  • @realitystrucku I doubt you've read the "real facts" either. I'll take the verdict of 12 jurors who sat and listened to every piece of evidence and decided an unanimous guilty verdict. I couldn't care less with what the rabid street mob of anti-death loonies managed to do after the fact by misconstruing "evidence", threatening and pressuring jurors and eye witnesses, etc.

  • @realitystrucku I don't think anybody denies the fact he committed similar shootings in the weeks or days before. Bullets were matched from both crime scenes to his gun, so it wasn't based solely on "eye witness" testimony but actual forensic evidence. Yeah, he shot the first time when nobody was hit and was seen doing it, but this SECOND time in which he hit his mark and killed someone and was again seen doing it, nah, THAT time someone else did it!!! Bullshit with a capital B.

  • @realitystrucku Maybe Aliens did it? I deal in reality. 22 years was more than ample time for evidence to be brought forward. 5 years would be enough. These 1990 and earlier death convictions are all drawing to an end. Nobody gets convicted these days and put on death row based solely on eye witness testimony anymore. Now it's all about forensics, DNA, and actual video. You wouldn't know that by the anti-death penalty crowd that have watched To Kill a Mockingbird one too many times.

  • @huytran have you actually read the court documents from the 2010 hearing with judge Moore where the "recantations" were heard. They do not leave anything beyond reasonable doubt. If you haven't I would encourage you to do so because they are very inconsistent

Why do you think the average murderer kills and takes the risk of at least a very long prison sentence when in most cases the “rewards” are minuscule, a relatively small amount of money or a few minutes sexual gratification? If capital punishment is immoral, it pales in terms of numbers compared to murder. How would you address the larger problem in that case?

One guy did not want to be involved and the last guy actually owned the same type of gun that killed the cop. Davis did not own that gun. What else do you want? Are you saying that because he declared his innocence up until the moment he died, that he is evil? You are wrong. The Death Penalty is evil.

It was reported that Troy did not own a .38 caliber gun. Also, one of the two jurors did not want to comment anymore on the case. Why? Because he/she didn't want to face any wrath when Davis was killed. The other juror that maintained his statement actually OWNS a .38 caliber gun.

The bullets of Davis' gun "magically" appeared in the victim, which was the same gun used by Davis in another shooting. How did bullets from Davis' gun end up in the victim? Did some random stranger "steal" his gun, who just happened to look identical to him as well? And then of course witnesses mistook innocent Davis for his identical evil twin.

How else would one explain them totally ignoring and dismissing overwhelming evidence that suggested Troy's innocence. If they really wanted justice for Officer MacPhail..if that were truly their intention..they would have been open to ALL of the evidence & asked that Troy be allowed to take the polygraph test as he requested.

Search for "Troy Davis" + "Ann Coulter" and read her article: ”Cop-Killer is Media’s Latest Baby Seal.” Also, there *was* physical evidence. The shell casings matched both shootings that night and Davis was convicted of the other shooting as well. Therefore, you’d have to claim that Davis was falsely convicted in both shootings. No gun recovered? Now what murderer would get rid of the murder weapon if possible?

  • @litwriter100 No gun with bullet casings means that the only thing they could prove is how many bullets were fired at the victims. Davis's conviction in the other shooting was also based on "witness testimony." Davis was falsely convicted in the other shooting because he was tried for all of those crimes at once. Prosecution theory was that he was on a crazy gun toting binge that night.

  • @litwriter100 and while there were 34 total witnesses, only 9 of those witnesses were the ones who IDed Davis as the murderer. The rest of the witnesses were you standard foundation witnesses, like the officers who investigated the crime, the coroner who testified as to cause of death, etc. 7 of those 9 witnesses eventually recanted, some of whom even saying that it was one of the two remaining witnesses who shot MacPhail, not Davis. All of them said the police pressured them into testifying.

  • @huytran According to the Coulter article, only two of the eyewitnesses recanted anything of significance. In regard to the two, why did Davis refuse to call them at a post-trial evidentiary hearing? One of them was right outside ready to testify. The implication seems to have been that Davis knew they wouldn’t hold up to cross-examination.

  • @litwriter100 Are you referring to the Ann Coulter article? I generally don't credit anything that comes from that vile woman's mouth, but to address your point (and I only speculate here since I would have to read through the case transcripts to get a much better idea of what Davis's counsel's considerations were) - Witness testimony without physical evidence is still circumstantial, so the credibility of those two witnesses may have been such that calling them back during the post-trial

  • @litwriter100 hearing would have been more damaging to Davis than helpful. Also, these witnesses recanted after the trial ended, so the time between their testimony at court, their affidavit, and the post-trial evidentiary hearing could have been such that defense counsel believed that the affidavit was more reliable than the witness's recantation. Finally, ineffective assistance of counsel was one of the grounds for appeal. It is quite possible that defense counsel simply made a mistake.

  • @litwriter100 Again though, these reasons are purely speculative.

    The crux of the argument against Davis's execution is this: His execution was based only on 9 witness IDs. When 7 of those witnesses then change their mind, his guilt is no longer beyond a reasonable doubt. The death penalty is final. There is no way to make amends if our justice system was wrong in concluding that Davis was in fact the murderer.

  • @huytran Thank you. I am only interested in Coulter’s article as a conduit of factual information. Her political views, like those of Amnesty International, don’t otherwise concern me. If either misstates facts, I would like to know what and the basis for such an assertion. You argue against capital punishment, which is irrelevant here as it is the law of the state involved. Only the guilt or innocence of the accused mattered. (Continued)

  • @huytran Even Justice Brennan, the late flaming liberal Supreme Court jurist, was most skeptical of post-trial recantations as such were often indicative of pressure from defense attorneys. One of the recanting witnesses in this case had been only a few feet from the murder but now, after many years, “isn’t certain” if he identified the right man.

  • @litwriter100 Though I am opposed to the death penalty, my focus is on the fact that the evidence the prosecution relied on fell through their bottom and left nothing reliable left to convict Davis with beyond a reasonable doubt. And though Justice Brennan may have been skeptical of post-trial recantations, he was also strongly in favor of ensuring the due process rights of criminal defendants, making many arguments in favor of excluding evidence that was secured in violation of their rights.

  • @781Cesare Davis was granted an unusual order by the US Supreme court for a lower court to review the facts. The judge issued an extensive report which anyone who is really interested in the facts of this tragic case can read if interested. I suspect you’re not.

In some cases you kill a cop and you may not make it to any police station thats why he turned himself in white has nothing to do with cop killing. the cops don't tolerate it.Thats just the way it is.He apparently signed a confession saying he killed the cop according to the detailed winopekia.
