The Founding Fathers envisioned the three branches of government for 'checks and balances' in governance. For the Supreme Court to 'defer' to the legislature is to forfeit its stewardship to protect the rights of the people.
Government and Big Business Pfizer oozed abuse of power and corruption. Ms. Kelo's neighborhood was abandoned by Pfizer in 2009 for economical reasons. What have the politicians and Supreme Court got to say now? Who should be accountable for abrogation of property rights?
The Government forgot 1 thing, public perception. Under the eyes of the law it is legal, but in the eyes in the most of the public it was stolen, making the land worthless to business You cant conduct business with a hostile public.
This is an example of why the US is not a capitalist country. It is corporate socialism. Capitalism has respect for property rights, corporate socialism only rigs the game in favour of those who need no favours.

The three reliably conservative members of the Supreme Court at the time (Rehnquist, Scalia and Thomas) voted with the minority, along with one swing Justice, Sandra Day O'Connor. The four traditional liberal justices (Stevens, Souter, Ginsberg and Breyer) voted with the majority, along with the second swing justice, Kennedy. Clearly, those justices similar to Bush voted to protect Suzette Kelo, while those justices similar to Obama voted to take her property.
Although I would say that Bush is not a real conservative and he's practically no different to Obama compared to Barry Goldwater or Ronald Reagan. Conservatives voted to protect Kelo's home, but Bush was anything but a conservative.
I see, so you are saying that Municipal financing mainly determined the vote? A chance for pro unfettered-corporate Judges to curry public favor, while weakening Government & particularly public service employee unions?
