, too inactive, too overweight, too rich, too poor. Should a few people be able to decide who has the right to speak? It seems unamerican to me. What seems odd to me is it seems those with the most pride in this country are the least likely to care what our principles are supposed to be.
If someone hurts me or my child then prison is fine - we don't need to burn the constitution or bomb a country.

DjMasquerade- That is simply not correct at all. His first conviction was in 1986 for sexual battery on a 14 year old boy. His second conviction was in 1987 again for sexual battery on a victim 12 years or older without using enough physical force to cause serious personal injury. That is Rape!

Liar liar pants on fire! Google search and about 10 seconds confirms, there is ONE not TWO charges of sexual misconduct. This was non violent as was alleged in the YT video. Also, the law is such that consensual sex can be reported as "Rape" so I wouldn't trust just a title of a crime. I have read stories about people landing on registries for sex with their current wives while they were still in high school. The government sucks at identifying actual threats so why allow scarlet lettering?

It's probably inappropriate for adults to engage in sex with younger participants - but there is a big difference between inappropriate behavior and "a danger to all society for the rest of one's life". I don't support elimination of statutory rape laws, but I think the age of consent should be reduced to 16, and the penalty for consensual sex with a 14 or 15 year old be a fine, and it not be considered a sex crime.

Lower AOC works pretty well in Europe - in countries with lower STDs, lower teen pregnancy and much less public hysteria than here. I don't think a 7 year old can consent to sex - but do you seriously not remember being 15 years old? Think of the emotional trauma of these kids being labeled a victim, and knowing that their lovers had their lives ruined, because of them.
A fine would allow recourse for concerned parents to stop the relationship without ruining anyones lives. No one loses.

I will never understand why you think sex is such a big deal, and you will never understand why I think negative psychological and economic impacts could possibly outweigh the "moral impetus". It's the same thing I run into with discussion of legalization of drugs or prostitution. We're discussing issues but we do it because of what we 'feel' which is much harder to change.

I read a story about a man who was on a sex offender registry for having sex with his high school sweetheart when their ages passed the legal limit. They are now married - but if you look at his page on the registry it sounds like he is some predator.
I don't really trust semantics used to describe these types of crimes and really have no desire to do a more thorough investigation.

I belive that every one should have a second chance. He may have raped a 14 year old but he may have cleaned up his live since then. I became a YouTube fan of Edarem recently. I enjoy watching his videos of him giving tips on meals and of his dogs. He is a old man. And he has only a short time left to live. I hope he is found inocent to his crime so he wont spen the remainder of his life in jail.

My point is that, in this case, we are dealing with someone who willfully tried to evade registration (private or not) & continued to try to circumnavigate court guidelines. You said 'Liberty compromised 'to protect others'. Sex offender registries have had zero impact on repeat offenses. My intuition told me it would make them worse, but no effect still proves my point. However, they do contribute to homelessness and create a new class of crime from dodging parole, such as in this case. Hurting the economy, and fascism are a steep price for not making anyone any safer.
Incidentally my vid "don't boot sex offenders" predated this incident.

As for Ed, my belief that sex offenders are "people who have made a mistake" and that sex offender registries are bad probably made me more amenable to the idea of defending him. But I don't think that invalidates or belittles the personal aspect.

The founders of our country broke the law to dodge tyranny. Even Rosa Parks, whom we now hold in esteem was breaking the law.
The public is targeting sex offenders more and more with organized stalking efforts. They can't get a job, they can't live where they want - they can't even take a walk on Halloween or by a school. This if they follow the rules. If they break the rules they can move to another state, but no one who breaks rules ever commits a sex crime, so we're safe.

When it comes to sex offenders the consideration of the public is the main concern. The world doesn't work in accordance to the law, the law works in accordance to the world. Public consideration will ALWAYS be upheld in cases of sex offenders. I'm not saying he is deserving of such a punishment, I'm merely saying he is being bound by laws that don't necessarily make sense to people not directly involved but are there for a reason.

My greatest fear is that after we have completely shut "them" up, we begin to expand what "them" is. You don't need a majority in favor of fascism - and everyone's motivations are not necessarily the same. Take away rights, then expand the definition of sex offender until it includes most people. In at least one state, urinating in public can land you on a registry.

I don't feel that he deserves constant harassment from people, but you have to protect the public. You feel that he's a hero for not obeying the rules of his probation and failing to register, so my question is:
Do you feel that felons who are convicted of gun crimes should have to follow the "unreasonable" rule of not allowed to own a gun and that it in fringes their right to the 2nd amendment?

I don't believe that that sex offender registries keep us SIGNIFICANTLY safer. On the other hand, I do believe that making people who have a tendency to act out sexually not be able to integrate into society and not get a job might cause them to reoffend. Also, they may subconsciously believe that they deserve this treatment - which goes both ways, if they deserve it then they are evil - why not reoffend? I want it repealed.

Jthompson1100 is absolutely correct. Not only did he plead no contest to raping the 14-year old, He failed to register as a sex offender in 1998 and in 2006, "he was hit with the similar charge of failure to comply when he made the move out of state." He also avoided a 5 year sentence in 2007 (got 5 years probation) for failing to notify officials when its required to do so. Even though the rape of the 14 year old happened 20 years ago, he still violates the rules.

Many do this for years without ever getting caught then one child will stand up for themselves. All the statistics I see say most sex offenders never re offend and most cases of unreported sexual assault are in the family - in fact, I find it hard to imagine a circumstance in which multiple teens would be "beaten" but not get it reported.

1. He wasn't arrested for making videos. He was arrested for failing to notify after he moved to a new state. He also violated conditions of his parole which prohibited him from using a computer.

i agree, anyone who is convicted of a crime should lose some of their rights. after their incarceration has been served, their rights should be fully restored.
unless restricted by conditions of a probation, ex-convicts should enjoy the same rights to life, liberty and the pursuit of happiness as you and i.

So a convicted felons should be allowed to bear arms once they are released from prison? (Seems pointless even mentioning it, since guns aren't readily available in prison).
Besides that, if you are on parole, or probation, you have not fully served. Why do people seem to always say that someone released from prison has re-payed their debt in full? It is rarely the case.

So people can never undo what they did, so their punishments must last for life? What does this have to do with this issue? If you are in favor of execution for all crimes you are doing a poor job of arguing it.
As for guns? I don't know, it's conservatives who argue that people should be allowed to own guns even though there is a risk they might kill somebody with one - ask one of them. I wouldn't expect a coherent argument to arise once the mention of sex offender comes up though.

I think you and I are going to have to agree to disagree. Your letter is well written, and you sound well-intentioned.
We aren't going to see eye-to-eye on whether individual rights supersede perceived safety of those who live in their communities who fear they might become victims. I'm not going to convince you that sentences and laws should be enforced whether they seem just or not, and you aren't going to convince me that owning a computer is a basic human right.

My point is this - if we let people out of jail then it should be with the hope that they are able to accomplish something with their life. If we impose rules which effectively make it so they can't be seen, can't be heard, can't leave their house, can't be safe, can't get a job . . . . how is this helpful?
I legitimately believe you are wrong on your facts. Despite publicity and fear mongering the overwhelming majority of sex crimes DO NOT involve a computer.

I did not claim, and will not debate whether or not use of the internet increases proclivity for recidivism. Its not my expertise, and I'll leave that to the experts.
Conditions of his parole were violated. You think that felons should only abide by conditions that they feel are reasonable. I think that parole is pointless if the conditions are not met.
As to whether or not life can be meaningful for a felon who has conditions placed on them, I guess that's up to them, unlike their victims.

If one person robs bank and they arranged the robbery with someone else on a cell phone - you do not make a theft registry and say that nobody who has ever stolen a candy bar cannot own a cell phone because "there is a chance they might use it to collaborate on a bank robbery". That doesn't make any sense. The difference is not the argument, but your misconception that all predators are using computers to seek out new victims. I'm sorry, you're just wrong.

If your point is that he violated the rule to not own a computer or post to youtube, he didn't, his friend posted it for him. If that was "illegal" then the court has made it illegal for his likeness to be posted, which I covered in my video.
If your point is that the law is good, then my analogy is highly relevant. The law exists because of a few highly publicized incidents of sex offenders using computers and public hysteria.
A well intentioned bad idea is a not a good idea.

if you wish to restrict someone's right to bear arms (or god forbid, computers) then make it a condition of their release and give them probation.
i'm not aware of the conditions of muscare's release. if he was in violation of a probation, he should be incarcerated. if not, get off his case. he's free.

I understand that and feel free to remain neutral. My position is not that sexual offenses are ok, but just that sexual offenses have nothing to do with owning a computer. To be completely honest, I doubt he's going to want to talk much about it - the only information that was given on his channel was that it was non violent since then it has been said it involved a minor (14 years old) though I have no interest in investigating further.

However, you do bring up an interesting point concerning the matter that "Edarem" himself did not post any of the videos after he was asked not to. I agree with you that is unfair. However, the fact that he violated the conditions in the first place is subject to legal consequence; and negligence of the law (or not knowing what the conditions of his probation are) is no excuse for violating probation conditions.

there are libraries where he could go and use the computer in a public place without the necessity of owning a computer.. don't see the big deal ... if you don't want your rights taken from you then don't commit a crime... simple as that... the moment you do, you are a threat to society and therefore subject to the law.. last time i checked molestation is a crime
